The process to select a jury began on October 14th at Suffolk Superior Court.

According to The Boston Globe, potential jurors were grilled about their impartiality on topics such as crimes committed by foreign nationals and victims of sexual assault who consumed alcohol.

The retrial will be presided over by Justice Joshua I Wall.

It comes after his first trial, held in June, was declared a mistrial by Judge Sarah Ellis after the jury failed to reach a verdict.

Crosbie spent four days on deliberations following five days of testimony.

He has remained in police custody in Boston since his arrest last year.

Following the mistrial, the judge declared him a flight risk and increased his bail from $10,000 to $50,000 cash.

Crosbie is charged with one count of rape on March 14th 2024, at the Omni Parker House hotel in Boston, which he has denied.

The 38-year-old from Dublin was detained at Boston Logan International Airport as he attempted to fly back to Ireland after speaking to cops.

Crosbie was in Boston with his employer, Dublin Fire Brigade, and was due to march in the city’s St. Patrick’s Day Parade.

The woman who accused Crosbie of rape, a 29-year-old lawyer, said she went to the Black Rose Irish Pub with her co-workers when she met an Irish man, Liam O’Brien, and his colleagues.

Video allegedly shows the woman leaving the restaurant with O’Brien at around 11.30 pm, and returning to the hotel room he was sharing with Crosbie.

The man and the woman had a “consensual encounter” before falling asleep in separate beds.

She said she awoke to Crosbie on top of her, raping her.

The first trial heard how DNA evidence collected from the complainant found two male profiles.

One matched O’Brien, while the owner of the second profile could not be conclusively identified.

During closing statements in the previous trial, his defence attorney, Daniel C Reilly, told jurors they should acquit Crosbie and argued there was not enough evidence to link Crosbie to the alleged rape.

“I’m going to ask you to end that nightmare and find him not guilty,” he said.

“The Commonwealth has not proven beyond a reasonable doubt that Mr Crosbie committed the crime he is accused of.”

Meanwhile, Suffolk Assistant District Attorney Erin Murphy asked: “If she was so drunk, or so mixed up, or if she was making up a story, then how did she have so much right?”

“It’s a misnomer to say the DNA was inconclusive. What is conclusive is that there were two distinct male profiles.

“There’s no mystery man here, there’s no phantom rapist who slipped off into the night. Terrence Crosbie is guilty.”

During the trial, Crosbie took the stand on Friday to adamantly deny raping the woman in the hotel room he was sharing with fellow firefighter, Liam O’Brien.

“I’ve done nothing wrong,” Crosbie told the court, adding, “100 per cent I didn’t do this. I had no physical or verbal contact with her at all.”
