A Toronto police officer who shot and killed a man pointing a BB gun at him at Danforth GO station will not be charged after an SIU investigation.

A Toronto police officer will not face criminal charges in the fatal shooting of a 32-year-old man at Danforth GO station late last year.

Ontario’s Special Investigations Unit says director Joseph Martino found no reasonable grounds to believe the officer committed a criminal offence in the Dec. 6, 2025 incident.

Investigators say the man was fatally shot after drawing a BB gun and pointing it at the officer during an early-morning interaction at the station.

Martino concluded the officer discharged his firearm to protect himself from what he reasonably believed was an imminent attack.

The shooting happened after police were called to the Main Street and Stephenson Avenue area around 1:08 a.m. for reports of a person with a gun. Officers located the man in a stairwell leading to Platform 3, where an interaction unfolded and shots were fired.

The man was struck multiple times and later pronounced dead in hospital.

In the release, officials note that they also seized $425 in cash, three baggies containing suspected drugs, two lighters, an empty cannabis container, medical debris and a pen.

At the time, the SIU assigned investigators and collected CCTV and body-worn camera footage, along with firearms recovered from the scene.

The SIU is an independent civilian agency that investigates incidents involving police where there has been death, serious injury, sexual assault, or the discharge of a firearm at a person.
