Sharif Rahman was attacked outside The Curry House restaurant in Owen Sound on August 17, 2023, after confronting them over an unpaid $150 bill.
The 44-year-old husband and father of a young girl died a week later in hospital.
Robert Evans (24) faces a charge of manslaughter, while his father Robert Busby Evans (47) and his uncle Barry Evans (54) are facing charges over helping him to leave the country.
Evidence heard during a court appearance stated the men were from an Irish Traveller community near Manchester, as first reported by the Canadian Broadcasting Corporation.
A recent judgement by a Scottish court on whether the two older men could be extradited outlined the Canadian case against them.
It is alleged by the Canadian government that Robert Evans’ uncle, Barry Evans, drove him 40 miles away from the town where the assault occurred.
His father, Robert Busby Evans, allegedly arranged for him to take a flight the next day to the United Kingdom.

The written judgement delivered on July 31 only dealt with whether the two older men are wanted in Canada on charges that could also be considered an alleged crime in Scotland.
Edinburgh Sheriff Julius Komorowski ruled there is a case to answer and a full extradition hearing is due next October.

“That Robert Evans (Junior) was not a wanted man when he left Owen Sound, or Canada entire, is irrelevant,” he wrote.
“The Canadian authorities essentially allege his departure was facilitated to avoid his apprehension if and when he became a wanted man.”
The court is also waiting for reports after lawyers for the men argued that conditions in Ontario prisons are so poor it would be a breach of their human rights to send them to Canada.

CBC reported that when officers arrived at The Curry House restaurant on August 17, 2023, they found Sharif lying unconscious on the ground.
A witness told police a man was seen punching him, causing him to fall backwards, and hit his head off the pavement.
Sharif was known as a generous and active member of his community, and the local mayor told how he’d cook food to help raise money for different causes.
There was an outpouring of grief and support in the wake of Sharif’s death and hundreds lined Owen Sound streets for his funeral.
