MIAMI — The Florida woman who shot and killed a drugged-up Army vet in a spat over a parking spot at a Walmart will not face charges after he allegedly hurled the N-word at her and threatened to “f— her s— up,” prosecutors revealed Thursday.

Bart Diguglielmo, a 62-year-old retired staff sergeant, was fatally shot in front of the supercenter in North Lauderdale just before 12:30 p.m. on June 30.

The shooter, identified as Melissa Payne, is immune from prosecution because she acted in self-defense due to the state’s “stand your ground” law, the Broward County state attorney’s office announced.

One witness said she had heard Diguglielmo threaten Payne before the shooting by saying “I’m gonna f— your s— up,” while another said he told her he was going to “mess her car up”, a legal memo stated.

Payne told deputies during a statement filmed on bodyworn camera footage and released Thursday that Diguglielmo had said “You n——” at her as the argument began.

“Florida is a Stand Your Ground State,” prosecutor Stephen J. Zaccor wrote. “MP (Melissa Payne) did not have to wait to be attacked before resorting to deadly force.

“She did not have to retreat as long as her fear was reasonable and no evidence has been presented to disprove that.”

Payne’s infant great-niece was in her vehicle during the incident, the memo said.

She was on the phone to her husband during the altercation and after firing told him, “Bae, I shot. Call the cops.”

A post-mortem later found that Diguglielmo had amphetamines, Delta 9 THC –– the psychoactive compound in cannabis –– and the SSRI antidepressant drug Sertraline in his blood.

Payne was briefly detained following the shooting and released after saying she was defending herself. 

The pair began arguing after Payne arrived in the parking lot in a white Chevrolet Malibu with her niece and great-niece, while Diguglielmo was driving alone in a Kia SUV.

Both attempted to park in the same space and a “brief stalemate” followed, with both drivers getting out of their vehicles, according to the legal memo.

Diguglielmo then “inexplicably” left his car in the lane of travel, went to retrieve a cart and walked into the Walmart, while Payne parked her vehicle and stayed in it while her niece went into the store.  

He returned to his vehicle after about a minute and a half and was filmed talking to Payne, with several witnesses saying that he was threatening her.  

After driving off at high speed, he parked up but instead of going into the store, he went back towards where Payne was sitting in her vehicle with her great-niece.

One witness described Diguglielmo –– later described by family as a decorated war veteran who served in Operation Desert Storm –– as “visibly angry” and shaking while smoking a cigarette and watching Payne.

Diguglielmo then walked towards Payne’s vehicle and she got out of her car with her phone in her left hand and a gun in her right.  

She yelled, “It’s not worth it!” and “If you keep coming up to me, I’m going to fucking shoot you!” according to one bystander.

Despite the warnings, Diguglielmo continued to advance on Payne while making hand gestures.

She claimed in her statement to police that he told her, “I’ve seen tougher a–holes than you, do it, shoot me.”

Video footage released by prosecutors showed that he followed her around another parked car before going up to Payne’s vehicle and motioning with his keys as if he was going to damage it.

He turned back and approached Payne, who then fired one shot into his abdomen, with the whole incident caught on video.  

Diguglielmo was rushed to Broward General Hospital but died there from his injuries. 

His cause of death was a gunshot wound and the manner of death was homicide, the medical examiner’s office found.

“The video does not demonstrate that MP was in the right, rather it demonstrates that the State of Florida cannot overcome her claim that she was in reasonable fear of great bodily harm by clear and convincing evidence,” Zaccor wrote.
