His defence team confirmed a written application had been lodged and Lynn would ask a judge to be released back into the community.
The former Jetstar pilot is accused of murdering retiree Carol Clay, 73, in Gippsland’s Wonnangatta Valley in March 2020.
At the time, Clay had been camping with friend Russell Hill, 74. Lynn was granted a retrial late last year.
