The government’s proposed 30 per cent minimum tax on discretionary trusts is being sold as a fairness measure. In reality, what has been proposed appears to rest on a deeply flawed assumption: that affected taxpayers can simply restructure out of trusts if they do not like the outcome.
For many legitimate Australian businesses, that is fantasy.
