{"id":117625,"date":"2025-09-04T06:54:08","date_gmt":"2025-09-04T06:54:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/117625\/"},"modified":"2025-09-04T06:54:08","modified_gmt":"2025-09-04T06:54:08","slug":"double-fault-trademark-registrations-or-lack-thereof-in-the-world-of-tennis-trademark","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/117625\/","title":{"rendered":"Double Fault: Trademark Registrations (Or Lack Thereof) In The World Of Tennis &#8211; Trademark"},"content":{"rendered":"<p>It&#8217;s that time of year where, for two weeks in late August&#13;<br \/>\nand early September, tens of thousands of people descend upon&#13;<br \/>\nFlushing Meadows in Queens, New York for the U.S. Open tennis&#13;<br \/>\ntournament. The biggest stars in the world of tennis are there,&#13;<br \/>\nfrom veteran players to up-and-comers hoping for an upset win. Fans&#13;<br \/>\npack the grounds, including Arthur Ashe Stadium, the largest&#13;<br \/>\ntennis-specific stadium in the world, named after the legendary&#13;<br \/>\ntennis star who passed away in 1993.<\/p>\n<p>Anyone who goes into Arthur Ashe Stadium or the other courts at&#13;<br \/>\nthe tournament, or who watches on TV, will likely see the&#13;<br \/>\ntournament logo: the words &#8220;US Open&#8221; with what appears to&#13;<br \/>\nbe a speeding yellow tennis ball above it. Keen observers may even&#13;<br \/>\nnote the \u00ae symbol in the logo. It will not surprise most folks&#13;<br \/>\nto learn that the United States Tennis Association (USTA) owns&#13;<br \/>\ntrademark registrations for that mark (such as U.S. Registration&#13;<br \/>\nNos. 5,934,944 and 5,929,884), as well as the UNITED STATES OPEN&#13;<br \/>\nTENNIS CHAMPIONSHIPS word mark (U.S. Registration No. 1,140,105).&#13;<br \/>\nThe USTA even has a registration and a pending application for&#13;<br \/>\nHONEY DEUCE, the name of the signature beverage of the tournament&#13;<br \/>\n(U.S. Registration No. 7,782,775 for alcoholic beverages; U.S.&#13;<br \/>\nSerial No. 99,266,182 for clothing).<\/p>\n<p>The phrase &#8220;US Open&#8221; is used by a wide variety of&#13;<br \/>\nsporting events, however, so there a number of other trademark&#13;<br \/>\nregistrations for the phrase, unrelated to the tennis tournament or&#13;<br \/>\nthe USTA. Sports ranging from golf (U.S. OPEN CHAMPIONSHIP, U.S.&#13;<br \/>\nRegistration No. 1,151,944) to bowling (U.S. OPEN, U.S.&#13;<br \/>\nRegistration No. 6,777,297) to Muay Thai (US OPEN, U.S.&#13;<br \/>\nRegistration No. 7,077,363) use the phrase or variations thereon.&#13;<br \/>\nIt is a crowded field, but the tennis tournament has carved out a&#13;<br \/>\nunique identity among users of the phrase.<\/p>\n<p>That made me wonder: have any top tennis players obtained U.S.&#13;<br \/>\ntrademark registrations relating to their names or brands? I was&#13;<br \/>\nsurprised to find that of the top five ranked women&#8217;s players,&#13;<br \/>\nonly one had registered trademarks that I could definitively&#13;<br \/>\ndetermine were owned by the player: the Polish player Iga Swiatek.&#13;<br \/>\nShe has registered or applied to register, through a foundation,&#13;<br \/>\n1GA (U.S. Registration No. 7,691,163); JAZDA (Polish for&#13;<br \/>\n&#8220;let&#8217;s go&#8221;) (U.S. Registration No. 7,873,751); IGA&#13;<br \/>\nSWIATEK (U.S. Serial No. 79,374,697); and TEAM SWIATEK (U.S. Serial&#13;<br \/>\nNo. 79,374,695).<\/p>\n<p>On the men&#8217;s side, there are similarly few trademarks among&#13;<br \/>\nthe top five. Italian Jannik Sinner appears to have registered a&#13;<br \/>\nlogo (U.S. Registration No. 7,089,046) and JANNIK SINNER (U.S.&#13;<br \/>\nRegistration No. 7,088,922). Spaniard Carlos Alcaraz has registered&#13;<br \/>\nCARLOS ALCARAZ (U.S. Registration No. 7,646,319). That appears to&#13;<br \/>\nbe it for the top five players.<\/p>\n<p>With name, image, and likeness (or NIL) rights exploding in&#13;<br \/>\ncollege sports, and athletes and other celebrities increasingly&#13;<br \/>\nacting like entrepreneurs, it may not be long before tennis players&#13;<br \/>\nsee the value of filing an application as essential as stringing a&#13;<br \/>\nracquet. As we&#8217;ve described in prior posts, athletes like <a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1673600&amp;company_id=7122&amp;redirectaddress=https:\/\/www.gadgetsgigabytesandgoodwill.com\/2025\/07\/boxing-out-competitors-wnba-star-angel-reeses-growing-trademark-portfolio\/\" rel=\"noreferrer noopener nofollow\" target=\"_blank\">Angel Reese, Caitlin&#13;<br \/>\nClark, Breanna Stewart, and Flau&#8217;jae Johnson<\/a>, and&#13;<br \/>\ncelebrities like <a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1673600&amp;company_id=7122&amp;redirectaddress=https:\/\/www.gadgetsgigabytesandgoodwill.com\/2025\/08\/taylor-swifts-trademark-era-how-the-life-of-a-showgirl-reinforces-her-ip-empire\/\" rel=\"noreferrer noopener nofollow\" target=\"_blank\">Taylor Swift<\/a>, <a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1673600&amp;company_id=7122&amp;redirectaddress=https:\/\/www.gadgetsgigabytesandgoodwill.com\/2025\/06\/turn-the-trademarks-off-the-trademarks-of-kendrick-lamar-sza-and-beyonce\/\" rel=\"noreferrer noopener nofollow\" target=\"_blank\">Beyonce, Kendrick Lamar,&#13;<br \/>\nand SZA<\/a>, have been building their trademark portfolios to&#13;<br \/>\nprotect their personal brands. In today&#8217;s sports economy,&#13;<br \/>\nfailing to register a mark might be the real unforced error. Will&#13;<br \/>\nwe see start to see more tennis players serving up trademark&#13;<br \/>\napplications?
