But will Australian writers benefit?"},"content":{"rendered":"<p>Anthropic, an AI startup founded in 2021, has reached a groundbreaking <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/sep\/05\/anthropic-settlement-ai-book-lawsuit\" rel=\"nofollow noopener\" target=\"_blank\">US$1.5 billion settlement<\/a> (AU$2.28 billion) in a class-action copyright lawsuit. The case was initiated in 2024 by novelist Andrea Bartz and non-fiction writers Charles Graeber and Kirk Wallace Johnson. <\/p>\n<p>If the settlement is approved by the presiding judge, the company will pay authors about US$3,000 for each of the estimated 500,000 books included in the agreement. It will destroy illegally downloaded books and refrain from using pirated books to train chatbots in the future. <\/p>\n<p>This is the largest copyright settlement in US history, establishing a crucial legal precedent for the evolving relationship between AI companies and content creators. <\/p>\n<p>It will have implications for numerous other copyright cases currently underway against AI companies <a href=\"https:\/\/www.theguardian.com\/books\/2025\/apr\/04\/us-authors-copyright-lawsuits-against-openai-and-microsoft-combined-in-new-york-with-newspaper-actions\" rel=\"nofollow noopener\" target=\"_blank\">OpenAI, Microsoft<\/a>, <a href=\"https:\/\/www.bakerlaw.com\/leovy-v-google\/\" rel=\"nofollow noopener\" target=\"_blank\">Google<\/a>, and most recently <a href=\"https:\/\/www.publishersweekly.com\/pw\/by-topic\/industry-news\/industry-deals\/article\/98546-apple-sued-by-authors-for-copyright-infringement.html\" rel=\"nofollow noopener\" target=\"_blank\">Apple<\/a>. In June, Meta prevailed in a copyright case brought against it, though the ruling <a href=\"https:\/\/www.cnbc.com\/2025\/06\/25\/meta-llama-ai-copyright-ruling.html\" rel=\"nofollow noopener\" target=\"_blank\">left open the possibility of other lawsuits<\/a>.<\/p>\n<p>The settlement follows a <a href=\"https:\/\/www.ropesgray.com\/en\/insights\/alerts\/2025\/06\/from-books-to-bots-key-takeaways-from-the-anthropic-fair-use-decision-for-ai-developers\" rel=\"nofollow noopener\" target=\"_blank\">landmark US ruling<\/a> on AI development and copyright law, issued in June 2025, that separated legal AI training from illegal acquisition of content. Anthropic allegedly pirated <a href=\"https:\/\/www.reuters.com\/legal\/government\/us-authors-suing-anthropic-can-band-together-copyright-class-action-judge-rules-2025-07-17\/\" rel=\"nofollow noopener\" target=\"_blank\">over seven million books<\/a> from two online \u201cshadow libraries\u201d in June 2021 and July 2022. <\/p>\n<p>The plaintiffs and Anthropic are expected to finalise a list of works to be compensated by September 15.<\/p>\n<p>Cautious optimism<\/p>\n<p>In Australia, the response to news of a potential settlement has been cautiously optimistic. <a href=\"https:\/\/publishers.asn.au\/Web\/Web\/About-Us\/People\/Staff.aspx\" rel=\"nofollow noopener\" target=\"_blank\">Stuart Glover<\/a>, head of policy at the Australian Publishers Association told me: <\/p>\n<p>We welcome these court-enforced steps towards accountability, but this settlement shows why AI companies must respect copyright and pay creators \u2013 not just see what they can get away with. <\/p>\n<p>And for the sake of Australian authors and publishers whose works have been unlawfully scraped without compensation under this action, it\u2019s a clear call for the Australian government to maintain copyright and mandate that AI companies pay for what they use.<\/p>\n<p><a href=\"https:\/\/www.authorslegal.org\/lucy-hayward\" rel=\"nofollow noopener\" target=\"_blank\">Lucy Hayward<\/a>, CEO of the Australian Society of Authors, told me: <\/p>\n<p>While all of the details are yet to be revealed, this settlement could represent a very welcome acknowledgement that AI companies cannot just steal authors\u2019 and artists\u2019 work to build their large language models.<\/p>\n<p>            <a href=\"https:\/\/images.theconversation.com\/files\/690047\/original\/file-20250910-64-m7hckm.jpg?ixlib=rb-4.1.0&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" alt=\"\" class=\"lazyload\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/09\/file-20250910-64-m7hckm.jpg\"  \/><\/a><\/p>\n<p>              Lucy Hayward has called for ongoing compensation for Australian authors whose work has been used to train AI models.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.asauthors.org.au\/our-team\/\" rel=\"nofollow noopener\" target=\"_blank\">Australian Society of Authors<\/a><\/p>\n<p>However, in the Anthropic case, authors will be only compensated if their publishers have <a href=\"https:\/\/www.uspto.gov\/ip-policy\/copyright-policy\/copyright-basics\" rel=\"nofollow noopener\" target=\"_blank\">registered their work<\/a> with the US copyright office within a certain timeframe. Hayward expressed concern about this, as the seven million works that are alleged to have been pirated were written by authors from around the world and \u201cwe suspect many international authors may miss out on settlement money.\u201d <\/p>\n<p>She has called on Australian the government to introduce new laws requiring tech companies to \u201cpay ongoing compensation to creators where Australian books have been used to train models offshore\u201d.<\/p>\n<p>Legal risks<\/p>\n<p>In June, US judge William Alsup ruled that using books to train AI was <a href=\"https:\/\/www.bbc.com\/news\/articles\/c77vr00enzyo\" rel=\"nofollow noopener\" target=\"_blank\">not a violation of US copyright law<\/a>. But he ruled Anthropic would still have to stand trial over its use of pirated copies to build its library of material. <\/p>\n<p>Judge Alsup has since criticised the settlement for its loopholes. He has scheduled another hearing for September 25. \u201cWe\u2019ll see if I can hold my nose and approve it,\u201d he <a href=\"https:\/\/apnews.com\/article\/anthropic-authors-book-settlement-ai-copyright-claude-b282fe615338bf1f98ad97cb82e978a1\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a>. <\/p>\n<p>If the settlement is not approved, Anthropic risks significantly greater financial repercussions. The trial is scheduled for December. If the company loses the case, US copyright law allows for statutory damages of <a href=\"https:\/\/copyrightalliance.org\/education\/copyright-law-explained\/copyright-infringement\/copyright-statutory-damages\/\" rel=\"nofollow noopener\" target=\"_blank\">up to $150,000<\/a> per infringed work in cases of wilful copyright infringement. <\/p>\n<p>William Long, a legal analyst at Wolters Kluwer, <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/sep\/05\/anthropic-settlement-ai-book-lawsuit\" rel=\"nofollow noopener\" target=\"_blank\">suggests<\/a> potential damages in a trial could reach multiple billions of dollars, potentially jeopardising or even bankrupting the company. <\/p>\n<p>Anthropic recently secured new funding worth <a href=\"https:\/\/www.anthropic.com\/news\/anthropic-raises-series-f-at-usd183b-post-money-valuation\" rel=\"nofollow noopener\" target=\"_blank\">US$13 billion<\/a>, bringing its total value to <a href=\"https:\/\/www.theverge.com\/anthropic\/769179\/anthropic-is-now-valued-at-183-billion\" rel=\"nofollow noopener\" target=\"_blank\">$183 billion<\/a>. Keith Kupferschmid, president and CEO of the US-based Copyright Alliance, <a href=\"https:\/\/www.npr.org\/2025\/09\/05\/nx-s1-5529404\/anthropic-settlement-authors-copyright-ai\" rel=\"nofollow noopener\" target=\"_blank\">has argued<\/a> that this is evidence \u201cAI companies can afford to compensate copyright owners for their works without it undermining their ability to continue to innovate and compete\u201d.<\/p>\n<p>For <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/sep\/05\/anthropic-settlement-ai-book-lawsuit\" rel=\"nofollow noopener\" target=\"_blank\">Mary Rasenberger<\/a>, CEO of the Authors Guild, the historic settlement is \u201can excellent result for authors, publishers, and rightsholders\u201d. <a href=\"https:\/\/authorsguild.org\/news\/what-authors-need-to-know-about-the-anthropic-settlement\/\" rel=\"nofollow noopener\" target=\"_blank\">Rasenberger<\/a> expects \u201cthe settlement will lead to more licensing that gives author[s] both compensation and control over the use of their work by AI companies, as should be the case in a functioning free market society.\u201d<\/p>\n<p>A step forward<\/p>\n<p>While this particular settlement may offer little help to Australian writers and publishers whose works are not registered with the US Copyright Office, overall it is at least <a href=\"https:\/\/journals.library.columbia.edu\/index.php\/lawandarts\/article\/view\/13925\/7689\" rel=\"nofollow noopener\" target=\"_blank\">potentially good news<\/a> for creators globally. It represents a step towards the establishment of a legitimate licensing scheme.<\/p>\n<p>Australian copyright law does not include a US-style \u201cfair use\u201d exception, which AI companies claim protects their training practices. There have been calls to change the law with major AI players, including <a href=\"https:\/\/www.abc.net.au\/news\/2023-08-03\/fight-brews-on-ai-copyright-unions-say-big-tech-must-pay\/102677032\" rel=\"nofollow noopener\" target=\"_blank\">Google and Microsoft<\/a>, lobbying the Australian government for copyright exemptions. <\/p>\n<p>The recent Productivity Commission interim <a href=\"https:\/\/www.pc.gov.au\/inquiries\/current\/data-digital\/interim\" rel=\"nofollow noopener\" target=\"_blank\">report<\/a> proposed a text and data mining exception to the Australian Copyright Act, which would allow AI training on copyrighted Australian work. The proposal faced strong opposition from the <a href=\"https:\/\/www.asauthors.org.au\/news\/asa-opposes-productivity-commission-proposal-for-copyright-exception\/\" rel=\"nofollow noopener\" target=\"_blank\">Australian Society of Authors<\/a> and the <a href=\"https:\/\/publishers.asn.au\/Web\/Web\/Latest\/IndustryNews\/20250806-Australian-publishers-oppose-AI-exemptions.aspx\" rel=\"nofollow noopener\" target=\"_blank\">publishing industry<\/a>.  <\/p>\n<p>As Arts Minister <a href=\"https:\/\/minister.infrastructure.gov.au\/burke\/speech\/book-conference\" rel=\"nofollow noopener\" target=\"_blank\">Tony Burke<\/a> stated in August 2025, the government has \u201cno plans, no intention, no appetite to be weakening\u201d our copyright laws.<\/p>\n<p>The Australian publishing industry is not entirely opposed to AI, but significant legal and ethical challenges remain.
