Billionaire businessman Clive Palmer’s human rights complaint has been referred to the Supreme Court amid ongoing legal battles.<\/p>\n
The complaint was referred to the Supreme Court on Friday after the Brisbane Magistrates Court heard the prosecution had failed to disclose some documents.<\/p>\n
Mr Palmer is facing two counts of fraud and dishonestly using his position as a company director to funnel millions into his party’s 2013 election campaign, and\u00a0in a separate matter, his company is charged with breaching company takeover laws in 2012.\u00a0<\/p>\n
Mr Palmer alleged he and his family had suffered because of the delays.<\/p>\n
Magistrate Cameron McKenzie ruled in his favour but also expressed sympathy for the prosecution, which he said had been taken on “a number of sidesteps and tangents” with the proceedings.<\/p>\n
“Mr Palmer has unsuccessfully taken issue with nearly every matter in this court,” he said.<\/p>\n
“Those other proceedings would most likely have taken the prosecution’s focus away from their disclosure obligations.”<\/p>\n

In 2020, the Australian Securities and Investments Commission (ASIC) charged Mr Palmer with two counts of fraud and dishonestly using his position as a director to fund his successful campaign to enter federal parliament.<\/p>\n
Mr Palmer was accused of transferring more than $12m through his company Mineralogy, via two companies Media Circus Network and Cosmo Developments in 2013.<\/p>\n
The maximum penalty is $340,000 or imprisonment for five years, or both.<\/p>\n

In a second matter, Mr Palmer and his company, Palmer Leisure Coolum (PLC), were charged with breaching takeover laws in 2012 over a proposed buyout of a timeshare investor.<\/p>\n
ASIC alleged Mr Palmer and PLC failed to make the offer within the required two-month timeframe. He was charged with aiding or procuring the company to commit this offence.<\/p>\n
The ruling on Friday was a small victory for Mr Palmer who is defending the charges.<\/p>\n
“I’m very grateful to the court,” he said.<\/p>\n
“I’m always under persecution by somebody at some time because my views are quite controversial.”<\/p>\n

“The events they complain about are in 2012 and this particular matter, I wasn’t charged until 2018, and they haven’t completed disclosure in the last seven years,” Mr Palmer said.<\/p>\n
