(ABC News: Eddy Gill)<\/p>\n<p>Who can fill out the form?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Brisbane conveyancer Darren Morris said he had been telling potential clients they could fill out the &#8220;simple document&#8221; themselves.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;They can do the couple of small searches themselves online with their credit card [and] get the information instantly,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;You&#8217;ve got this fairly innocuous document which everybody is telling everybody else is incredibly important [and] that you can&#8217;t do it yourself and you can&#8217;t assist with \u2013 as a sales agent.<\/p>\n<p>&#8220;I keep shaking my head.&#8221;<img decoding=\"async\" alt=\"A man in a blue shirt seated at a desk with a yellow wall office behind him and a shelf full of folders.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/09\/9d6aec81d932f776adafec5158a3d937\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Darren Morris says buyers can do simple searches themselves online. (ABC News: Stephen Clarke)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mr Morris said he believed there was &#8220;absolutely&#8221; an industry being created through the introduction of disclosure documents, and said the combination of fees, inconvenience and stress could mean the seller &#8220;loses&#8221; under the new laws.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But he said buyers may not necessarily be winners, either \u2013 particularly if they did not read the document thoroughly.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mr Dunn encouraged sellers to &#8220;have a conversation&#8221; with the person who will be filling out the form.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;There are some things that searches need to be undertaken for and there&#8217;s other things that are certainly within the knowledge of the seller,&#8221; he said.<\/p>\n<p>What do the disclosure laws mean for buyers and sellers?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">While there&#8217;s no official required waiting period under the seller disclosure scheme, real estate agents have reported waiting up to ten days to get the required documentation.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2025-08-09\/queensland-property-market-frozen-seller-disclosure\/105624028\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Queensland&#8217;s housing market &#8216;frozen&#8217; after new property laws come into effect<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Tough new disclosure laws for property sales came into effect in Queensland on August 1.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mr Navybox said he&#8217;s concerned that could result in buyers getting &#8220;gazumped&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">That&#8217;s the term used when a seller accepts one buyer&#8217;s offer but then backs out of the agreement for a better offer before the contract has been legally signed.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;You will find this word &#8216;gazumping&#8217; will be used rampantly throughout Queensland because there will be prices agreed on properties and there will be buyers and sellers changing their mind for different reasons,&#8221; Mr Navybox said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But Mr Dunn said he believed the scheme would prove beneficial for both buyers and sellers.<\/p>\n<p>&#8220;This is something that&#8217;s been thought out to work in the way that we do property here in Queensland,&#8221;  he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;The last thing you want is contracts falling over at the eleventh hour because something important and terrible has only just been found.&#8221;<\/p>\n<p><img decoding=\"async\" alt=\"a house for sale in the brisbane suburb of stafford with the sale sign in the front yard \" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/09\/a3293b3333702ad2037e40a62d739e93\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The new laws apply to all contracts entered into on or after August 1, 2025, regardless of when the property was listed for sale. (ABC News: Liz Pickering)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But what constitutes a material matter may vary depending on the particular circumstances of the sale.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Property lawyer Jeremy Streten said material issues would have to be something that would have caused the buyer not to go ahead with the purchase.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Interestingly it&#8217;s an objective test, so it&#8217;s what a reasonable person would do.
