Is making housing a human right the answer?"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">It&#8217;s never been done in Australia before \u2014 enshrining housing as a human right.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But it&#8217;s a concept that will soon become a reality in the ACT.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The territory&#8217;s Legislative Assembly unanimously passed legislation this week that will require the government to consider access to adequate housing in all of its decisions and policymaking.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It&#8217;s a move that might bring hope to the more than 3,400 approved applicants on the ACT&#8217;s public housing waitlist, who are waiting about five years on average.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It might also spark hope among those struggling to find an affordable rental \u2014 over five years, <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-07-24\/canberra-rents-changing-but-still-challenging\/105566738\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/105566738\" rel=\"nofollow noopener\" target=\"_blank\">Canberra&#8217;s median rent prices increased 18 per cent for houses and 20 per cent for units<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">And for those still chasing the Australian dream, making housing a human right might make them feel like home ownership is within their grasp.<\/p>\n<p><img decoding=\"async\" alt=\"An aerial view of a collection of high-rise buildings, with a lake in the foreground and Telstra Tower in the background.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/09\/a0bcd1f26f309960f5026c61e995da71\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Canberra&#8217;s rents have increased signficantly over the past five years. (ABC News: Matt Roberts)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But will Canberrans actually feel a tangible benefit when this change comes in?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The answer for the vast majority: no. At least, not immediately.<\/p>\n<p>Time for change<\/p>\n<p class=\"paragraph_paragraph__iYReA\">There&#8217;s consensus, even from the community organisations that have advocated for the change for years, that the new law won&#8217;t solve the housing crisis overnight.<\/p>\n<p>&#8220;When this legislation comes into effect, it won&#8217;t mean everything is solved straight away,&#8221;  ACT Shelter CEO Corinne Dobson said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;But over time, the government will need to show that it is moving in the direction of ensuring that everyone has the right to adequate housing.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">And to be clear: it doesn&#8217;t mean the government has to provide a house for everybody.<\/p>\n<p><img decoding=\"async\" alt=\"A man wearing a light grey suit looks serious.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/09\/5b0e87ad087409fd9be49b42c9dea4c7\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Shane Rattenbury hopes the bill will start reshaping the way housing is thought about in the city. (ABC News: Ian Cutmore)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In the words of ACT Greens leader Shane Rattenbury, who authored the bill, &#8220;it will start the process of reshaping the way we think about housing in this city&#8221;.<\/p>\n<p>&#8220;It will create a new requirement, by law, for the government to treat housing not as a private asset for wealth creation, but as a foundational social good,&#8221;  he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Though not everyone is convinced that lofty goal can be achieved.<\/p>\n<p>Should others states follow?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Chris Martin, a senior research fellow at the City Futures Research Centre at UNSW said the legislation was not &#8220;a radical change in thinking&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;But it&#8217;s definitely a step in the right direction and something that other jurisdictions should be looking at to better organise the way we think about and do housing,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Dr Martin said the legislation had some limitations \u2014 it doesn&#8217;t impact decisions made by private landlords, for example.<\/p>\n<p>&#8220;It doesn&#8217;t mean ACT citizens suddenly have a whole lot of new rights,&#8221;  he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;But it does signal that the ACT government will consider the right to housing when they make laws and also when they make decisions about individual people interacting with them.&#8221;<\/p>\n<p><img decoding=\"async\" alt=\"An A-frame sign that reads &quot;auction today&quot;, directing toward a house.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/09\/f1a92c4d503ecfc501959cd895c23248\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Chris Martin said the legislation doesn&#8217;t impact decisions made by private landlords. (ABC News: Ian Cutmore)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Importantly, the legislation also opens the government up to possible legal challenges, providing a mechanism for Canberrans to hold decision-makers to account.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Human Rights Minister Tara Cheyne said the bill &#8220;recognises that access to adequate housing must be progressively realised over time&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But she also confirmed that certain protections must be guaranteed sooner \u2014 including protection against unlawful and arbitrary eviction.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It won&#8217;t solve all of our housing challenges overnight but [it&#8217;s a] pretty powerful building block to our legal foundation,&#8221; she said.<\/p>\n<p>A first step<a href=\"https:\/\/www.abc.net.au\/news\/2025-04-17\/canberra-housing-rental-stress-for-students-pensioners-families\/105182406\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Tiana affords rent by having her landlords live in her backyard<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">There is a widening housing divide in a city that boasts the highest weekly median income in the country.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The Australian-first laws will take effect in January 2027.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But there&#8217;s a delayed start, allowing additional time for the government to prepare during a two-year implementation period.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">That means the broad scope of including the right to housing in the Human Rights Act won&#8217;t commence until January 2029.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">While many agree enshrining housing as a human right is a good first step, to solve some of the housing issues in the territory, this feels like the first step in a marathon.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">And the government will need plenty of focus to make it to the finish line.<\/p>\n","protected":false},"excerpt":{"rendered":"It&#8217;s never been done in Australia before \u2014 enshrining housing as a human right.
