{"id":193949,"date":"2025-10-06T20:04:09","date_gmt":"2025-10-06T20:04:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/193949\/"},"modified":"2025-10-06T20:04:09","modified_gmt":"2025-10-06T20:04:09","slug":"sussan-ley-elevates-case-of-trans-offender-seeking-minimum-jail-terms-for-child-exploitation-crimes","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/193949\/","title":{"rendered":"Sussan Ley elevates case of trans offender, seeking minimum jail terms for child exploitation crimes"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">Opposition Leader Sussan Ley has demanded mandatory minimum jail terms for child exploitation offences, as the Coalition seeks to further drive a wedge through Labor on an issue the party has long opposed, but yielded to before the federal election.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In making its demand, the Coalition has raised the case of a Victorian parent who was given a four-year and nine-month jail term after sexually abusing their five-year-old daughter on at least 19 occasions, as well as producing child abuse material.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The sentence carried a non-parole period of two and a half years.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;&#8221;If a parent abuses their child 19 times and only receives a two-and-a-half year prison sentence, the system is broken and needs to be fixed immediately,&#8221; Ms Ley said in a statement.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;When a monster abuses a five-year-old child, yet is then free to roam the streets of Victoria when that poor child hasn&#8217;t even turned eight, that is not justice \u2014 it is a betrayal.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The 2024 case prompted fury within some political circles, as the judge accepted that the parent had reduced &#8220;moral culpability&#8221; due to isolation and vulnerability resulting from the parent&#8217;s gender transition from male to female.<\/p>\n<p>Coalition elevates case of trans woman who abused child<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The parent, who was given the pseudonym Maloney, was found to have provided child abuse material to a paedophile overseas, who Victorian County Court Judge Nola Karapanagiotidis said in her sentencing remarks had manipulated and coerced Maloney.<\/p>\n<p>If you or anyone you know needs help:<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Justice Karapanagiotidis said Maloney was &#8220;much less able to make objectively the right and healthy choices&#8221; due to loneliness and Maloney&#8217;s &#8220;vulnerabilities&#8221;, also taking into consideration &#8220;additional hardship&#8221; Maloney would likely face in prison as a trans woman.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I do accept that your moral culpability, which I would otherwise assess as high, is reduced by reason of these factors,&#8221; Justice Karapanagiotidis said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Anti-trans think tank Women&#8217;s Forum Australia has campaigned for the case to be reviewed by the Victorian government, claiming it could create an incentive for offenders to identify as transgender in order to seek a reduced sentence.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The sentence was also reduced due to Maloney&#8217;s guilty plea, first-time offending, relative youth and prospects of rehabilitation.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Maloney was given an effective non-parole period of six months for the Commonwealth offences of producing and distributing child abuse material, which followed a two-year non-parole period for the other offences.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The Coalition has said that fell well short of an offence that is punishable with a maximum term of 15 years&#8217; prison, and is calling for minimum terms of three years for those offences.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Those who abuse children should expect to do serious time behind bars. (ABC News: Matt Roberts)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The opposition&#8217;s decision to elevate the case is a shift from former opposition leader Peter Dutton&#8217;s cautious approach last term \u2014 the former Liberal leader largely avoided the debate <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-01-23\/dutton-shuts-down-transgender-debate-lean-in-littleproud\/104849652\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/104849652\" rel=\"nofollow noopener\" target=\"_blank\">and instructed his colleagues to do the same<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The opposition&#8217;s demand also puts the Albanese government under pressure to further compromise its party platform.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Labor&#8217;s national platform explicitly opposes mandatory minimum jail sentencing, which it says does not reduce crime &#8220;but does undermine the independence of the judiciary, lead to unjust outcomes and is often discriminatory in practice&#8221;.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2025-02-05\/labor-to-implement-mandatory-minimum-sentences-for-hate-crimes\/104902500\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Labor backs mandatory sentences for hate crimes<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Federal Labor has agreed to Coalition demands on mandatory minimum jail sentences, paving the way to pass the government&#8217;s Hate Crimes bill in parliament.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">However, after a summer of antisemitic incidents and intense pressure from the Coalition to respond, the federal government introduced laws to require minimum terms for terror and hate crimes, as well as the display of Nazi symbols.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">That decision was a break from Labor&#8217;s longstanding position on mandatory sentences, and was criticised by the legal fraternity.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">After the federal government&#8217;s capitulation in February, the Law Council of Australia expressed it was &#8220;extremely disappointed&#8221; by a decision it said would fail to take the personal circumstances of offenders into consideration.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;This has the potential to disproportionately impact vulnerable groups,&#8221;
