What began as a private inheritance dispute has erupted into a courtroom thriller, with lawyers for Kapur\u2019s children from his second marriage \u2014 Samaira and Kiaan Kapur, whose mother is Bollywood actor Karisma Kapoor \u2014 alleging a deliberate digital manipulation of files, secret WhatsApp groups, and a forged signature trail. The outcome could redefine not just the balance of one family\u2019s fortune but the boundaries of digital evidence in India\u2019s inheritance law.<\/p>\n

Senior advocate Mahesh Jethmalani, representing the two children, told the bench that the contested will \u201cwas not the product of the deceased\u2019s hand or mind\u201d but a \u201cmanufactured document\u201d created and edited on another man\u2019s computer. According to Jethmalani, metadata shows that the will originated on the device of one Nitin Sharma, a person with no formal connection to Sunjay Kapur. \u201cWho prepared this will?\u201d he asked. \u201cThe file was created and altered on Sharma\u2019s system on March 17, 2025 \u2014 the very day Sunjay was in Goa with his son Kiaan. It defies logic that he would rewrite his will on holiday while disinheriting his own children.\u201d<\/p>\n
The counsel added that the Word file was converted into a PDF on March 24 at 10:06 a.m., hours before a WhatsApp group named Family Office IC was formed to circulate it among a select circle that included Sharma, Priya Kapur, and Dinesh Agarwal, a director of Aureus Investment Pvt Ltd, part of the Sona BLW promoter group.<\/p>\n
\u201cImmediately after the document was shared,\u201d Jethmalani said, \u201cPriya Kapur responded, \u2018Okay, thank you!\u2019 \u2014 with no surprise or hesitation. It reads like an acknowledgment of a task completed, with no endorsement from the deceased.\u201d<\/p>\n
Digital footprints and missing links<\/p>\n
Jethmalani argued that the electronic evidence showed multiple, unidentified edits before and after Kapur\u2019s death, pointing to \u201ca secretive and coordinated effort.\u201d The will, he said, surfaced only on the 13th day after the cremation of the deceased. \u201cThere is no explanation for where this document was stored or who had possession of it,\u201d he said. \u201cThe entire chain of custody is broken.\u201d<\/p>\n
Contradictions and omissions<\/p>\n
The will, Jethmalani told the court, contains glaring internal contradictions \u2014 listing three bank accounts in one section and six in another, while omitting key properties including Kapur\u2019s New York apartment, a 2010 family trust, and holdings in jewellery, artwork, and precious metals. \u201cThese are not clerical errors,\u201d he said. \u201cA Harvard-educated industrialist of Sunjay Kapur\u2019s precision could not have drafted a document this casual.\u201d<\/p>\n
Even more striking, he said, are the incorrect addresses of Samaira and Kiaan and the five inconsistent spellings of his youngest son Azarias\u2019 name. \u201cA meticulous and affectionate father would never commit such mistakes,\u201d he said.<\/p>\n
\u201cA will standing on air\u201d<\/p>\n
Jethmalani also drew attention to the absence of a schedule of assets, a mandatory annexure detailing the testator\u2019s holdings. The bench itself described the omission as \u201ca serious procedural lapse.\u201d<\/p>\n
\u201cWithout it,\u201d Jethmalani said, \u201cthis will stands on air. It lists no inventory of what the deceased owned, and even the named executor appears unaware of the estate\u2019s scale.\u201d<\/p>\n
A matter of character and credibility<\/p>\n
To reinforce his case, Jethmalani portrayed Sunjay Kapur as \u201ca devoted father and a perfectionist in both business and life,\u201d citing his education at the University of Buckingham and Harvard Business School. \u201cHe never missed Kiaan\u2019s birthdays,\u201d he said. \u201cThe idea that such a man would exclude his children is beyond belief.\u201d Concluding his arguments, Jethmalani declared: \u201cThis will should be cast into the dustbin of history. It bears no mark of the deceased\u2019s hand or heart.\u201d<\/p>\n
Court reaction and adjournment<\/p>\n
The High Court said the evidence raised \u201csubstantial questions\u201d about the will\u2019s origin and internal coherence. The case was adjourned to Tuesday, October 14, for further examination of the digital trail and the physical document\u2019s custody.<\/p>\n
Priya Kapur\u2019s counsel maintains that \u201cunimpeachable electronic evidence\u201d supports the will\u2019s authenticity. But for Samaira and Kiaan, the fight has become a broader test of truth \u2014 pitting memory against metadata in one of India\u2019s most closely watched inheritance battles.<\/p>\n
