\"Priya Priya Kapur has taken a firm stand in the ongoing legal battle over the late industrialist Sunjay Kapur\u2019s estate, opposing the civil suit filed by Karisma Kapoor<\/a>\u2019s children who are claiming a share of their late father\u2019s fortune.According to an ANI report, in Wednesday\u2019s hearing at the Delhi High Court<\/a>, Senior Advocate Rajiv Nayar, representing Priya, argued that the will dated March 21, 2025 is valid and the children\u2019s challenge is entirely \u201cbogus,\u201d setting the stage for a high\u2011stakes courtroom clash over the late industrialist\u2019s personal assets.<\/p>\n

Priya Kapur challenges legality of inheritance suit<\/p>\n

Rajiv Nayar argued that the entire plaint filed by Karisma Kapoor\u2019s children had no legal basis. He said, \u201cThere is no challenge to this Will.\u201d He pointed out that the children knew about the will as early as 30 July, when it was disclosed, and a formal will reading was held in their presence. Yet, the suit was filed on September 9 without any mention of the will.The document was officially shared with the plaintiffs on 15 September as directed by the court. \u201cEven after that, there was no amendment to the plaint or any replication challenging the will,\u201d Nayar added.<\/p>\n

Court hears debate on will\u2019s validity<\/p>\n

On the issue of maintainability, Nayar said, \u201cI ask myself in which proceeding are we putting the Will to issue? This is not a probate proceeding. You have not challenged the execution or validity of the Will in the pleadings. There is no declaration sought for cancelling it.\u201dHe described the children\u2019s case as a \u201cnon-existent and bogus challenge,\u201d adding that after the recent Supreme Court judgment, the court can suo motu reject the plaint if it shows no cause of action.<\/p>\n

Priya Kapur defends will against minor errors<\/p>\n

Addressing discrepancies raised by Karisma\u2019s children, Nayar said, \u201cI am told that there are four additional grounds to invalidate a will, wrong spelling, wrong address, writing testatrix instead of testator, and the closeness of witnesses. In my 45 years of experience, I have never seen a Will invalidated for spelling errors. Forgery has to be complete, no mistakes would be left. And this lady (Priya Kapur) is not a housewife; she is an investment banker. Would she spell her son’s name wrong?\u201dNayar added that minor errors cannot invalidate a properly executed will. The only questions that matter, he said, are whether the deceased was of sound mind and whether the will was executed in the presence of two witnesses. \u201cA will is not judged by whose custody it remained in or when it surfaced, but by whether it bears genuine signatures and proper attestation,\u201d Nayar explained.<\/p>\n

Lawyers discuss family tensions in court<\/p>\n

Nayar also addressed the emotional arguments raised by the other side, saying, \u201cThis is wife versus wife, obviously, the current wife would be preferred, not the estranged one.\u201dNayar said his submissions were meant only to \u201cdispel allegations\u201d and show that prima facie the will was valid. He added that the execution and disclosure of the will were placed on affidavit and that there was no material before the court to suggest otherwise. \u201cThe execution of the will and the course of disclosure have been detailed. There is no basis for assuming a different narrative,\u201d he said.The court concluded Wednesday\u2019s hearing after these submissions. The matter will continue on Friday for further arguments.<\/p>\n
