By entering the multiyear deals, which were announced today, the NHL becomes the \u201cfirst major U.S. professional sports league to allow the use of its trademarks by prediction markets.\u201d Such upstart trading platforms have \u201cencroached on the turf\u201d of established gambling companies by \u201coffering \u2018event contracts\u2019 on games that are similar to traditional sports bets.\u201d So far, Kalshi has \u201cavoided using trademarked terms such as \u2018NFL\u2019 or \u2018Super Bowl\u2019\u201d on its app and website. Instead, it uses terms such as \u201cPro football champion\u201d and \u201crefers to teams by their cities.\u201d The NFL and other leagues have \u201clong been vigilant about potential infringement of their intellectual property.\u201d With the NHL deal, both Kalshi and its rival Polymarket will have the league\u2019s \u201cgreenlight to use its logo, terms such as \u2018NHL\u2019 and \u2018Stanley Cup,\u2019 and names of individual teams.\u201d The NHL has \u201csimilar agreements in place with sportsbook operators\u201d such as DraftKings, FanDuel and BetMGM.
