The man arrested following the death of a three-year-old boy in the foyer of a Queensland police station has been denied bail.<\/p>\n
He faced the Southport Magistrates Court on Monday charged with an aggravated contravention of a domestic violence order and breaching bail.<\/p>\n
Police said on the weekend the man, who cannot be named for legal reasons, was behind the wheel of a car carrying a woman and two children when it crashed into bushland at Stapylton on the Gold Coast on Saturday morning.<\/p>\n
A witness took the woman and the three-year-old to the Beenleigh police station, while the man left the scene with a one-year-old boy before officers arrived, according to police.<\/p>\n
Officers performed CPR on the three-year-old boy but he was not revived.\u00a0<\/p>\n
No charges have been laid in relation to the crash or the boy’s death.<\/p>\n
Court hears mother’s statement<\/p>\n
The man’s defence lawyer, Shannon Fletcher, argued the case was “unusual” and he should be released because the circumstances were unlikely to be repeated.<\/p>\n
The court heard the mother of the children had provided a statement to police accusing the man of holding a gun to her head.<\/p>\n
“There is obviously a significantly traumatic incident that has occurred,” Ms Fletcher said.<\/p>\n
“I would ask that your honour exercise caution in respect to that statement, noting there has obviously been a police investigation in relation to the traffic accident and there is no evidence or mention of a gun.<\/p>\n

“That would cast some doubt on the reliability of the aggrieved in terms of allocating blame for this particular incident.<\/p>\n
“At this stage [he] has not been charged with any wrongdoing. He accepts that he was in breach but there is dispute to the factual nature of these charges.<\/p>\n
“His instructions are that the aggrieved was making threats towards the safety of the children and he felt obligated to enter the vehicle.”<\/p>\n
Magistrate Gary Finger refused bail and the man did not enter a plea.\u00a0<\/p>\n
“I have to be satisfied you won’t reoffend and I’m far from satisfied of that,” Mr Finger said.<\/p>\n
