{"id":271542,"date":"2025-11-08T17:51:09","date_gmt":"2025-11-08T17:51:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/271542\/"},"modified":"2025-11-08T17:51:09","modified_gmt":"2025-11-08T17:51:09","slug":"statement-breach-of-agent-regulations","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/271542\/","title":{"rendered":"STATEMENT: BREACH OF AGENT REGULATIONS"},"content":{"rendered":"<p class=\"entry-block entry-block--p\">The AFL Players\u2019 Association has issued the following statement, attributed to the Agent Accreditation Board (AAB), in relation to the conduct of\u00a0Accredited Agent Kif Chowdhury of\u00a0Enrichd\u00a0Sports Management:\u00a0<\/p>\n<p class=\"entry-block entry-block--p\">The Agents\u2019 Accreditation Board (AAB) has\u00a0imposed fines\u00a0of\u00a0$10,000\u00a0and\u00a0issued a final reprimand\u00a0to Accredited Agent Kif\u00a0Chowdhury\u00a0for three material breaches of\u00a0the\u00a0AFLPA Regulations Governing Accredited Agents\u00a0(Regulations).\u00a0In addition to these\u00a0sanctions, Mr Chowdhury has been fined a further $3,000, which had previously been suspended, relating to breaches during 2024.\u00a0Mr Chowdhury\u00a0has been imposed\u00a0fines totalling $13,000\u00a0and\u00a0is\u00a0also\u00a0required to undergo an approved\u00a0ethics course\u00a0at his cost.\u00a0<\/p>\n<p class=\"entry-block entry-block--p\">The AAB has\u00a0determined\u00a0that, earlier this year,\u00a0Mr\u00a0Chowdhury\u00a0breached:\u00a0<\/p>\n<p>Clauses 12 and 15.3 of the Regulations\u00a0by using the confidential information and intellectual property of a third party\u00a0(namely, a club\u2019s\u00a0Hudl\u00a0Sportscode\u00a0account and system)\u00a0to access footage of a player to share with another party in an unauthorised manner. Clause 12 of the Regulations\u00a0obliges\u00a0an Accredited Agent\u00a0not\u00a0to\u00a0disclose\u00a0confidential information\u00a0and\u00a0Clause 15.3\u00a0provides that an\u00a0\u201cAccredited Agent must not act dishonestly \u2026 in any dealings with any other person, body or football club in the course of representing a Player\u2026\u201d;\u00a0<\/p>\n<p>Clause 15.3 of the Regulations\u00a0on a\u00a0further\u00a0occasion\u00a0by\u00a0using\u00a0the confidential information and intellectual property of a third party\u00a0(again, a club\u2019s\u00a0Hudl\u00a0account and system)\u00a0to access footage of a\u00a0player\u00a0to display on social media.\u00a0The AAB imposed a fine of $7,500 for\u00a0these\u00a0two\u00a0breaches; and,\u00a0<\/p>\n<p>Clause 18.1.5(f)\u00a0by contacting the\u00a0parent\/legal guardian\u00a0of a young player who had set\u00a0their\u00a0status\u00a0as\u00a0\u201cno approaches at this time\u201d\u00a0on the AFLPA Agents\u2019 Portal, meaning that\u00a0they are\u00a0not to be approached by an Accredited Agent as a prospective client. The AAB imposed a fine of $2,500 for this breach.\u00a0<\/p>\n<p class=\"entry-block entry-block--p\">Mr Chowdhury\u00a0was previously issued with two suspended fines\u00a0in June 2024 for breaches relating to approaching players outside the scope\u00a0permitted\u00a0under the Regulations.\u00a0Those fines have now been activated.\u00a0<\/p>\n<p class=\"entry-block entry-block--p\">Given Mr Chowdhury\u2019s previous breaches, the AAB decided to issue Mr Chowdhury with a final reprimand\u00a0on the condition that, if he is found to have breached the Regulations again before 30 September 2027 or fails to comply with the sanctions imposed, the AAB will meet to consider the revocation of Mr Chowdhury\u2019s accreditation.\u00a0<\/p>\n<p class=\"entry-block entry-block--p\">All fines imposed upon Accredited Agents by the AAB are paid to a nominated charity approved by the AFLPA.\u00a0<\/p>\n<p class=\"entry-block entry-block--p\">The AFLPA and the AAB take this opportunity to reiterate the importance of all Accredited Agents\u00a0complying with\u00a0the Regulations, including by\u00a0maintaining\u00a0the highest standards of professional and ethical conduct\u00a0such as the protection of confidential information and data.\u00a0In particular,\u00a0Accredited\u00a0Agents are not\u00a0permitted\u00a0to access player\u00a0Hudl\u00a0accounts or other employee portals without the express written authorisation of the player\u2019s club. The AAB will treat any breaches of this directive with the utmost seriousness.\u00a0<\/p>\n<p class=\"entry-block entry-block--p\">The Regulations deliberately regulate\u00a0how and when Accredited Agents may approach young players in the talent pathway for the purposes of discussing their representation.
