{"id":286491,"date":"2025-11-15T16:26:30","date_gmt":"2025-11-15T16:26:30","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/286491\/"},"modified":"2025-11-15T16:26:30","modified_gmt":"2025-11-15T16:26:30","slug":"after-tireless-advocacy-and-a-dark-history-australia-has-a-treaty-with-its-first-peoples","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/286491\/","title":{"rendered":"After tireless advocacy and a dark history, Australia has a treaty with its First Peoples"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">Aunty Thelma Chilly can remember when children would hide, panicked by strangers who entered the family home.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Many families were still segregated by race, their lives were surveilled by the government.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;We had mission managers that used to come into homes; they used to check in cupboards and check on children,&#8221; she said.<\/p>\n<p>&#8220;If they weren&#8217;t satisfied, they would take those children away.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The rule book to survive? &#8220;Act like you were a non-Aboriginal person,&#8221; the proud multi-clan nation woman said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Australia&#8217;s first truth-telling commission \u2014 the Yoorrook Justice Commission \u2014 recounted this era as a time where, &#8220;Aboriginal children were taken to missions, to foster homes, to orphanages where the walls were high and the rooms chilly&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;They were placed with white families who told them their mothers were dead, who scrubbed their skin raw and forbade them to speak their ancestors&#8217; words.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;They were told they were lucky; that they had been saved from their own people.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Aunty Thelma Chilly was sharing these memories about her childhood on the long drive back home to Robinvale, after witnessing a history-making event she never thought she would see in her lifetime.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2025-11-13\/australia-first-treaty-agreement-signed-law-victoria\/106002730\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Australia&#8217;s first treaty becomes law<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Victoria&#8217;s first treaty with Aboriginal people has been signed by members of the Aboriginal community, the premier and state governor.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It was such a momentous occasion. Some of the words that were spoken just brought tears to my eyes, as they do now,&#8221; as her voice wavered with emotion.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Kids will grow up without racism in their lives because they&#8217;ll have an understanding of what really happened to our people,&#8221; she said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;And we finally get to have a say about our lives and have the power to hold government to account, to make sure that they&#8217;re doing the right thing for our people.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">On Thursday, Victoria wrote a new chapter in Australia&#8217;s history books by becoming the first jurisdiction to sign a treaty with First Nations peoples.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Parked on the side of the road \u2014 a pit stop in her five-hour-long journey home \u2014 Aunty Thelma relived that moment.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The day prior, elders, mums, dads and their babies gathered on the banks of the Birrarung in Melbourne to celebrate the first signing of the treaty.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Geared with umbrellas and expecting a downpour of rain, they were gifted a surprise when the smoking ceremony began.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;The sun just shone the entire time that we were still there, and I just thought, &#8216;our old people are happy with us,'&#8221; Aunty Thelma said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I thought about my grandmother, grandfathers, my mother, father and uncles. (Supplied: Interim Truth and Treaty Body)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Until this week, Australia was the only developed country colonised by the British that never signed a formal treaty with First Nations people.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I don&#8217;t think we can underestimate the importance of this,&#8221; Ms Kiss said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Human rights have not been achieved here for First Peoples.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;They&#8217;ve been abused, they&#8217;ve been denied, and treaty is the first step in providing redress and reset and reframe that relationship between the state and Australia&#8217;s First Peoples.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Since the Voice referendum defeat in 2023, Commissioner Kiss said the Australian government&#8217;s commitment to implement the rest of the Uluru Statement from the Heart \u2014 Treaty and Truth-telling \u2014 has &#8220;gone silent&#8221;.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2025-03-23\/truth-telling-inquiry-yoorook-four-corners\/104931188\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Reckoning with Australia&#8217;s secret history<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Australia has a painful past. For the first time, the country has been grappling with recording the stories of that history in a truth-telling commission.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Those key pillars are what she believes will help close the gap around issues like health, housing, youth incarceration and suicide because First Nations people &#8220;will be in the driver&#8217;s seat&#8221;, leading the solutions.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">She also said they would play an important role in helping the nation heal.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I think this process that&#8217;s unfolded in Victoria is the exact demonstration of what Voice, Treaty and Truth is all about. It&#8217;s about putting our people in the driver&#8217;s seat of issues that are affecting our mob,&#8221; Commissioner Kiss said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;[It] puts in place those critical foundations to make sure we can address the past, deal with that together, and move forward in a way that delivers justice, healing and truth for all Victorians but also for Australia.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Telling the truth didn&#8217;t bring the house down, if anything, it strengthened it.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In a statement, Minister for Indigenous Australians Malarndirri McCarthy said Victoria&#8217;s treaty &#8220;showed what can be achieved when local communities and government come together and acknowledge the truths of the past, realities of the present and hopes for the future&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;The government remains committed to the principles of the Uluru Statement from the Heart,&#8221; she said.<\/p>\n<p><img decoding=\"async\" alt=\"A possum-skin quilt built from squares etched with messages about the promise of the treaty process.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/11\/ff3755c6a620e2be908ed31260c8eae5\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The road to treaty in Victoria has taken almost a decade. (ABC News: Joseph Dunstan)<\/p>\n<p>&#8216;Courage&#8217; shown by Vic government<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Until November last year, Queensland was on its own path to truth-telling and treaty.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Waanyi and Kalkadoon barrister Joshua Creamer was the chair of the Truth Telling and Healing Inquiry before the <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2024-11-02\/queensland-truth-telling-inquiry-cancellation\/104549294\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">Crisafulli government abolished it<\/a>, but not before countless accounts of traumatic and shocking experiences were brought forward by First Nations people.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mr Creamer congratulated the First Peoples&#8217; Assembly on signing a treaty and said it was a &#8220;hugely significant outcome&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;We&#8217;ve all watched with a real sense of pride in what the community in Victoria has led through the truth-telling process and now the treaty process, and it&#8217;s set an example for the rest of us,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The journey took more than a decade, led by the unwavering advocacy of First Nations people in Victoria, he said, along with what he called the &#8220;courage&#8221; of the Victorian government, led by Daniel Andrews and Jacinta Allan.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Few political leaders actually possess that courage,&#8221; Mr Creamer said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Sometimes to do things that aren&#8217;t popular, but are important and right, takes a lot of courage, and Victoria&#8217;s had a vision now for more than a decade in getting to this point \u2026 and they&#8217;ve held firm on that.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">To this day, he said, Indigenous and non-Indigenous people stop Mr Creamer on the street, expressing their &#8220;disappointment&#8221; in the decisions made by the Crisafulli government.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But the unwinding of progress will not stop their fight for justice and healing, he said.<\/p>\n<p><img decoding=\"async\" alt=\"a man writing on official documents\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/11\/02399f0d88a7c9e144e6b637e8f1f889\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Joshua Creamer says the treaty reflects the tireless advocacy of First Nations people in Victoria. (Supplied: First Nations Media Australia)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The Victorian opposition has said that if they are elected at the 2026 election, <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-10-14\/victoria-liberal-opposition-first-peoples-treaty-scrapped\/105888108\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">it will repeal the treaty legislation.<\/a><\/p>\n<p class=\"paragraph_paragraph__iYReA\">The ABC has sought comment from the opposition.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">When announcing the decision, it said it would instead establish its own First Nations advisory body and set up a new government department to report to parliament and oversee progress on closing the gap targets.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But Commissioner Moran said treaties &#8220;shouldn&#8217;t be feared&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Around the world, they see treaties as a pathway to justice, not division, and I think the environment that we&#8217;re in today in Australia is that we need to remove the idea that treaties are about division,&#8221; she said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;What is happening in Victoria is powerful; it makes us feel empowered, and feeling like we have power shouldn&#8217;t be feared by non-Indigenous Australians.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;We had that feeling taken away from us, and now this is about standing strong in that again.&#8221;<\/p>\n<p><img decoding=\"async\" alt=\"Aboriginal people performing a dance\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/11\/1763223990_720_0cdc106567d116408c203aead58698b3\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The treaty acknowledges past wrongs and establishes a range of commitments intended to improve outcomes for Aboriginal Victorians.
