{"id":304982,"date":"2025-11-24T06:00:09","date_gmt":"2025-11-24T06:00:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/304982\/"},"modified":"2025-11-24T06:00:09","modified_gmt":"2025-11-24T06:00:09","slug":"heres-what-the-law-says-about-working-these-holidays","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/304982\/","title":{"rendered":"Here&#8217;s what the law says about working these holidays"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">Whether you&#8217;re an employee counting down the days until your break, or an employer trying to keep a business open over Christmas \u2014 what are the rules about working these holidays?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">And if your workplace shuts over the holiday period, can you or your staff be made to use up leave?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Here&#8217;s what the law says.<\/p>\n<p>Do I have to work on Christmas?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Your boss <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.fairwork.gov.au\/employment-conditions\/public-holidays\/not-working-on-public-holidays\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">must ask you<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If you&#8217;re an employee, you have a legal entitlement not to work on a public holiday. If your boss asks you to work, you can say no if you have a reasonable reason to refuse the request.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The employer&#8217;s request for you to work also has to be <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.fairwork.gov.au\/employment-conditions\/public-holidays\/not-working-on-public-holidays\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">reasonable<\/a> \u2013 for instance, if they&#8217;re running an emergency room, which needs to be open 24\/7. But the employee&#8217;s personal circumstances are relevant too.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">There was an important court ruling about this earlier this month.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mining giant <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-11-12\/bhp-labour-company-ordered-to-pay-for-employees-working\/105999642\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">BHP was ordered<\/a> to pay 85 miners $A84,000 in compensation, after it made them work Christmas and Boxing Day in 2019 without giving them a chance to say no.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Among the miners forced to work was a single mother without family help, who said she had to go to &#8220;<a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.afr.com\/work-and-careers\/workplace\/fines-a-warning-to-bosses-who-don-t-ask-first-about-working-christmas-20251111-p5n9a4\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">demeaning and heartbreaking<\/a>&#8221; lengths to find a babysitter for her two daughters, 11 and 15, on Christmas Day.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">What that court case made clear is that rostering people on, then expecting or even suggesting that&#8217;s the end of the matter, does not meet the requirements of the <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/classic.austlii.edu.au\/au\/legis\/cth\/consol_act\/fwa2009114\/s114.html\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">Fair Work Act<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If you&#8217;re the employer, you need to have a conversation about it, or produce a draft roster, with employees given the opportunity to indicate if they would not like to work. (Pexels)<\/p>\n<p>What if I don&#8217;t have kids?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If you&#8217;re being asked to work, the <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/classic.austlii.edu.au\/au\/legis\/cth\/consol_act\/fwa2009114\/s114.html\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">same rules<\/a> apply to you as to parents or others.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Is your employer&#8217;s request reasonable? Are you in the kind of industry that needs to operate on a public holiday?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">What are your personal circumstances and responsibilities? Is there additional compensation beyond your normal pay, such as penalty rates?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It may be easier for someone with kids to argue they have caring responsibilities on a day like Christmas, when alternative childcare is mostly closed.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But if the children can be safely cared for by someone else, it doesn&#8217;t necessarily elevate a parent above a single person \u2014 who may have other responsibilities, such as caring for parents, or personal circumstances including their own mental wellbeing.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">So the right to refuse to work on a public holiday on reasonable grounds doesn&#8217;t just belong to parents; it belongs to everybody covered by the Fair Work Act.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Which public holidays do the rules apply to?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/classic.austlii.edu.au\/au\/legis\/cth\/consol_act\/fwa2009114\/s115.html\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">Fair Work Act<\/a> lists the public holidays these rules apply to:<\/p>\n<p>January 1 (New Year&#8217;s Day)January 26 (Australia Day)Good FridayEaster MondayApril 25 (Anzac Day)the King&#8217;s birthday (this date depends on the state or territory you&#8217;re in)December 25 (Christmas Day)December 26 (Boxing Day)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Plus any other public holiday declared in your state or territory, unless it&#8217;s excluded by regulations.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The majority of Australians are covered under the Fair Work Act, with some exceptions, including state public servants outside of Victoria, some council workers and certain private sector employees in Western Australia.<\/p>\n<p>If my work shuts over Christmas can I be made to use up leave?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Generally speaking, yes. But find out if you&#8217;re covered by an award or enterprise agreement, as it&#8217;s usually spelled out clearly there.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But if you don&#8217;t have a modern award or enterprise agreement, the <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www5.austlii.edu.au\/au\/legis\/cth\/num_act\/fwa2009114\/s94.html\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">Fair Work Act<\/a> notes that one of the times of year it may be reasonable to make people take leave is when:<\/p>\n<p class=\"paragraph_paragraph__iYReA\">the employer&#8217;s enterprise is being shut down for a period (for example, between Christmas and New Year).<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If you don&#8217;t have enough paid leave to cover a shutdown period, you can come to an agreement with your employer for other options, such as:<\/p>\n<p>using accrued time offannual leave in advance, orleave without pay.Is there a minimum notice period?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">There&#8217;s no set time period to be asked to work or take leave under the <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.fairwork.gov.au\/employment-conditions\/public-holidays\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">National Employment Standards<\/a>, though there may be in your award or agreement.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But if the request to work or take leave is very late, it becomes less &#8220;reasonable&#8221; than early notice.
