{"id":307285,"date":"2025-11-25T08:03:09","date_gmt":"2025-11-25T08:03:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/307285\/"},"modified":"2025-11-25T08:03:09","modified_gmt":"2025-11-25T08:03:09","slug":"vast-overreach-police-allowed-to-conduct-warrantless-pat-downs-of-people-across-inner-melbourne-for-six-months-melbourne","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/307285\/","title":{"rendered":"\u2018Vast overreach\u2019: police allowed to conduct warrantless pat-downs of people across inner Melbourne for six months | Melbourne"},"content":{"rendered":"<p class=\"dcr-130mj7b\">Victoria police will have the power to conduct warrant-less pat-downs, search cars and move people on in Melbourne\u2019s CBD for six months, in a move human rights and legal groups have described as a \u201cvast overreach\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Police on Tuesday declared the CBD, Docklands, Southbank, the sporting and entertainment precinct and parts of East Melbourne and South Melbourne as a \u201cdesignated area\u201d from Sunday, until 29 May 2026.<\/p>\n<p class=\"dcr-130mj7b\">This means police and protective service officers (PSOs) have the ability to randomly stop and search anyone without a warrant or reasonable grounds.<\/p>\n<p class=\"dcr-130mj7b\">The searches, which are allowed under the Control of Weapons Act, can be conducted using an electronic wand or a pat-down, and people may be asked to take off items of outer clothing such as headwear, scarves or jackets and to remove items from bags or pockets. Vehicles can also be searched.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.theguardian.com\/email-newsletters?CMP=copyembed&amp;CMP=emailbutton\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Sign up: AU Breaking News email<\/a><\/p>\n<p class=\"dcr-130mj7b\">Police may also require people to remove face coverings that could conceal a person\u2019s identity or protect against the effects of \u201ccrowd-control substances\u201d, such as pepper spray. Those who refuse to remove the mask can be asked to move on.<\/p>\n<p class=\"dcr-130mj7b\">Under the act, it is an offence to \u201cobstruct or hinder\u201d an officer or PSO conducting a search. Failing to comply with a police direction to leave the designated area is also an offence.<\/p>\n<p class=\"dcr-130mj7b\">Designated areas are often declared to allow police to manage major planned protests or demonstrations.<\/p>\n<p class=\"dcr-130mj7b\">But the Inner Melbourne Community Legal described the new six-month designation as a \u201cvast overreach\u201d. The legal centre\u2019s chief executive, Nadia Morales, said it was unprecedented both in its geographic scope and for the length of time it is intended to apply for.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThis is complete overkill by <a href=\"https:\/\/www.theguardian.com\/australia-news\/victoria\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Victoria<\/a> police to designate such a large area for six months,\u201d Morales said.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWhat it means is that a police officer or protective services officer can stop and search anyone, no questions asked, at any time in the CBD and its surrounds.\u201d<\/p>\n<p class=\"dcr-130mj7b\">She said she feared the declaration would \u201cunfairly impact\u201d minorities and vulnerable or marginalised groups, including those experiencing poor mental health and homelessness.<\/p>\n<p class=\"dcr-130mj7b\">\u201cPeople who are stopped randomly by police tell us it is humiliating and makes them feel like they have done something wrong,\u201d Morales said.<\/p>\n<p class=\"dcr-130mj7b\">Sarah Schwartz, the legal director at the Human Rights Law Centre, said the designation could affect any person who may be in the CBD.<\/p>\n<p class=\"dcr-130mj7b\">\u201cPeople could be heading to study at the State Library, or heading to a free music gig at Federation Square and end up humiliated by Victoria police,\u201d Schwartz said.<\/p>\n<p class=\"dcr-130mj7b\">In a statement provided to Guardian Australia, a spokesperson for Victoria police confirmed it was the first area to receive a declaration for this length of time under the recent changes to the act.<\/p>\n<p class=\"dcr-130mj7b\">\u201cAhead of the designated area commencing on Sunday, Victoria police will be commencing further safety measures in the CBD,\u201d the spokesperson said.<\/p>\n<p><a data-ignore=\"global-link-styling\" href=\"#EmailSignup-skip-link-17\" class=\"dcr-jzxpee\">skip past newsletter promotion<\/a><\/p>\n<p class=\"dcr-rsfwa\">Sign up to Breaking News Australia<\/p>\n<p class=\"dcr-1xjndtj\">Get the most important news as it breaks<\/p>\n<p>Privacy Notice: Newsletters may contain information about charities, online ads, and content funded by outside parties.
