{"id":311833,"date":"2025-11-27T08:57:07","date_gmt":"2025-11-27T08:57:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/311833\/"},"modified":"2025-11-27T08:57:07","modified_gmt":"2025-11-27T08:57:07","slug":"teens-seek-urgent-high-court-injunction-to-block-australian-governments-social-media-ban-social-media-ban","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/311833\/","title":{"rendered":"Teens seek urgent high court injunction to block Australian government\u2019s social media ban | Social media ban"},"content":{"rendered":"<p class=\"dcr-130mj7b\">Two teens and a digital rights group led by a New South Wales state politician are seeking an urgent high court injunction to block Australia\u2019s under-16s social media ban, just two weeks before the ban is due to begin.<\/p>\n<p class=\"dcr-130mj7b\">The two young people, 15-year-olds Noah Jones and Macy Neyland, are supported by the Digital Freedom Project \u2013 an initiative led by NSW Libertarian MP John Ruddick.<\/p>\n<p class=\"dcr-130mj7b\">The Digital Freedom Project said it was challenging the law on the grounds Australians have a constitutional implied right to freedom of political communication.<\/p>\n<p class=\"dcr-130mj7b\">The group announced its plans on Wednesday, but the court documents were not made available until Thursday.<\/p>\n<p class=\"dcr-130mj7b\">The documents state the ban \u201cwill prevent persons under 16 years of age from using account-based social interaction to engage in communication by, to and between them of political and governmental matters on all social media services and platforms that are principal fora for such communication by 13 to 15 years-olds [sic] in Australia\u201d.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.theguardian.com\/email-newsletters?CMP=copyembed&amp;CMP=emailbutton\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Sign up: AU Breaking News email<\/a><\/p>\n<p class=\"dcr-130mj7b\">The group has argued that only giving teens access to some of the sites, such as <a href=\"https:\/\/www.theguardian.com\/technology\/youtube\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">YouTube<\/a>, in a logged out view, was not sufficient.<\/p>\n<p class=\"dcr-130mj7b\">\u201cLogged-out viewing does not provide a meaningful substitute for the interactive functions which are integral to and necessary for contemporary modes of free political communication by persons aged between 13 and 15 years of age and for the maintenance of the integrity and efficacy of the system of representative and responsible government mandated by the Constitution.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The federal government, the communications minister and the eSafety commissioner have all been named as respondents in the case, and the Digital Freedom Project is seeking an injunction to prevent the parties from enforcing the ban.<\/p>\n<p class=\"dcr-130mj7b\">Facebook, Instagram, Snapchat, TikTok, YouTube, X, Twitch, Kick and Reddit <a href=\"https:\/\/www.theguardian.com\/media\/2025\/nov\/23\/australia-under-16-social-media-ban-how-will-it-work-which-platforms-age-verification\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">must stop children aged under 16 from holding accounts<\/a> from 10 December under the legislation.<\/p>\n<p class=\"dcr-130mj7b\">The Digital Freedom Project has argued that the social media ban would \u201cimproperly rob\u201d 2.6 million young Australians of that right.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThis issue should concern every Australian,\u201d Ruddick said in a statement. \u201cThis ban is disproportionate and will trespass either directly or indirectly upon the rights of every Australian.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThis ban is a direct assault on young people\u2019s right to freedom of political communication. But it\u2019s worse than that. Come December 10 all kids will be banned, and all the rest of us will have to prove our age and potentially provide ID just to access social media.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Under the ban, platforms can accept ID as one form of age check, but it must not be the sole method of identification.<\/p>\n<p class=\"dcr-130mj7b\">Both <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/nov\/19\/meta-starts-notifying-australian-teens-of-account-shutdowns-as-social-media-ban-looms\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Meta<\/a> and <a href=\"https:\/\/www.theguardian.com\/australia-news\/2025\/nov\/24\/snapchat-to-tell-440k-australians-to-prove-theyre-16-or-accounts-will-be-locked-in-social-media-ban\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Snap Inc<\/a> have said they will use ID checks as a fallback option in the event that facial age estimation incorrectly estimates an account to be held by someone under 16. Bring us into safer spaces, with rules that work: age\u2011appropriate features, privacy\u2011first age assurance, and fast takedowns.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Neyland will turn 16 before the ban comes into effect, according to the documents, but the statement of claim argued that the ban is \u201cforcing her to surrender her privacy and anonymity by submitting personal identification to continue using social media\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The communications minister, Anika Wells, said the government was prepared to face the legal challenge in question time on Wednesday.<\/p>\n<p class=\"dcr-130mj7b\">\u201cDespite the fact that we are receiving threats and legal challenges by people with ulterior motives, the Albanese Labor government remains steadfastly on the side of parents, and not of platforms,\u201d she said. \u201cWe will not be intimidated by threats. We will not be intimidated by legal challenges. We will not be intimidated by big tech on the behalf of Australian parents. We stand firm.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The high court will determine whether it hears the case. The next court sitting days are the first two weeks of December.<\/p>\n<p class=\"dcr-130mj7b\">YouTube has also raised the possibility with the Albanese government of <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/oct\/02\/youtube-three-legal-grounds-fchallenging-inclusion-australia-under-16s-social-media-ban\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">a high court challenge<\/a> to its inclusion in the social media ban.
