{"id":337386,"date":"2025-12-09T15:13:09","date_gmt":"2025-12-09T15:13:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/337386\/"},"modified":"2025-12-09T15:13:09","modified_gmt":"2025-12-09T15:13:09","slug":"no-justice-for-family-of-boy-killed-outside-school","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/337386\/","title":{"rendered":"&#8216;No justice&#8217; for family of boy killed outside school"},"content":{"rendered":"<p>The family of a 12-year-old boy who was struck and killed by a car during an afternoon school pick-up say no justice has been served by a four-month suspended jail term.<\/p>\n<p>Marshall Oakley-Stagg was walking with friends on a footpath outside Cosgrove High School in Hobart&#8217;s northern suburbs on April 5, 2024.<\/p>\n<p>As they approached a lane, Marshall had his head turned and was hit by the bumper bar of a blue Isuzu pulling out onto the main road.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/12\/https:\/\/prod.static9.net.au\/fs\/d2ca60bc-6b31-4922-9238-5f7ff5f88476.jpeg\"   alt=\"\"\/>Marshall Oakley-Stagg. (AAP)<\/p>\n<p>Its driver, Elena Anita Begovic, 51, was today handed a four-month jail sentence after pleading guilty to causing death by negligent driving.<\/p>\n<p>It was suspended on the condition Begovic not commit any serious crimes for two years.<\/p>\n<p>Magistrate Robert Webster said Begovic, who had just picked up her two kids from the school, failed to keep a proper lookout and didn&#8217;t look left as she pulled out.<\/p>\n<p>&#8220;His life meant more,&#8221; Marshall&#8217;s mother Karina Stagg said outside court.<\/p>\n<p>&#8220;There needs to be a change to our laws and our justice system to do with crimes with vehicles.<\/p>\n<p>&#8220;There is no justice for our family. It&#8217;s a kick in the guts.&#8221;<\/p>\n<p>Marshall loved life and was funny, quirky and always looked out for his mates, Stagg said.<\/p>\n<p>CCTV from a car across the main road showed Begovic did not slow or stop as she approached the school fence line.<\/p>\n<p>Her negligence was fleeting and not on the high-end of the scale but had disastrous consequences, Webster said.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/12\/https:\/\/prod.static9.net.au\/fs\/6ea43ec8-654c-4be3-9231-b53b112ea093.jpeg\"   alt=\"\"\/>Elena Anita Begovic arrives at Hobart Magistrates Court. (AAP)<\/p>\n<p>Begovic knew about bushes to the left of the lane which created a blind spot and was aware of how busy it was during school pick-up.<\/p>\n<p>Based on the dimensions of the car, Marshall would have been seen by Begovic had she looked, Webster said.<\/p>\n<p>A &#8220;much higher degree of care and vigilance&#8221; was needed given her familiarity with the location, the magistrate said.<\/p>\n<p>There were &#8220;no winners&#8221; in the case and no punishment would be sufficient for the loss experienced by Marshall&#8217;s family, he added.<\/p>\n<p>Begovic, who works as a teachers&#8217; assistant, suffers post-traumatic stress disorder, significant anxiety and has changed working hours to avoid driving in busy school times.<\/p>\n<p>In suspending the sentence Webster noted Begovic&#8217;s &#8220;essentially blameless&#8221; life, her cooperation with authorities and her work helping disadvantaged students.<\/p>\n<p>Begovic was disqualified from driving for 12 months and ordered to pay a total of $1060 in fines and court fees.<\/p>\n<p>She had also pleaded guilty to contravening vehicle standards in relation to indicator lights, parking lights and tyre tread.<\/p>\n<p>Webster said none of the contraventions influenced the accident.<\/p>\n","protected":false},"excerpt":{"rendered":"The family of a 12-year-old boy who was struck and killed by a car during an afternoon school&hellip;\n","protected":false},"author":2,"featured_media":337387,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2],"tags":[43,44,41,39,42,40],"class_list":{"0":"post-337386","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-headlines","8":"tag-headlines","9":"tag-news","10":"tag-top-news","11":"tag-top-stories","12":"tag-topnews","13":"tag-topstories"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/posts\/337386","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/comments?post=337386"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/posts\/337386\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/media\/337387"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/media?parent=337386"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/categories?post=337386"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/au\/wp-json\/wp\/v2\/tags?post=337386"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
