Wicked Campers, known for its offensive slogans on its vans, has the most breached cases at 111 (out of 145 complaints).

“You’re always going to have brands that are pushing the boundaries and are always going to spark controversy,” instead, it was because the ad was targeting children under 15.

Woolworths, Didi and Universal Pictures followed for the most complaint cases reviewed in 2025.

Food and beverage ads received the most complaints with 49 cases investigated and 36 breaches of the code.

Sex/sexuality/nudity was the biggest area of concern, followed by health and safety and violence.

Those complaints are in line with the latest community perceptions survey, which showed use of sexual appeal or nudity was the third biggest concern, following gambling and misleading or deceptive advertising.

Traditional media still attracting more complaints

While complaint cases against social media ads have risen, traditional media cases still outnumber them.

Mr Hughes said this was likely due to the demographics of people who see these ads and the longer linger times.

He added online advertising had the benefit of being more targeted than traditional media.

“When you’re speaking the language of that audience, it’s going to be less polarising,” he said.

“What people deem to be unacceptable may still fall within the acceptance range, but because it’s not a message that’s fit for them, they often will be putting in a complaint.”

With a growing number of advertisers and platforms available to advertise on, Mr Hughes said there could be an argument made for further tightening the code.

Graeme Hughes says the self-regulated code has historically worked well. (ABC News)

“What we’re finding is the code works exceptionally well when you have very traditional media, because all of the media operators of the day agreed that if something was outside of scope and it was reviewed and deemed to be unacceptable, then that would be pulled,” he said.

“That would be a big enough sting in someone’s budget to be more aware of practices.

“I think the testing point of all of this at the moment is, in this new landscape, what can be done to ensure that we still have proper oversight, but whilst not over-governance.”

Ad Standards enforces the self-regulated AANA code, while the Australian Competition and Consumer Commission (ACCC) deals with false claims in advertising and can hand out hefty fines.

Webjet fined $9 million for misleading airfares

Webjet has agreed to pay a $9 million fine for making false or misleading statements about the price of flights and booking confirmations.

Executive director of Ad Standards Greg Wallace said the advertising industry codes were platform-neutral and applied no matter where ads appeared.

“Australia’s self-regulatory system is strong because it’s backed by industry and shaped by community standards.

“The codes are reviewed regularly to keep pace with industry developments and evolving community expectations.

“This approach gives flexibility and speed while ensuring accountability through a transparent complaint handling process.”

Changing expectations

The AANA code is currently accepting feedback on the code, asking questions, including if the objectives need to be amended, whether various sections of the code need to be changed to better reflect community standards and if the code should have guidance for artificial intelligence.

An AANA spokesperson said it aimed to review the code every five years to stay up to date with evolving community expectations.

“For example, recent Ad Standards community perception research shows that Australians are fairly relaxed about colourful language but are concerned about sexual content in advertising,” they said.

In the last review, which received 160 submissions, the main themes were around the objectification of women, gender stereotypes, images from horror films and the need for clear disclosure of influencer advertising.

“I think we’re a progressive nation and we do hold brands to account based on where we’re currently at in society,” Mr Hughes said.

“I do think the code does a good job of keeping in step with that. Could it be improved, like everything? Absolutely, but I think it sets a really good tonality and standard.”

Top 10 most complained about ads for 2025Kia Australia

This series of TV ads show Kia’s range of ‘zombie proof’
