Former Jetstar pilot Greg Lynn has had his murder conviction overturned on appeal, and will face a new trial.<\/p>\n
Mr Lynn, 59, was found guilty last year after a high-profile Supreme Court trial of murdering retiree Carol Clay in Victoria’s High Country in March 2020.<\/p>\n
He was acquitted of the murder of her camping companion, Russell Hill.<\/p>\n
Mr Lynn’s lawyers subsequently appealed his sentence and conviction on four key grounds, including the prosecution’s conduct during the trial’s closing arguments and Mr Lynn’s “manifestly excessive” 32-year prison sentence.<\/p>\n
The Court of Appeal on Thursday morning granted the appeal, finding “there were a number of serious irregularities in the course of the trial” that gave rise to a substantial miscarriage of justice.<\/p>\n
His conviction was set aside and a new trial ordered.<\/p>\n
Mr Lynn was remanded in custody, pending an application for bail, and will return to court in January.<\/p>\n
He hugged his legal team before leaving the courtroom.\u00a0<\/p>\n
Members of Mr Hill’s family could be heard sobbing as the brief hearing concluded.<\/p>\n
Mr Lynn’s lawyer, Dermot Dann KC, was swarmed by media as he left the courthouse, but did not answer questions, including whether his client would apply for bail.<\/p>\n
“The Court of Appeal has ordered a retrial, so it would not be appropriate to make public comment,” he said.<\/p>\n
The former Jetstar pilot has always maintained the campers’ deaths at the remote campsite the trio shared were tragic accidents, set in motion by separate struggles over a knife and a shotgun.<\/p>\n
