{"id":353272,"date":"2025-12-17T05:54:07","date_gmt":"2025-12-17T05:54:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/353272\/"},"modified":"2025-12-17T05:54:07","modified_gmt":"2025-12-17T05:54:07","slug":"elon-musks-x-wins-appeal-to-lift-block-on-australians-seeing-charlie-kirk-shooting-footage-charlie-kirk-shooting","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/353272\/","title":{"rendered":"Elon Musk\u2019s X wins appeal to lift block on Australians seeing Charlie Kirk shooting footage | Charlie Kirk shooting"},"content":{"rendered":"<p class=\"dcr-130mj7b\">The Australian classification review board has overturned a decision to block Australians seeing footage of the shooting of conservative influencer Charlie Kirk on social media after Elon Musk\u2019s <a href=\"https:\/\/www.theguardian.com\/technology\/twitter\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">X<\/a> appealed against the ruling sought by the eSafety commissioner.<\/p>\n<p class=\"dcr-130mj7b\">After <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/dec\/11\/charlie-kirk-murder-suspect-court-appearance\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Kirk\u2019s death at Utah Valley University<\/a> on 10 September, the eSafety commissioner applied to the board to have video of the shooting classified in Australia. The video was ruled to be \u201crefused classification\u201d, which allowed eSafety to serve notices on social media platforms ordering them to geo-block the posts from view for Australia-based users.<\/p>\n<p class=\"dcr-130mj7b\">X appealed against the ruling on two separate Kirk videos. It also appealed a ruling on another video also deemed refused classification \u2013 the <a href=\"https:\/\/www.classification.gov.au\/sites\/default\/files\/documents\/classification-review-board-review-board-reasons-inv-2025-05242.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">attack on Iryna Zarutska<\/a> on a train in Charlotte, North Carolina in August.<\/p>\n<p class=\"dcr-130mj7b\">X was successful in the cases. In <a href=\"https:\/\/www.classification.gov.au\/sites\/default\/files\/documents\/classification-review-board-review-board-reasons-inv-2025-05224.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">the Kirk case<\/a>, X argued the Kirk video contained brief violence, with no weapon visible. The footage was grainy and the camera moves away from the victim to the crowd quickly.<\/p>\n<p class=\"dcr-130mj7b\">The social media company argued the video was not excessively detailed, gratuitous, or offensive, adding that the film is a neutral objective record of \u201ca notorious public event of historical and political significance that prompted extensive public discourse\u201d. X compared the video to the video of the assassination of John F Kennedy.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.theguardian.com\/email-newsletters?CMP=copyembed&amp;CMP=emailbutton\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Sign up: AU Breaking News email<\/a><\/p>\n<p class=\"dcr-130mj7b\">The majority of the review board agreed that \u201cnotwithstanding the heinous nature of the event\u201d the video was not gratuitous, exploitative or offensive to the extent that it should be refused classification, but that a more detailed depiction with different editing or commentary might rise to the level of refused classification. The board changed the classification of the videos to R18+.<\/p>\n<p class=\"dcr-130mj7b\">The minority view disagreed, arguing that the post was \u201ca shareable video for the likely purposes of entertainment and\/or personal gain (such as likes, shares, or views) for distribution to users of a social media platform\u201d. They argued it could not be compared to the Zapruder JFK video as that was released 15 years after JFK\u2019s assassination, \u201conce emotions around the matter had subsided\u201d.<\/p>\n<p class=\"dcr-130mj7b\">In a post on X\u2019s global government affairs account, the platform welcomed the decision.<\/p>\n<p class=\"dcr-130mj7b\">\u201cX fought this case to uphold free speech and the importance of access to information about matters of public significance.
