Convicted rapist Tom Silvagni has been jailed for six years and two months over the \u201cinsidious\u201d sexual abuse of a young woman at his parents\u2019 home almost two years ago<\/a>.<\/p>\n

Silvagni, 23, returned to Victoria\u2019s County Court on Wednesday, less than two weeks after a jury found him guilty of two counts of rape on December 5.<\/p>\n

Shortly after 10am, Silvagni beamed into the courtroom from the Melbourne Assessment Prison, wearing a green sweatshirt and sporting a new stubble beard. <\/p>\n

More than 50 people were present in court. <\/p>\n

Judge Gregory Lyon said Silvagni will serve a minimum of three years and three months before becoming eligible for parole. <\/p>\n

Prosecutors, led by Jeremy McWilliams, labelled Silvagni\u2019s crime \u201cobjectively serious\u201d, arguing the convicted rapist demonstrated cunning deception and persistent dishonesty after the fact in an attempt to avoid accountability. <\/p>\n

At trial, jurors heard Silvagni snuck into a guest room at his parents\u2019 Balwyn North home in the early hours of the morning last January, twice digitally raping the woman while pretending to be his friend, a man the woman had previously had consensual sex with.<\/p>\n

In the days and weeks that followed, he lied to the woman, claiming it was the friend, and doctored a Uber receipt to show the friend was still at the home, when he\u2019d already left. <\/p>\n

\u201cTo deny her experience of reality demonstrates a real moral capability and real moral deficit, a real lack of empathy, a real sense of entitlement,\u201d Mr McWilliams said. <\/p>\n

Silvagni\u2019s barrister, David Hallowes SC, urged Judge Lyon to give his client \u201csome light that he can see where he will get out of the tunnel and make something useful of his life\u201d.<\/p>\n

He argued the sentence imposed needed to take into account Silvagni\u2019s youth, prior good character, and \u201cexcellent prospects for rehabilitation\u201d.<\/p>\n

Silvagni\u2019s defence tendered two medical reports from psychiatrists about his mental health issues, including depression and anxiety, which the writers of those reports believed would make his time in custody more difficult.<\/p>\n

The rape case had been shrouded in secrecy by a series of suppression orders since Silvagni was charged in June last year \u2014 with a final order revoked last Thursday by Judge Andrew Palmer. <\/p>\n

\u201cAt some point he will have to reconcile himself to the reality that he has committed these offences and there is media interest in them,\u201d the judge said. <\/p>\n

Judge Lyon said he considered Silvagni to be a \u201cyoung offender\u201d and noted he had no prior convictions.<\/p>\n

\u201cYour prospects of rehabilitation must be considered very good,\u201d he said.<\/p>\n

He added that Silvagni has the \u201cstrong support of a good pro-social family,\u201d but he said he has demonstrated \u201cno remorse\u201d or insight into any of his actions.<\/p>\n

Silvagni maintains his innocence, with his father, Carlton Hall of Famer Stephen Silvagni telling media the family are \u201cconsidering our options to appeal\u201d last week.<\/p>\n

He will be eligible for parole in three years and three months\u2019 time.<\/p>\n

The incident has left the Silvagni family at odds with the family of former Carlton president Mark LoGiudice.<\/p>\n

LoGiudice\u2019s son, Anthony, was the friend who was also at the Silvagnis\u2019 home on the night of the incident.<\/p>\n

\u201cDuring the trial, details emerged of how sexual offence detectives attended Mark\u2019s home on two occasions to interview his son Anthony in the weeks and months after a young woman was assaulted in a dark room at the Silvagnis\u2019 Balwyn North mansion,\u201d News Corp reported<\/a>.<\/p>\n

\u201cOn the second occasion \u2014 in a conversation secretly recorded by police on April 29, 2024 \u2014 Mark expressed concern that his son was going to be arrested as Anthony sat with his parents to answer questions about the booze-fuelled night.\u201d<\/p>\n

The prosecution then accused Tom of trying to \u201cshift the blame\u201d onto Anthony during the case.<\/p>\n

During his evidence, Tom referred to Anthony as \u201cmy best friend at the time\u201d, while Tom\u2019s girlfriend described them as \u201cvery good friends\u201d.<\/p>\n
