{"id":372476,"date":"2025-12-26T06:54:14","date_gmt":"2025-12-26T06:54:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/372476\/"},"modified":"2025-12-26T06:54:14","modified_gmt":"2025-12-26T06:54:14","slug":"when-can-you-get-a-refund-or-exchange-under-australian-law","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/372476\/","title":{"rendered":"When can you get a refund or exchange under Australian law?"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">Have you received some unwanted gifts this holiday season?\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Perhaps you\u2019ve bought a few things for yourself that you now regret.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It can feel a little awkward asking for a refund or to exchange an item, especially if you\u2019re not sure what you\u2019re entitled to.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It&#8217;s one of those errands you may want to avoid altogether but to make it less painful, we\u2019ve broken down what you\u2019re entitled to.\u00a0<\/p>\n<p>Firstly, is the product faulty?\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Your rights really boil down to the reason for the return, according to the Australian Competition and Consumer Commission (ACCC).<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;If a product is faulty, doesn\u2019t match the description, or is not fit for purpose, consumers will have rights to a remedy under the Australian Consumer Law (ACL),&#8221; the ACCC says. \u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Also known <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.accc.gov.au\/consumers\/buying-products-and-services\/consumer-rights-and-guarantees\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">as consumer guarantees<\/a>, these rights still apply if an item was given as a gift and a &#8220;remedy&#8221; can include a refund, repair or replacement.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But it depends on whether the problem is considered <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.accc.gov.au\/consumers\/problem-with-a-product-or-service-you-bought\/repair-replace-refund-cancel\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">&#8220;major&#8221; or &#8220;minor&#8221;<\/a>.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\"><a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.accc.gov.au\/system\/files\/Consumer%20guarantees%20-%20a%20guide%20for%20consumers%20-%20July%202021.pdf\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">According to the ACCC <\/a>ordering a red bicycle and receiving a green one, an electric blanket with faulty wiring or a raincoat not being waterproof because it\u2019s made from the wrong material are all examples of major problems.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If something does not meet a consumer guarantee and you would like it refunded, repaired or replaced, &#8220;a business can ask consumers to provide a receipt or another form of proof of purchase,&#8221; the ACCC says.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Other acceptable forms of proof of purchase may include a credit or debit card statement, lay-by agreement, a receipt or reference number given over the phone or internet, as well as warranty cards or serial numbers.&#8221;\u00a0<\/p>\n<p>Can I get a refund for change of mind? \u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">This is where things become more nuanced.\u00a0<\/p>\n<p><img decoding=\"async\" alt=\"A professional headshot of Nicola Howell.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/12\/1f27c5ddf88531c8978286f0ede24f65\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Nicola Howell says whether you can return or exchange an item because of a change of mind depends on an individual business&#8217;s policy. (Supplied: Queensland University of Technology)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The ACCC says consumers don&#8217;t have the same rights if &#8220;they no longer like or want a product&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Wanting to return something because it&#8217;s the wrong size, you found it cheaper elsewhere or you did not like the item would typically all fall under a &#8220;change of mind&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Nicola Howell, a senior lecturer at Queensland University of Technology&#8217;s law school, says our consumer law does not address &#8220;change of mind&#8221; returns.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Dr Howell says it comes down to the policy the store offers. There&#8217;s no obligation to have a change of mind policy, but retailers do need to be consistent if they offer one, she says.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If you&#8217;re shopping for something that may need to be returned, she recommends checking the store&#8217;s specific policy.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The store determines whether it allows &#8220;change of mind&#8221; refunds or exchanges, the return window, and the kind of proof of purchase it requires, Dr Howell says.<\/p>\n<p>What is a return window?\u00a0<img decoding=\"async\" alt=\"A headshot of Stephanie Tonkin, taken in front of a colourful yellow artwork.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/12\/4b2a0d0003767138dab5047fabe5be4c\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Stephanie Tonkin says change of mind returns are not guaranteed. (Supplied: Consumer Action Law Centre)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">When it comes to change of mind returns, most store policies outline the length of time a customer has to refund or exchange an item.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Consumer Action Law Centre CEO Stephanie Tonkin says the ACL doesn&#8217;t force businesses to offer change of mind refunds, but they are legally obligated to follow their own policy.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;If they do set a return period \u2014 14 days, 30 days, whatever \u2014 they must honour it.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\"><a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.consumer.vic.gov.au\/consumers-and-businesses\/products-and-services\/business-practices\/store-policies\/change-of-mind\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">Consumer Affairs Victoria<\/a> says the policy should be clearly displayed at point of sale or included on the business&#8217; website.<\/p>\n<p>What about exchanges?\u00a0<a href=\"https:\/\/www.abc.net.au\/news\/2024-02-03\/understanding-buyers-remorse-and-how-to-break-the-cycle\/103321474\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Understanding buyer&#8217;s remorse<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Buyer&#8217;s remorse is a crappy feeling.
