(ABC News: Che Chorley)<\/p>\n<p>What are the new protest laws\uff1f<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In the wake of the Bondi mass shooting, the state government recalled parliament to pass a suite of new gun and protest laws.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">As a result of a <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-12-24\/changes-to-nsw-gun-protest-laws-pass-after-bondi-terror-attack\/106175636\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">marathon debate in the early hours of Christmas Eve<\/a>, police were given the power to enact a blanket refusal of all public assemblies for up to three months after a terrorist incident.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It means NSW Police Commissioner Mal Lanyon has the discretion to enforce the ban and can extend it in two-week increments.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The powers were <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2025-12-25\/public-assemblies-banned-14-days-in-sydney-under-new-protest-law\/106178406\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">activated just before midnight on December 24<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Premier Chris Minns said &#8220;static rallies&#8221; \u2014 demonstrations in a fixed location \u2014 would not be covered by the laws, but police could still shut them down if they were regarded a &#8220;breach of the peace&#8221;.<\/p>\n<p>What is a &#8216;breach of the peace&#8217;\uff1f<\/p>\n<p class=\"paragraph_paragraph__iYReA\">On Sunday, three people were arrested and released without charge at the end of the protest, including two arrests for &#8220;breach of the peace&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">This is not a specific offence but instead a police power that allows them to arrest or detain someone to prevent violence or serious disturbance.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">These powers were not introduced under the government&#8217;s protest laws.<\/p>\n<p>Does this mean protests are banned\uff1f<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In short, no.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2025-12-23\/nsw-proposed-protest-laws-challenge-parliament\/106172910\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Activists launch legal action against NSW protest laws<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Palestine Action Group have launched a constitutional challenge to Chris Minns\u2019s new anti-protest laws.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The new laws have barred police from accepting Form 1 applications, which notify of a planned protest, but that does not mean protests cannot go ahead.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Normally, if police do not challenge an application, the protest automatically has the consent of police and is therefore &#8220;authorised&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If an application is not made, then the event is considered &#8220;unauthorised&#8221; by default and participants attending are not afforded the same legal protections, putting them at a greater risk of arrest or fines.<\/p>\n<p>Are unauthorised protests considered unlawful\uff1f<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Unauthorised&#8221; protests are not unlawful; they are just not protected.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">You do not need authorisation to protest or for a static gathering in a public place.<\/p>\n<p><img decoding=\"async\" alt=\"Courtney Houssos in a black top talking to the media\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/live-production.wcms.abc-cdn.net.au\/1173a7486a32312afb1a4bbbed59d094?impolicy=wcms_crop_resize&amp;cropH=3333&amp;cropW=5000&amp;xPos=0&amp;yPos=0&amp;width=862&amp;height=575\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Courtney Houssos says the laws are about keeping the community safe.
