(ABC News: Glenn Mullane)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Landlords may be motivated to keep good and long-term tenants in place by upgrading their property.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">You could also research other properties in a similar price bracket to see if they have air conditioning and put that as an argument to your landlord.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Residential Tenancy Authority spokesperson Sam Galer said if the property was uncomfortable to live in it was worth raising with a landlord.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It will be an ongoing issue for future tenants,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I would encourage tenants to put [that] forward to an owner.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Future tenants might ask for the same thing so that might motivate an owner.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If they refuse, you could apply to the tribunal for a breach of agreement and apply for an order that the landlord make the premises habitable.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">This can prove difficult and will depend on your state laws.<\/p>\n<p>Is cooling a requirement in my rental?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It depends on which state you live in and how hot your home gets.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/science\/2022-12-17\/cooling-summer-heat-air-conditioner-fan-water-money-electricity\/101589938\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Ways to keep cool this summer<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">As power prices rise alongside the mercury, and the world continues to pump carbon emissions into the atmosphere, what can we do to stay cool at home?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In most states, landlords are not legally required to provide air conditioning.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If it is already installed and included as an amenity, it must be maintained and repaired if needed.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Appreciating it is a competitive rental market, we encourage people to make sure the property they&#8217;re trying to rent is suitable for their needs,&#8221; Mr Galer said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;If there are fans or aircon, they need to be in good repair.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;You could also, when looking for a property, think what it might be like all year round. If you&#8217;re inspecting in winter, make sure it is suitable year round.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In most states, the home does have to be habitable, but the definition of habitable can vary.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In recent years, states and territories have been amending their tenancy laws to make sure landlords meet minimum rental standards.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">These standards differ by state, and in some they are not enforced.<\/p>\n<p>Victoria<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In Victoria, minimum standards are higher than in most states.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Last year, the Victorian government announced that, from March 1, 2027, main living areas must have an efficient electric cooling system for new leases, starting from that time.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Additionally, changes were announced to increase efficiency in rental homes, including:<\/p>\n<p>Ceiling insulation must be installed at the start of a new lease where there is no ceiling insulation already in placeWeather seals on all external doors, windows and wall vents must be installed at the start of a new lease<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Victoria already requires all rental properties to have a fixed heater in the main living space.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The heater must be energy efficient.<\/p>\n<p>Queensland<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In Queensland, general habitability must be ensured in a property.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">This means it must be clean, pest-free and free from hazards such as mould or asbestos.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Amenities such as air conditioning are not considered essential and fall outside of mandated standards.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Before a tenant signs a lease they may negotiate with the landlord about installing air conditioning.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Some landlords may be willing to install air conditioning as a condition of the lease and adjust the rent.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But legally, a landlord is only able to adjust the rent every 12 months.<\/p>\n<p>New South Wales<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Like Queensland, residential tenancy legislation in New South Wales does not require air conditioning or heating devices to be installed at a property.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But the premises must generally be habitable.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">If it takes an air conditioning unit to make that particular premises habitable, a tenant may be able to argue for one.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2025-12-04\/renters-energy-costs-report\/106079190\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Most renters avoid heating and cooling homes due to costs<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">A new report finds that about 70 per cent of renters were avoiding heating and cooling their homes to save money.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Units are specifically written in to the <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.nsw.gov.au\/housing-and-construction\/rules\/minimum-standards-for-rental-properties\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">seven minimum living standards<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">A property could have other issues that may make it unfit for a tenant to live in even if it meets the above seven minimum standards, the government&#8217;s Living in New South Wales website says.<\/p>\n<p>Western Australia<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Despite the high temperatures of Western Australian summers there is no obligation to provide air conditioning.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The minimum standards are similar to those of other states.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">There is also a requirement that a home must be insulated to protect tenants from extreme temperatures &#8220;where necessary&#8221;, the Western Australian consumer protection website says.<\/p>\n<p>Tasmania<\/p>\n<p class=\"paragraph_paragraph__iYReA\">A property in Tasmania must have a heater in the main living area of the property before it can be rented out.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It can be a fixed electric or gas heater, a heat pump or a wood heater.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">There is no requirement for a fixed cooling system.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">There are also <a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/cbos.tas.gov.au\/topics\/housing\/renting\/beginning-tenancy\/minimum-standards\/types\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">minimum standards for ventilation<\/a> \u2014 all rooms in a property must have openings to allow air in.<\/p>\n<p>South Australia<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In South Australia, there is no requirement for air conditioning in a rental property.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The state implemented minimum standards similar to those in most other states in 2024.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In addition, a property must be maintained to negate the possibility of being a fire hazard, and there are rules about the height and positioning of stairs and ceilings.<\/p>\n<p>Northern Territory<\/p>\n<p class=\"paragraph_paragraph__iYReA\">There are no specific minimum standards to be met in the Northern Territory.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But it is the landlord&#8217;s responsibility to ensure the property is clean and habitable and meets health and safety requirements.<\/p>\n<p>Australian Capital Territory<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The Residential Tenancies Act 1997 (RTA) was amended in 2020 to allow the ACT government to make minimum standards for residential tenancies.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">No minimum standards have yet been introduced.<\/p>\n","protected":false},"excerpt":{"rendered":"As Australia swelters through its first
