The declarations can be made for six months at a time, up from 12 hours, under changes by the Allan government last year in response to knife crime.<\/p>\n<p><img decoding=\"async\" alt=\"Tarneen Onus Browne, Sarah Schwartz and Benny Zable address the media outside the Federal Court.\" aspectratios=\"[object Object]\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/01\/2e9d301ae3971486d6492ad833c40c197abc854c.jpeg\"  class=\"sc-d2942506-1 wgbit\"\/>Tarneen Onus Browne, Sarah Schwartz and Benny Zable address the media outside the Federal Court.Wayne Taylor<\/p>\n<p>There is no legal need to have any suspicion the person has a weapon or is engaging in any wrongdoing when a declaration is in place.<\/p>\n<p>Police in November used six-month-long powers for the first time to declare Melbourne CBD and surrounding neighbourhoods a designated area, covering East Melbourne, the MCG, Shrine of Remembrance, Carlton Gardens, Southbank and South Melbourne.<\/p>\n<p>The powers would have been in force until May 29, but Victoria Police suddenly revoked the declaration prematurely two weeks ago in the days before the Federal Court was due to hear <a class=\"inline-link\" href=\"https:\/\/www.theage.com.au\/politics\/victoria\/expanded-police-search-powers-challenged-in-federal-court-20251207-p5nllh.html\" rel=\"nofollow noopener\" target=\"_blank\">a legal challenge to it.<\/a><\/p>\n<p>Justice Elizabeth Bennett found on Friday that police made the declaration erroneously. \u201cThat erroneous approach had the dual effect of meaning that the decision maker did not apply the correct statutory criteria and did not, as a matter of fact, reach the necessary state of satisfaction,\u201d she said.<\/p>\n<\/p>\n<p>The Federal Court found the declaration was incompatible with the Victorian Charter of Human Rights and Responsibilities and that police failed to properly consider these rights, particularly the right to privacy. The designated area was therefore unlawful, the court said.<\/p>\n<p>The case was expedited for Monday\u2019s planned Invasion Day rally.<\/p>\n<p>The Human Rights Law Centre brought the case on behalf of Aboriginal activist Tarneen Onus Browne and <a class=\"inline-link\" href=\"https:\/\/www.theage.com.au\/politics\/victoria\/benny-has-protested-in-a-costume-for-decades-he-says-his-mask-is-art-not-criminality-20251106-p5n8a0.html\" rel=\"nofollow noopener\" target=\"_blank\">environmentalist and anti-war protester Benny Zable<\/a>. A third applicant, David Hack, was added to the challenge after being searched in the CBD.<\/p>\n<p>The centre argued the declaration was invalid by failing to reach the legal threshold that the designation was \u201cnecessary\u201d, particularly given its wide-ranging scope and time frame, and breached the rights charter.<\/p>\n<p>The centre was also seeking a judgment that designated areas should not give police the power to direct someone to remove a face mask at protests, arguing it contravened implied constitutional freedoms to political communication. The court dismissed that claim.<\/p>\n<p>The Human Rights Law Centre said the findings called into question the legality of other designated areas and thousands of searches, and would make it much more difficult for Victoria Police to make the declarations in future.<\/p>\n<p>The centre\u2019s legal director Sarah Schwartz said the Victorian government should seriously reconsider the extraordinary powers.<\/p>\n<p>Onus Browne, a Gunditjmara, Yorta Yorta, Bindal and Meriam person from the Warriors of the Aboriginal Resistance, celebrated the decision on Friday.<\/p>\n<p><img decoding=\"async\" alt=\"Benny Zable and Tarneen Onus Browne when they launched the challenge in the Federal Court.\" aspectratios=\"[object Object]\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/01\/51a734336d754a569495f8591fb782c77c98ffcc.jpeg\"  class=\"sc-d2942506-1 ffXaNQ\"\/>Benny Zable and Tarneen Onus Browne when they launched the challenge in the Federal Court.Joe Armao<\/p>\n<p>The Invasion Day rally organiser said those attending were encouraged to wear face masks to protect vulnerable people such as elders from illness, and had worried First Nations people could be deterred from exercising their right to protest.<\/p>\n<p>In a statement, a Victoria Police spokesman said the force respected the court\u2019s decision and would take the time to consider the findings.<\/p>\n<p>\u201cOur intent has always been to protect the community and remove dangerous weapons from our streets,\u201d he said.<\/p>\n<p>The spokesman said the force was not planning to make Melbourne\u2019s CBD a designated area for Monday\u2019s rallies. He said officers were working constructively with protest organisers and had no intelligence to suggest a heightened risk of violence.<\/p>\n<p>Assistant Commissioner Brett Curran, in an affidavit to the court, said he had considered a police brief for several hours on November 24 before he signed off on the six-month search zone.<\/p>\n<p>Curran conceded<a class=\"inline-link\" href=\"https:\/\/www.theage.com.au\/politics\/victoria\/just-1-per-cent-of-designated-area-searches-find-illicit-items-20250313-p5ljdz.html\" rel=\"noopener noreferrer nofollow\" target=\"_blank\"> few weapons were seized<\/a> under similar, shorter and smaller declarations in the year beforehand, but argued this was a sign the powers were working as a deterrent.<\/p>\n<p>The assistant commissioner said he considered the broad area necessary as weapons could be carried between high-risk locations \u2013 like the MCG and Federation Square \u2013 and the expansive zone would be easier for police to enforce and for the public to comprehend.<\/p>\n<p>Editor&#8217;s pick<a href=\"https:\/\/www.theage.com.au\/healthcare\/unrelenting-more-young-people-are-suffering-from-this-painful-condition-no-one-knows-why-20260122-p5nw49.html\" tabindex=\"-1\" class=\"sc-cba76dee-0 hLTVHY\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" alt=\"Melissa Mack is among a growing number of younger Australians who have had shingles.\" aspectratios=\"[object Object]\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/01\/6cb707b997820557d318cce78c498f26c315a36f.jpeg\"  class=\"sc-d2942506-1 ffXaNQ\"\/><\/a><\/p>\n<p>Curran said the six-month period covered the busy season and that a longer declaration avoided the need for repeated designations over the same period.<\/p>\n<p>Zable, 80, has worn his \u201cGreedozer\u201d costume to protests for 45 years and says his performance art is political expression. In his affidavit, Zable said an officer had forcefully removed his mask while he was trying to comply with their direction.<\/p>\n<p>\u201cFor me, the costume and props are essential to express my opinions and messages.\u201d<\/p>\n<p>He was disappointed that protesters could still be directed to remove their masks in when designated areas are declared in future.<\/p>\n<p>Hack, the third applicant, said being searched outside Melbourne Central station while on his way to a protest in December was an invasion of his privacy.<\/p>\n<p>\u201cI wasn\u2019t doing anything wrong,\u201d Hack wrote in his affidavit. \u201cIt made me feel like a criminal.\u201d<\/p>\n<p>Two years of data obtained by Liberty Victoria revealed <a class=\"inline-link\" href=\"https:\/\/www.theage.com.au\/politics\/victoria\/just-1-per-cent-of-designated-area-searches-find-illicit-items-20250313-p5ljdz.html\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">just over 1 per cent of the searches<\/a> in designated areas resulted in any \u201cobjects or substances\u201d being found.<\/p>\n<p>The Centre for Racial Profiling Network, using freedom of information to examine all police search powers where that data is recorded, found Indigenous people were 11 times more likely to be searched than white people in 2023.
