An Australian YouTuber who is being sued by Andrew and Tristan Tate in a Florida court has won a bid to have the case dismissed, a decision the self-described misogynist influencers are now appealing.<\/p>\n

Adelaide man Nathan Pope, known as “Gadget” online, was one of 15 social media users, advocates and lawyers named in the lawsuit, brought on by internet personalities Andrew and Tristan Tate in March 2025.<\/p>\n

Mr Pope hosts a YouTube channel, largely dedicated to criticism of the brothers, who he has accused of taking advantage of their followers, particularly through their subscription-based online education business known as “The Real World”.<\/p>\n

“I was researching online and discovered that they were at that time predominantly targeting very young schoolboys,” Mr Pope told ABC News.<\/p>\n

“They were luring them into, what I believe, was a cult environment and isolating them from their families and friends, so I found that side of what the Tates were doing was quite a bit worse than what the public realised and I felt compelled to cover it from there.”<\/p>\n

The Tate brothers, particularly self-described misogynist Andrew Tate, have millions of followers online.<\/p>\n

Both brothers are facing charges of rape and human trafficking<\/a> in Romania and the United Kingdom.<\/p>\n

In their defamation lawsuit, the brothers said the criminal charges against them were false, and accused the group of social media users, advocates and lawyers of conspiring to defame them.<\/p>\n

“The Tate Brothers consult, advise, and generate income from various business ventures, with revenues estimated in the hundreds of millions of dollars,” court documents seen by the ABC state.<\/p>\n

“They are respected thought leaders, business moguls, and motivational speakers in multiple industries.”<\/p>\n

The documents said the brothers’ ability to generate income hinged on their reputation, which has been damaged by social media posts from the defendants.<\/p>\n

“As a direct consequence of the publication of the false statements \u2026 repeated at a minimum recklessly and vindictively to third parties, T. Tate and A. Tate sustained serious personal, financial, and professional injuries,” it said.<\/p>\n

But Mr Pope said his YouTube posts were factual.<\/p>\n

“Honestly, I think it’s just to silence me, because what we’re saying is effective and the truth and often counteracting what I believe are lies from the Tates,” he said.<\/p>\n

“They don’t like what they say being contradicted at all.”<\/p>\n

Mr Pope said the group of social media users being sued by the Tate brothers were turning to crowd funding to help pay for their legal fees.<\/p>\n

“My opinion is a lot of this is just to harass and financially drain us so, I expect them to draw this out as long as possible,” Mr Pope said.<\/p>\n

The Tate brothers have lived in Romania for a decade, but last year briefly returned to Florida where the lawsuit has been lodged<\/a>.<\/p>\n

In December 2025, the judge found that several of the defendants named in the suit do not live in Florida, and the court therefore did not have legal jurisdiction over them.<\/p>\n

He found even if their social media posts were read by someone in Florida, it did not automatically mean the court had jurisdiction over them.<\/p>\n

Many of the defendants, including Nathan Pope, were not named in the suit, but were listed under their online handles as “John Doe” defendants.<\/p>\n

The Judge found the Tate brothers “did not include the actual names of the ‘John Doe’ Defendants” and did not properly follow other legal procedures that would identify them and allow them to be served with legal documents.<\/p>\n

“Most of us aren’t even from the US. I’ve never been to the US or stepped foot in Florida,” Mr Pope said.<\/p>\n

“The judge has said himself in the dismissal of the lawsuit that there’s jurisdiction issues and he’s not sure why he’s suing us there.”<\/p>\n

A lawyer for several of the defendants, Christopher B. Hopkins, welcomed the decision in a statement.<\/p>\n

“Defamation cases are supposed to right actual wrongs, not just be litigation to drain someone’s bank account or frighten away any criticism,” Mr Hopkins said.<\/p>\n

“The court’s order draws important lines around jurisdiction, procedure, and fairness.”<\/p>\n

Following the court’s findings, the Tate brothers were given 20 days to amend their complaint, with the judge saying “any amendment shall name actual defendants and be supported by good-faith, fact-based basis for personal jurisdiction”.<\/p>\n

Since that finding, the Tates’ lawyers have appealed the finding that the so called “John Doe” defendants cannot be sued.<\/p>\n
