{"id":485209,"date":"2026-02-17T06:53:09","date_gmt":"2026-02-17T06:53:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/485209\/"},"modified":"2026-02-17T06:53:09","modified_gmt":"2026-02-17T06:53:09","slug":"coles-downplays-meaning-of-down-down-price-tags-and-advertising-in-case-against-accc","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/485209\/","title":{"rendered":"Coles downplays meaning of &#8216;Down Down&#8217; price tags and advertising in case against ACCC"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">Coles has downplayed what shoppers understood when they saw its &#8220;Down Down&#8221; price tags and advertising, saying &#8220;not much&#8221;, on the second day of a bombshell federal court case.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The Australian Competition and Consumer Commission (ACCC) is suing Coles in a lawsuit described as &#8220;the case of the century&#8221; by a former ACCC boss.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Yesterday, the ACCC accused Coles of a &#8220;planned&#8221; campaign to mislead customers with fake or &#8220;illusory&#8221; discounts on hundreds of common household items from dog food to yoghurt and bottles of Coke.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The consumer watchdog claims the supermarket giant jacked up prices for a short time before cutting them and including items in the &#8220;Down Down&#8221; promotion.<\/p>\n<p><img decoding=\"async\" alt=\"A sign in a Coles fresh produce section saying 'Great Value. (Four Corners)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It claims the &#8220;Down Down&#8221; price was actually more than, or the same as, the regular price.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In evidence this morning the judge overseeing the case, Justice Michael O&#8217;Bryan, asked Coles to explain what it was telling customers with its prominent marketing campaign, featuring giant red hands pointing down.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It&#8217;s really asking a bigger question about what ordinary consumers understand about the Down Down program,&#8221; Justice O&#8217;Bryan said.<\/p>\n<p>&#8220;I don&#8217;t know if I&#8217;ve seen a statement from Coles which directly answers that question.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In response, legal counsel for Coles John Sheahan KC said: &#8220;In terms of what consumers would take from the advertising campaigns and the red hand \u2014 not much.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It&#8217;s an indication that Coles is trying to keep prices low,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Justice O&#8217;Bryan probed further, asking if Coles would accept that &#8220;Down Down&#8221; was a promotion and showed a discount.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Yes,&#8221; Mr Sheahan responded.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Do you have a story about a company misleading consumers? discounts.\u00a0 (ABC News: Patrick Stone\u00a0)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Yesterday, the ACCC used three prices Coles charged for a tin of dog food to illustrate what it claimed was the misleading conduct.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">For a period of almost 300 days between April 2022 and February 2023, Coles offered a 1.2 kilogram loaf of Nature&#8217;s Gift Wet Dog Food for $4, ACCC legal counsel Garry Rich told the court.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Then for seven days the price rose by 50 per cent to $6.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">On the eighth day the price was set at $4.50 \u2014 13 per cent more than customers had been paying for all but seven of the previous 303 days \u2014 with Coles labelling the product &#8220;Down Down&#8221;.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2026-02-16\/accc-accuses-coles-of-planned-campaign-to-mislead-customers\/106295046\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Coles promotions slammed in court<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Supermarket giant Coles is accused of a &#8220;planned&#8221; campaign to mislead customers over discounts on the first day of a bombshell Federal Court case.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mr Rich said while that statement was &#8220;literally true&#8221; it was also &#8220;utterly misleading&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It did not disclose that a reasonable consumer would not have understood that Coles had increased the price to $6 for just seven days, immediately before the promotion, and that for 296 days before that, the price was $4,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">That line of argument was criticised by Coles.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;In the end, all prices are temporary.
