In love. <a rel=\"nofollow noopener\" class=\"link  yahoo-link\" href=\"https:\/\/au.finance.yahoo.com\/news\/aussies-breaking-up-and-making-up-to-keep-costs-down-011523209.html\" data-i13n=\"cpos:1;pos:1\" data-ylk=\"slk:Want to spend as much time as possible together;cpos:1;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" target=\"_blank\">Want to spend as much time as possible together<\/a> in the same space.<\/p>\n<p class=\"yf-vbsvxt\">Maybe they think, &#8220;Rent is so expensive, why don&#8217;t we just half our costs and move in together?&#8221;<\/p>\n<p class=\"yf-vbsvxt\">Under Australian law, that decision can be <a rel=\"nofollow noopener\" class=\"link  yahoo-link\" href=\"https:\/\/au.finance.yahoo.com\/news\/how-financial-infidelity-can-quietly-cost-aussie-couples-163000-big-money-problems-204821771.html\" data-i13n=\"cpos:2;pos:1\" data-ylk=\"slk:a major financial event.;cpos:2;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" target=\"_blank\">a major financial event.<\/a> And most people don\u2019t realise it until it\u2019s too late.<\/p>\n<p class=\"yf-vbsvxt\">RELATED<\/p>\n<p class=\"yf-vbsvxt\">People still think there\u2019s a bright line between \u201cdating\u201d, \u201cliving together\u201d, and \u201cmarried\u201d.<\/p>\n<p class=\"yf-vbsvxt\">Legally, that line barely exists.<\/p>\n<p class=\"yf-vbsvxt\">Once a relationship is considered <a class=\"link \" href=\"https:\/\/www.fcfcoa.gov.au\/fl\/pubs\/defacto\" data-i13n=\"cpos:6;pos:1\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:de facto;cpos:6;pos:1;elm:context_link;itc:0;sec:content-canvas\">de facto<\/a>, a breakup can trigger property settlements, <a class=\"link \" href=\"https:\/\/www.ag.gov.au\/families-and-marriage\/dividing-property-finances-and-superannuation-after-separation\/superannuation-splitting\" data-i13n=\"cpos:7;pos:1\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:superannuation splits;cpos:7;pos:1;elm:context_link;itc:0;sec:content-canvas\">superannuation splits<\/a> and, in some cases, ongoing financial obligations. No ring. No wedding. No paperwork announcing you\u2019ve crossed into this zone.<\/p>\n<p class=\"yf-vbsvxt\">It just\u2026 happens.<\/p>\n<p class=\"yf-vbsvxt\">Australian de facto law doesn\u2019t work on neat rules. There\u2019s no form you sign or ceremony that you need to do.<\/p>\n<p class=\"yf-vbsvxt\">Instead, courts look back after the relationship ends and look at things like:<\/p>\n<p class=\"yf-vbsvxt\">How long you lived together<\/p>\n<p class=\"yf-vbsvxt\">Are there any children<\/p>\n<p class=\"yf-vbsvxt\">Whether you shared finances or supported each other<\/p>\n<p class=\"yf-vbsvxt\">How property was used<\/p>\n<p class=\"yf-vbsvxt\">Whether one person sacrificed earning capacity<\/p>\n<p class=\"yf-vbsvxt\">How you presented yourselves socially<\/p>\n<p class=\"yf-vbsvxt\">There\u2019s no single factor that decides it. Duration alone isn\u2019t enough. And two years of living together is not a hard line, despite how often it\u2019s quoted.<\/p>\n<p class=\"yf-vbsvxt\">If I had a dollar for every time I heard these, I\u2019d be writing this from a beach somewhere.<\/p>\n<p class=\"yf-vbsvxt\">\u201cThe house was mine before we met.\u201d<\/p>\n<p class=\"yf-vbsvxt\">Assets owned before entering into a relationship can still be subjected to a split after separation.<\/p>\n<p class=\"yf-vbsvxt\">\u201cWe kept our finances separate.\u201d<\/p>\n<p class=\"yf-vbsvxt\">Living together is already a form of financial interdependence.<\/p>\n<p class=\"yf-vbsvxt\">\u201cWe didn\u2019t want to get married because we didn\u2019t want the legal stuff.\u201d<\/p>\n<p class=\"yf-vbsvxt\">Ironically, you may have signed up for most of it anyway.<\/p>\n<p class=\"yf-vbsvxt\">These aren\u2019t reckless people. Many are professionals, investors, business owners. The relationship itself was seven years long, and there was no marriage.<\/p>\n<p class=\"yf-vbsvxt\">They moved in together, shared living expenses, and his partner took on more of the domestic load while he focused on expanding the business. When the relationship ended, what he thought was a clean personal breakup turned into a complex financial dispute. The home he assumed was untouchable was brought into the property pool and the business had to be valued.<\/p>\n<p class=\"yf-vbsvxt\">And he said the most common sentence we hear all the time:<\/p>\n<p class=\"yf-vbsvxt\">\u201cI had no idea this could happen.\u201d<\/p>\n<p class=\"yf-vbsvxt\"><a class=\"link \" href=\"https:\/\/justicefamilylawyers.com.au\/prenups-bfas-for-professionals-and-executives\/\" data-i13n=\"cpos:8;pos:1\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Binding financial agreements;cpos:8;pos:1;elm:context_link;itc:0;sec:content-canvas\">Binding financial agreements<\/a> have an image problem, mostly because people tend to confuse planning with pessimism and assume that putting something in writing somehow predicts the end of a relationship.<\/p>\n<p class=\"yf-vbsvxt\">It doesn\u2019t.<\/p>\n<p class=\"yf-vbsvxt\">Are you pessimistic for taking out home insurance? For buying insurance for your car in case something goes wrong?<\/p>\n<p class=\"yf-vbsvxt\">In reality, these agreements serve the same purpose as insurance, estate planning, or asset structuring: they acknowledge that life is unpredictable and that sensible people plan for uncertainty without expecting the worst to happen.<\/p>\n<p class=\"yf-vbsvxt\">When done properly, a financial agreement isn\u2019t about mistrust or negativity \u2013 it\u2019s about clarity. It allows each person to protect what they bring into a relationship, sets expectations while things are still calm and cooperative, and significantly reduces the likelihood of costly disputes if the relationship does come to an end.<\/p>\n<p class=\"yf-vbsvxt\">Perhaps most importantly, it removes guesswork at a time when emotions tend to run high and rational decision-making is at its lowest.<\/p>\n<p class=\"yf-vbsvxt\">Seen through that lens, financial agreements sit comfortably alongside wills and insurance policies. They\u2019re not a statement about how confident you are in a relationship; they\u2019re a statement about how seriously you take your financial future.
