Former Australian of the Year Grace Tame is unlikely to face charges after chanting \u201cglobalise the Intifada\u201d at a pro-Palestine rally, with NSW\u2019s top cop admitting he had not watched the speech.<\/p>\n

Ms Tame, a sexual assault survivor and advocate, stirred controversy earlier this month after she was filmed chanting \u201cFrom Gadigal to Gaza, globalise the Intifada\u201d at a protest opposing Israeli President Isaac Herzog\u2019s visit to Australia.<\/p>\n

The phrase is linked to two popular uprisings in the Occupied Palestinian Territories \u2013 but is regarded by swathes of the Jewish community as a call to violence.<\/p>\n

It has been criminalised in recent weeks in Queensland, with a NSW parliament probe recommending the Labor government do the same.<\/p>\n

However, under current laws, the term had been \u201creviewed on a number of occasions\u201d and not found to meet the criteria of inciting racial hatred, NSW Police Commissioner<\/p>\n

Mal Lanyon told a NSW budget estimates hearing on Friday afternoon.<\/p>\n

\u201cIt\u2019s not a prohibited term at the moment,\u201d Mr Lanyon said.<\/p>\n

\u201cIt may be offensive to some members of the community, and I\u2019ll certainly accept that.\u201d<\/p>\n

The questions by Liberal MLC Susan Carter related to Crimes Act 1900 section 93ZAA, or the offence of publicly inciting hatred on ground of race.<\/p>\n

Mr Lanyon said he had not watched Ms Tame\u2019s speech but admitted he was aware of reporting on it.<\/p>\n

Asked if he\u2019d watched the speech, he said: \u201cNot personally, not in terms of her speech\u201d.<\/p>\n

Mr Lanyon and Deputy Commissioner Dave Hudson told the hearing they were not aware of any complaints about the speech.
\u201cI\u2019m unaware of NSW Police receiving any compliant,\u201d he said.<\/p>\n

\u201cI can\u2019t say that hasn\u2019t happened. I\u2019m certainly unaware of.\u201d<\/p>\n

Mr Lanyon confirmed legal advisers had been present at the rally with officers, but could not confirm whether they had reviewed Ms Tame\u2019s speech.<\/p>\n

He noted police had taken action at a March For Australia rally earlier this year where Brandan Koschel was charged with publicly inciting hatred on the grounds of race causing fear over on-mic comments.<\/p>\n

Anthony Albanese has faced pressure from the Coalition to condemn Ms Tame.<\/p>\n

This week, the Prime Minister was forced to backtrack after calling the former Australian of the Year a \u201cdifficult\u201d woman.<\/p>\n

He later apologised, claiming he was referring to Ms Tame\u2019s life.<\/p>\n
