But does it really confuse consumers?"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">When is milk not milk?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Debate has raged over whether non-dairy products should be able to use labels such as milk, yoghurt and cheese.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Now, the Australian dairy industry has seized upon a recent UK Supreme Court ruling, in which an oat-based drinks company lost a long-running legal battle to use the word &#8220;milk&#8221; in its marketing, to push for tighter labelling laws in Australia.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Earlier this month, the UK&#8217;s highest court ruled that Swedish company Oatly could no longer trademark or use the wording &#8220;Post Milk Generation&#8221; on its food products, following an objection by British dairy farmers.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Dairy UK argued that under trademark law, the term &#8220;milk&#8221; could only be used to refer to products coming from an animal.<\/p>\n<p><img decoding=\"async\" alt=\"Robert, a middle-aged white-haired fair-skinned man, smiles as he leans on a farm fence post with his hands together \" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/03\/b8a022ee24b1bbcadfe29e31f6e6232b.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Robert Brokenshire is arguing for &#8220;truth in labelling&#8221; when it comes to non-dairy based products. (ABC Rural: Selina Green)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Mr Brokenshire said the dairy industry was facing other challenges, with a potential European Union trade agreement threatening to restrict Australian producers&#8217; ability to use terms such as feta and parmesan.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;We&#8217;ve got all these challenges, but we&#8217;ve been dragging the chain when it comes to equity and fairness in our own industries,&#8221; he said.<\/p>\n<p>Strengthening the voluntary code<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The Australian government committed $1.5 million in its 2024\u201325 budget to improve existing arrangements for the labelling of plant-based and alternative protein products.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Federal Agriculture Minister Julie Collins has since announced that would involve the development of an industry code of practice, led by the Alternative Proteins Council.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">According to the minister, the voluntary code will provide clearer guidance to plant-based producers by discouraging animal imagery, limiting meat-specific terminology, improving the prominence of plant-based qualifiers, and establishing a transparent complaints mechanism.<\/p>\n<p><img decoding=\"async\" alt=\"A glass of oat milk being poured next to a glass of rolled oats\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/03\/ddf2d282e862abe3f3601bf305fe8c7a.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Plant-based milk alternatives are derived from legumes, nuts, cereals or seeds. (ABC News: Bec Whetham)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">He did not believe changing the name would significantly impact the plant-based protein industry, given its market popularity.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It wouldn&#8217;t make any difference whatsoever \u2026 I think that the market&#8217;s already established,&#8221; Mr Jackson said.<\/p>\n<p>&#8220;I just think that it&#8217;s a lot of energy over something that the almond industry and the dairy industry should be working closely together, not trying to drive wedges between us.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Food labelling expert Courtney Stewart was not surprised by the recent UK Supreme Court ruling around the use of the word milk.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It&#8217;s something that&#8217;s probably been brewing for a while,&#8221; Dr Stewart said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I think there&#8217;s probably been a little bit of controversy in the way that the terminology around milk has been used, so it is interesting to see there&#8217;s actually a bit of a legal playbook now for companies to follow.&#8221;<\/p>\n<p>Imagery rather than wording matters<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Dr Stewart said Australia&#8217;s approach to non-dairy labelling was more concerned around imagery than wording.<\/p>\n<p><img decoding=\"async\" alt=\"A women with dark hair smiles, weaking a black top. \" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/03\/a386ad29f7d973a82afde85f53c79c1e.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Courtney Stewart says imagery rather than wording seems to confuse consumers. (Supplied: Courtney Stewart)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;There was some research done by Food Standards Australia New Zealand, and they found that consumers generally were pretty clear about the difference between dairy versus plant-based alternatives,&#8221; she said.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;The only area where there was confusion was around when there was animal imagery on plant-based products.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;If a consumer is looking at that imagery and \u2026 there&#8217;s something that indicates it might be a cow-based product, but then the name of the product is that it&#8217;s oat-based, it can really create that confusion for consumers, which is misleading.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"When is milk not milk?
