{"id":538751,"date":"2026-03-13T23:20:10","date_gmt":"2026-03-13T23:20:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/538751\/"},"modified":"2026-03-13T23:20:10","modified_gmt":"2026-03-13T23:20:10","slug":"what-does-katy-perrys-loss-in-the-high-court-mean-for-her-business","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/538751\/","title":{"rendered":"What does Katy Perry&#8217;s loss in the High Court mean for her business?"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">Sydney designer Katie Taylor, the woman behind the Katie Perry label, was on a high.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Surrounded by empty champagne glasses in her newly launched Mossman showroom, she opened a letter with devastating news.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It said, these words jumped out at me, &#8216;Cease and desist, stop sale of your clothes, stop any advertising material, stop your website, otherwise this is going to go to the Supreme Court,'&#8221; Ms Taylor said this week.<\/p>\n<p>&#8220;I just burst into tears. I thought, &#8216;I&#8217;m going to lose everything, and this has been my dream since I was 11 years old.'&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">The letter was from international superstar Katy Perry, whose bid to lodge a trademark to sell clothing in Australia had been blocked because Ms Taylor had just secured that trademark herself.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Taylor was born with the name Katie Perry, and when she began her small business, she applied for a trademark under that name.<\/p>\n<p class=\"paragraph_paragraph___QITb\">This week, <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-03-11\/act-katy-and-katie-perry-high-court-judgment\/106439894\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/106439894\" rel=\"nofollow noopener\" target=\"_blank\">the High Court ended the superstar&#8217;s bid to force a cancellation of the designer&#8217;s trademark<\/a>, but the battle, it seems, is far from over.<\/p>\n<p>Questions remain around Katy Perry tour merchandise<img decoding=\"async\" alt=\"Katy Perry\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/03\/3d24d30c2bee9435312f30526dd908cf.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">It is still unclear whether Katy Perry will be able to sell her clothing merchandise as part of any future tours. (Getty Images: Amy Sussman)<\/p>\n<p class=\"paragraph_paragraph___QITb\">To start with, the High Court has sent the case back to the federal court to determine the not insignificant costs.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But questions about whether the singer will be able to sell her &#8220;Katy Perry&#8221; clothing merchandise as part of any future tours are not resolved.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Sarah Hook from the University of Technology Sydney said it was an ongoing issue.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Now it goes back to trial and they&#8217;re going to talk about what that means in terms of liability,&#8221; Dr Hook said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;So Katy Perry, the singer, might have some kind of defence, such as honest concurrent use, prior use \u2026 good faith of using her name.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;All of that has to be sorted out again.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">If the singer was found to have done the wrong thing, Dr Hook said determining what happened next could be difficult.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;There&#8217;s a number of penalties that they could give. (ABC News: John Gunn)<\/p>\n<p>A 16-year legal battle<\/p>\n<p class=\"paragraph_paragraph___QITb\">The potted story of the legal struggle between the pair is that it began in 2009, although the initial threat of court action went nowhere.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But over the next few years, Katie Taylor had customers remarking on the &#8220;Katy Perry&#8221; clothing they had seen.<\/p>\n<p class=\"paragraph_paragraph___QITb\">That prompted a Federal Court challenge in 2019, in which Ms Taylor alleged the singer had breached her trademark.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But in an appeal, the full bench <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2024-11-22\/katy-perry-wins-appeal-trademark-battle-sydney-label-katie-perry\/104633950\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/104633950\" rel=\"nofollow noopener\" target=\"_blank\">found Ms Taylor was the one who had breached the trademark rules and that the singer already had a reputation associated with the brand name, ordering the &#8220;Katie Perry&#8221; trademark be cancelled<\/a>.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">It is that ruling that was reversed by the High Court this week.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Dr Hook said while the High Court had left many issues still to be resolved, it did make other things clear.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;They were sort of concerned about the way that the full Federal Court was looking at \u2026 if a celebrity owns or a singer owns a trademark, which she does, in entertainment and music, does that necessarily mean that consumers would think that they have a monopoly on all these other products that celebrities are known to go out and do?&#8221; Dr Hook said.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;So things like perfumes and clothing and things like that.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;They said \u2026 that&#8217;s not the case, [and] that especially when the Australian designer put in the trademark application, Katy Perry was a singer, she [Katie Taylor] knew she was a singer, but that doesn&#8217;t mean that she therefore has this monopoly over everything.&#8221;<\/p>\n<p>Case about &#8216;protecting and supporting&#8217; small businesses<img decoding=\"async\" alt=\"Sydney fashion designer Katie Jane Taylor, who owns the fashion label Katie Perry, straight faced sitting at table\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/03\/c7753e9e5da7114847077019a63d4242.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Katie Taylor says the case is important in terms of standing up for the rights of small businesses. (ABC News: Timothy Ailwood)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Katie Taylor was born Katie Perry, and says when she heard the song I Kissed a Girl, she loved knowing there was a singer of the same name.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But that soon turned sour, with a legal battle that has raged for 16 years so far.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I think the damage that it&#8217;s done is more \u2026 it&#8217;s kept me away from my business \u2014 and anybody with a small business knows the amount of hours and times and commitment that it takes,&#8221; Ms Taylor said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;This whole legal case has taken up so much of my time, my emotional bandwidth. It&#8217;s even really impacted my time with my family and my kids.\u00a0<\/p>\n<p>&#8220;It has been part of my life for such a long period.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">But Ms Taylor said she felt the case was important not just for her own situation.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;This case has always been about more than just my trademark \u2026 it&#8217;s actually been about protecting and supporting all of small businesses,&#8221; Ms Taylor said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Because we all matter, whether or not you&#8217;re a small business with two young kids, you&#8217;re a mum, or you&#8217;re a big global pop star.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"Sydney designer Katie Taylor, the woman behind the Katie Perry label, was on a high.
