The two sides have been locked in an <a href=\"https:\/\/www.theguardian.com\/technology\/2026\/mar\/09\/anthropic-artificial-intelligence-pentagon\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">escalating feud<\/a> over Anthropic\u2019s refusal to allow its Claude AI chatbot to be used for domestic mass surveillance and fully autonomous lethal weapons. <a href=\"https:\/\/www.theguardian.com\/us-news\/donaldtrump\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump<\/a> has ordered all US government agencies to stop using Anthropic\u2019s tools, which the company is also contesting.<\/p>\n<p class=\"dcr-130mj7b\">Representatives for the AI firm and the government appeared in a northern California district court, where Judge Rita Lin presided over the hearing for a temporary injunction. The hearing is one of the first steps in <a href=\"https:\/\/www.theguardian.com\/technology\/2026\/mar\/09\/anthropic-defense-department-lawsuit-ai\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Anthropic\u2019s lawsuit<\/a> against the defense department, which it filed earlier this month after Pete Hegseth, the secretary of defense, declared the company a supply chain risk \u2013 a designation that Anthropic alleges will <a href=\"https:\/\/www.reuters.com\/technology\/anthropic-seeks-court-stay-pentagon-supply-chain-risk-designation-2026-03-12\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">cause irreparable harm<\/a> and cost hundreds of millions or more in revenue.<\/p>\n<p class=\"dcr-130mj7b\">Anthropic\u2019s suit and Lin\u2019s decision will have widespread ramifications for both the company and the US government, which has come to extensively rely on Claude over the past year for a variety of uses, including in its military operations against Iran. The standoff between the defense department and Anthropic, especially the former\u2019s move to categorize a US company as a supply chain risk for the first time ever, has also created significant tension in Silicon Valley\u2019s <a href=\"https:\/\/www.theguardian.com\/technology\/2026\/jan\/20\/trump-tech-alliance-datacenters-social-media\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">close<\/a> <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/jan\/11\/trump-silicon-valley\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">relationship<\/a> with the Trump administration.<\/p>\n<p class=\"dcr-130mj7b\">Lin opened the hearing with her thoughts on the case, calling it a \u201cfascinating public policy debate\u201d while saying that her role was to narrowly decide whether the government\u2019s actions were illegal. Lin also said she had questions about the government\u2019s actions, which appeared to go beyond a decision simply not to work with Anthropic and veer into punitive measures.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt looks like an attempt to cripple Anthropic,\u201d Lin said.<\/p>\n<p class=\"dcr-130mj7b\">Lawyers for the government argued that <a href=\"https:\/\/x.com\/SecWar\/status\/2027507717469049070\" data-link-name=\"in body link\" rel=\"nofollow\">Hegseth\u2019s social media post<\/a> last month declaring that no contractors could do business with the government was not a legal action and no entity would face noncompliance issues if they ignored it. The government\u2019s argument seemed to conflict with Hegseth\u2019s post on X that any contractor that does business with the military is prohibited from working with Anthropic.<\/p>\n<p class=\"dcr-130mj7b\">\u201cYou\u2019re standing here saying, \u2018We said it, but we didn\u2019t really mean it,\u2019\u201d Lin pressed the government\u2019s lawyer on their claim. Lin later asked why Hegseth would post the claim if it had no legal effect.<\/p>\n<p class=\"dcr-130mj7b\">\u201cI don\u2019t know,\u201d the government\u2019s lawyer replied.<\/p>\n<p class=\"dcr-130mj7b\">Anthropic declined to comment on the lawsuit. The defense department has previously stated that as a matter of policy it does not comment on litigation.<\/p>\n<p class=\"dcr-130mj7b\">Anthropic alleges that the government violated the company\u2019s first amendment rights by designating it a supply chain risk, arguing that the decision was an attempt at punishing the company for displeasing the president and for not complying with the defense department\u2019s request to loosen safety guardrails on Claude.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThese actions are unprecedented and unlawful. The constitution does not allow the government to wield its enormous power to punish a company for its protected speech,\u201d Anthropic stated in its California suit.<\/p>\n<p class=\"dcr-130mj7b\">Anthropic has argued that its AI model is not reliable enough to be used for the purposes of mass domestic surveillance or fully automated lethal weapons, while its CEO, Dario Amodei, has expressed concerns about AI being used in authoritarian ways. US defense officials and Trump have meanwhile framed the company\u2019s actions as a politically biased betrayal of the country, with Trump calling it a \u201cA RADICAL LEFT, WOKE COMPANY\u201d in a post on his social media platform, Truth Social.<\/p>\n<p class=\"dcr-130mj7b\">Despite the defense department striking deals in recent weeks with rival firms OpenAI and Elon Musk\u2019s xAI to allow them to operate in a classified environment, disentangling federal agencies from their use of Claude is <a href=\"https:\/\/www.reuters.com\/business\/hegseth-wants-pentagon-dump-anthropics-claude-military-users-say-its-not-so-easy-2026-03-19\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">an enormous undertaking<\/a> that would take months of disruption to complete.
