You\u2019ve got <a href=\"https:\/\/gizmodo.com\/oura-ring-4-ceramic-review-can-the-latest-smart-ring-really-track-it-all-2000692522\" rel=\"nofollow noopener\" target=\"_blank\">all sorts of smart rings<\/a>, <a href=\"https:\/\/gizmodo.com\/googles-next-fitbit-sounds-exactly-like-a-whoop-clone-2000740825\" rel=\"nofollow noopener\" target=\"_blank\">fitness trackers<\/a>, <a href=\"https:\/\/gizmodo.com\/nothing-might-get-into-smart-glasses-at-the-worst-possible-time-2000740782\" rel=\"nofollow noopener\" target=\"_blank\">smart glasses<\/a>, <a href=\"https:\/\/gizmodo.com\/this-is-what-has-become-of-the-humane-ai-pin-an-enterprise-laptop-chatbot-2000737668\" rel=\"nofollow noopener\" target=\"_blank\">weird, useless pins stuffed with AI<\/a>\u2014you name it. You also have, as a result of all that captivating innovation, quite a few lawsuits.<\/p>\n<p>Most recently on that litigious side of things is a lawsuit from screenless health tracker company Whoop,\u00a0which is <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ded.92454\/gov.uscourts.ded.92454.1.0.pdf\" rel=\"nofollow noopener\" target=\"_blank\">suing the maker of a health app called Bevel<\/a>, alleging that it\u2019s copying core parts of Whoop\u2019s brand. Below is a video of Bevel CEO, Grey Nguyen, <a href=\"https:\/\/x.com\/greyngyen\/status\/2040100105336799659\" rel=\"nofollow\">talking about the lawsuit<\/a>.<\/p>\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/WHOOP?ref_src=twsrc%5Etfw\" rel=\"nofollow noopener\" target=\"_blank\">@WHOOP<\/a> just filed a lawsuit against us.<\/p>\n<p>A $10B company with 800+ employees is scared of us, a 20-person team making health tracking accessible to all.<\/p>\n<p>Rather than focusing on product and innovation, Whoop has decided to use its newly raised capital on lawfare.<\/p>\n<p>In this video, I\u2026 <a href=\"https:\/\/t.co\/gpi6AUpc40\" rel=\"nofollow\">pic.twitter.com\/gpi6AUpc40<\/a><\/p>\n<p>\u2014 Grey (@greyngyen) <a href=\"https:\/\/twitter.com\/greyngyen\/status\/2040100105336799659?ref_src=twsrc%5Etfw\" rel=\"nofollow noopener\" target=\"_blank\">April 3, 2026<\/a><\/p>\n<p>Obviously, the details are a whole can of legal worms, but the suit centers on something called \u201ctrade dress,\u201d which is legal terminology that refers to the way a product looks and feels\u2014it\u2019s that je ne sais quoi that Whoop claims Bevel is copying. <a href=\"https:\/\/www.bevel.health\/\" rel=\"nofollow noopener\" target=\"_blank\">Bevel<\/a>, for the record, doesn\u2019t make hardware like Whoop, but it does offer an app that\u2019s meant to crunch the data from health wearables and provide insights on sleep, exercise, stress, and more. While Bevel doesn\u2019t integrate with Whoop, it does use data from the Apple Health app, where data from Whoop\u2019s band is stored.<\/p>\n<p>There are a lot of ways you could look at the lawsuit, but one thing is abundantly clear, and that\u2019s the fact that Whoop (which just announced that it <a href=\"https:\/\/www.whoop.com\/us\/en\/press-center\/whoop-announces-series-g-funding\/?srsltid=AfmBOorCT7he6Qy1SflE2BcyzL_On_gC0lCX1JWRmNcaAwjiikgmU_p3\" rel=\"nofollow noopener\" target=\"_blank\">raised $575 million<\/a> in capital this week) isn\u2019t exactly pumped about its newfound competition\u2014and it\u2019s not just Bevel ruffling its feathers. In October, <a href=\"https:\/\/dockets.justia.com\/docket\/new-york\/nyedce\/2:2025cv05766\/537618\" rel=\"nofollow noopener\" target=\"_blank\">Whoop also sued Polar<\/a>, which makes its own version of screenless fitness wearables. The complaints, as you might expect, are similar to those made against Bevel. Whoop alleges that the <a href=\"https:\/\/gizmodo.com\/polar-loop-review-better-than-a-whoop-5-0-2000684399\" rel=\"nofollow noopener\" target=\"_blank\">Polar Loop<\/a> copies key parts of Whoop\u2019s design and that the hardware is tantamount to patent infringement.<\/p>\n<p>The Polar Loop, for the record, is similar to Whoop in that it tracks a lot of the same metrics, looks similar, and is also connected to an app. To make matters worse for Whoop, it\u2019s also cheaper and doesn\u2019t require a monthly subscription, making it an enticing competitor in the space if you\u2019re looking to save some money and don\u2019t mind going with a lesser-known brand.<\/p>\n<p>Whether either of Whoop\u2019s competitors is actually infringing on patents is something for a judge to decide, but for consumers, the immediate results might not be great. Think about it, if you\u2019re a health-tracking startup looking to carve out a niche in the space, do you really want to rush ahead knowing damn well that Whoop is waiting there with a team of lawyers? Maybe you do, if you\u2019ve got the resources and grit, but I\u2019m going to assume that startups operating in this space will think twice with the scent of litigation in the air.<\/p>\n<p>Then there\u2019s the potential fallout from lawsuits to consider. What if the court determines that companies like Polar and Bevel\u00a0did\u00a0infringe on Whoop\u2019s patents? That could mean both of those brands end up either having to gut their products or drastically change them in a way that defeats the purpose. These are hypotheticals, of course, but in the pantheon of outcomes stemming from a lawsuit, they\u2019re a real possibility.<\/p>\n<p>Health wearables are only a part of the equation, too. Similar lawsuits have bubbled up in the smart glasses space, though in this case, it\u2019s not a big name pointing the finger at a little guy; it\u2019s everyone pointing the finger at Meta. Mark Zuckerberg\u2019s efforts in the smart glasses space have already drawn the ire of companies claiming Meta stole their ideas to make various aspects of its <a href=\"https:\/\/gizmodo.com\/ray-ban-meta-gen-2-review-still-the-best-non-display-smart-glasses-2000664295\" rel=\"nofollow noopener\" target=\"_blank\">Ray-Ban-branded smart glasses<\/a>.<\/p>\n<p>While Solos, a competing smart glasses company, is <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2026-01-23\/meta-essilorluxottica-sued-in-smart-glasses-patent-case\" rel=\"nofollow noopener\" target=\"_blank\">alleging that Meta stole parts of its smart glasses technology,<\/a> including audio and processing, to create the Ray-Ban Meta AI glasses, a company called Perceptix Technologies is <a href=\"https:\/\/news.bloomberglaw.com\/ip-law\/meta-ar-glasses-prompt-patent-suit-over-muscle-signal-technology\" rel=\"nofollow noopener\" target=\"_blank\">alleging that Meta is infringing on its patents<\/a> around electromyography (EMG) devices. For context, Meta\u2019s Neural Band, the muscle-reading wristband that can be used to control the <a href=\"https:\/\/gizmodo.com\/meta-ray-ban-display-smart-glasses-review-is-this-the-future-we-really-want-2000679520\" rel=\"nofollow noopener\" target=\"_blank\">Meta Ray-Ban Display<\/a> with finger\/hand motions, uses EMG to do so. Perceptix Technologies holds patents on similar EMG devices.<\/p>\n<p>Needless to say, there\u2019s a lot of finger-pointing happening in the wearable space right now, and it\u2019s not just people trying to get their <a href=\"https:\/\/gizmodo.com\/smart-glasses-have-privacy-advocates-scrambling-2000734146\" rel=\"nofollow noopener\" target=\"_blank\">increasingly unwelcome smart glasses<\/a> to take a picture. Lawsuits like this typically don\u2019t shake out overnight\u2014patent litigation can take several years, especially at a high level. The consequences could be significant, though, when\/if they do arrive. While Meta likely won\u2019t stop selling smart glasses regardless of whether it loses in court, companies like Bevel and Polar may not have the same immunity. Whatever happens, I wouldn\u2019t expect wearables to get any less spicy soon; for companies of scale, lawsuits are a small price to pay when the prospect of cornering a new market is on the table.<\/p>\n<p>      <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n","protected":false},"excerpt":{"rendered":"Wearables are an exciting space right now.
