Photos: Getty Images, Eddie Jim<\/p>\n<p>The two groups remain at loggerheads despite ongoing attempts by the Rebels\u2019 side to settle the matter, most recently for a seven-figure sum, according to a source familiar with the negotiations but not permitted to talk publicly.<\/p>\n<p>The new bill takes the security for costs orders towards $3 million after an earlier payment of $550,000 by the club.<\/p>\n<p>The directors of the defunct Super Rugby club <a class=\"inline-link\" href=\"https:\/\/www.watoday.com.au\/national\/victoria\/melbourne-rebels-sue-rugby-australia-for-30-million-and-seek-return-of-club-20241008-p5kgo4.html\" rel=\"nofollow noopener\" target=\"_blank\">launched a damages claim<\/a> against Rugby Australia in 2024 seeking $30 million and accusing the governing body of abandoning the club and <a class=\"inline-link\" href=\"https:\/\/www.watoday.com.au\/sport\/rugby-union\/rugby-australia-refuses-to-commit-to-melbourne-rebels-future-20240124-p5ezr6.html\" rel=\"nofollow noopener\" target=\"_blank\">causing its directors allege Rugby Australia knowingly and unfairly <a class=\"inline-link\" href=\"https:\/\/www.watoday.com.au\/sport\/rugby-union\/melbourne-rebels-players-called-to-emergency-meeting-at-aami-park-20240530-p5jhul.html\" rel=\"nofollow noopener\" target=\"_blank\">underfunded the club<\/a> during the pandemic and this led to its financial troubles.<\/p>\n<p>They also allege Rugby Australia should not have stripped the club\u2019s licence to play in May 2024 after the group entered administration in January that year owing creditors $23 million, which included an $11.5 million debt to the Tax Office.<\/p>\n<p>The Rebels also claim Rugby Australia is responsible for the unpaid tax because it oversaw the payroll for the club and was responsible for any tax debts accrued when Rebels players were playing for Rugby Australia teams.<\/p>\n<p><a class=\"inline-link\" href=\"https:\/\/www.watoday.com.au\/sport\/rugby-union\/rebels-could-drop-rugby-australia-lawsuit-threat-if-it-backs-plan-to-save-club-20240520-p5jey0.html\" rel=\"nofollow noopener\" target=\"_blank\">The dispute<\/a> became particularly tense when the ATO said it would hold the Rebels\u2019 directors \u2013 which include top solicitor Georgia Widdup, senior silk Tim North, KC, and now-bankrupt club president <a class=\"inline-link\" href=\"https:\/\/www.watoday.com.au\/national\/victoria\/just-500-cash-75-million-in-debt-the-parlous-state-of-former-melbourne-rebels-boss-s-finances-20250930-p5myvm.html\" rel=\"nofollow noopener\" target=\"_blank\">Paul Docherty<\/a> and others \u2013 personally responsible for the massive tax debt.<\/p>\n<p>The case is set down for a three-week trial next month.<\/p>\n<p>Rugby Australia declined to comment on Thursday <a class=\"inline-link\" href=\"https:\/\/www.watoday.com.au\/sport\/rugby-union\/rugby-australia-to-counter-sue-melbourne-rebels-directors-20241010-p5khd9.html\" rel=\"nofollow noopener\" target=\"_blank\">but has maintained<\/a> throughout the case that it had provided the Rebels with adequate money to meet their costs and to cover their tax bill, and instead the money was allegedly misused by the club.<\/p>\n<p>The Rebels strongly reject these allegations.<\/p>\n<p>Rugby Australia had originally asked the court to order the Rebels team to pay $2.9 million into court, while the Rebels thought the payment should be limited to $1.65 million.<\/p>\n<p>Editor&#8217;s pick<a class=\"sc-d34e428-1 ioInpc\"\/><\/a><\/p>\n<p>The Rebels had argued that Rugby Australia\u2019s estimated legal costs were a \u201cRolls-Royce approach to litigation\u201d, including that each member of Rugby Australia\u2019s legal team would need $805 a night per person to stay in a hotel in Melbourne and $955 a person per flight between Sydney and Melbourne.<\/p>\n<p>The cost estimate also included assumptions for two leading senior counsels, who charge a combined daily rate of $56,000.<\/p>\n<p>In deciding to split the difference between the two legal cost estimates, Justice Cameron Moore said that describing the costs as Rolls-Royce might be going too far, \u201cbut I accept that the estimates are not modest\u201d.<\/p>\n<p>A spokesperson for the directors said: \u201cThe volunteer directors of the Melbourne Rebels never wanted to take legal action against Rugby Australia.
