Sean “Diddy” Combs’s legal team has urged a US federal appeals court to question if the four-year prison term for his conviction on prostitution-related charges<\/a> is too harsh.<\/p>\n

Violence, music, money, a meteoric rise and a faster fall. Sean ‘Diddy’ Combs had it all until his life and crimes brought him back to the boroughs of New York City for a sordid court case.<\/p>\n

Two hours of oral arguments regarding the hip hop mogul’s sentencing were heard on Thursday, local time, when the three-judge panel of the 2nd US Circuit Court of Appeals in Manhattan did not immediately rule.<\/p>\n

Combs’s trial last year exposed the sordid private life of one of the most influential figures in music and featured harrowing testimony of violence, drugs and sexual performances, or so-called “freak-offs”.<\/p>\n

He was convicted last July under the federal Mann Act, which bans transporting people across state lines for any sexual crime, but was acquitted of sex trafficking and racketeering charges that carried the potential for a life sentence.<\/p>\n

‘Exceptionally difficult case’ says Circuit Judge<\/p>\n

Throughout Thursday’s appeals court arguments, Circuit judges questioned whether Judge Arun Subramanian improperly considered elements of acquitted charges to sentence Combs to what his lawyer, Alexandra Shapiro, said was the most prison time ever given to someone convicted of the same charges with a similar criminal history.<\/p>\n

Assistant US attorney Christy Slavik, arguing for the government, challenged Mr Shapiro’s claim, saying the four-year, two-month prison term was below what federal sentencing guidelines called for and was in line with similar convictions in the Second Circuit.<\/p>\n

In sentencing, Judge Subramanian said Combs was “being sentenced for the offences of conviction, not the crimes he was acquitted of. However, under law, the court ‘shall consider’ the nature of the offence and characteristics of the defendant”.<\/p>\n

The judge also cited law which states that no limitation shall be placed on the “background, character and conduct” that a judge can consider.<\/p>\n

At the conclusion of the appeals arguments, Circuit Judge William J Nardini called it an “exceptionally difficult case” that raised questions of first impression “not only for this court but for any federal court in the country”.<\/p>\n

Mr Shapiro asked the appeals panel for a speedy decision.<\/p>\n

Comb’s lawyers want conviction reversed<\/p>\n

Combs, 56, is currently in federal prison in New Jersey and challenging his conviction and prison sentence.\u00a0<\/p>\n

His attorneys say the star’s conviction should be reversed, or he should at least be freed and re-sentenced to less time.<\/p>\n

Despite extensive written arguments on the subject, there was no discussion on Thursday about claims by Combs’s lawyers that his conviction should be reversed on grounds that the First Amendment protects sexual encounters between his girlfriends and male sex workers because they were sometimes filmed and amounted to “amateur pornography”.<\/p>\n

There was extensive discussion though, about his lawyers’ arguments that Judge Subramanian\u00a0wrongly considered evidence of fraud and coercion that they said the jury rejected as it exonerated him on the most serious charges.<\/p>\n

Combs has been behind bars since his September 2024 arrest, and is scheduled for release in April 2028.<\/p>\n
