{"id":608109,"date":"2026-04-15T08:58:11","date_gmt":"2026-04-15T08:58:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/608109\/"},"modified":"2026-04-15T08:58:11","modified_gmt":"2026-04-15T08:58:11","slug":"naacp-lawsuit-accuses-elon-musks-xai-of-polluting-black-neighborhoods-near-memphis-technology","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/608109\/","title":{"rendered":"NAACP lawsuit accuses Elon Musk\u2019s xAI of polluting Black neighborhoods near Memphis | Technology"},"content":{"rendered":"<p class=\"dcr-130mj7b\">A new lawsuit accuses Elon Musk\u2019s artificial intelligence company of illegally spewing toxic pollutants into the Black neighborhoods on the border of Tennessee and <a href=\"https:\/\/www.theguardian.com\/us-news\/mississippi\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Mississippi<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">The suit, filed on Tuesday in Mississippi federal court, alleges xAI is violating the Clean Air Act due to emissions from its makeshift power plant in Southaven, Mississippi, which powers its datacenters in south <a href=\"https:\/\/www.theguardian.com\/us-news\/memphis\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Memphis<\/a>. The NAACP, represented by environmental groups Southern Environmental Law Center and Earthjustice, says xAI has been polluting the surrounding historically Black communities by using dozens of methane gas generators without permits. The organization is seeking to force the company to stop operating its unpermitted turbines in Southaven.<\/p>\n<p class=\"dcr-130mj7b\">\u201cAll too often, big corporations like xAI treat our communities and families like obstacles to be pushed aside,\u201d said Derrick Johnson, the president and CEO of the NAACP.<\/p>\n<p class=\"dcr-130mj7b\">xAI\u2019s datacenters, nicknamed \u201c<a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/apr\/09\/elon-musk-xai-memphis\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Colossus<\/a>\u201d and \u201cColossus II\u201d by Musk, are massive facilities, with the latter occupying 1m sq ft in Memphis. They are located in Memphis\u2019s industrial zone and a few miles from residential neighborhoods that have long dealt with harmful pollution, including Boxtown, a neighborhood that was established by formerly enslaved people after emancipation in the 19th century.<\/p>\n<p class=\"dcr-130mj7b\">The lawsuit alleges xAI illegally installed and operated up to 27 gas turbines, each one the size of a large bus, to power the datacenters. Combined, they have the capacity to emit tons of harmful nitrogen oxides per year, along with toxic chemicals like formaldehyde, according to the Southern Environmental Law Center.<\/p>\n<p class=\"dcr-130mj7b\">xAI issued a statement in response to the lawsuit: \u201cWe take our commitment to the community and environment seriously. The temporary power generation units are operating in compliance with all applicable laws.\u201d The company did not respond to questions about whether it will address the alleged violations listed in the lawsuit.<\/p>\n<p class=\"dcr-130mj7b\">Black residents still make up a large portion of the Memphis neighborhoods, which have faced higher rates of asthma and respiratory diseases as well as a lower life expectancy than other parts of the city. Studies have likewise shown these neighborhoods have a cancer risk that is<a href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S1352231013006948\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\"> four times the national average<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWe cannot afford to normalize this kind of environmental injustice \u2013 where billion-dollar companies set up polluting operations in Black neighborhoods without any permits and think they\u2019ll get away with it because the people don\u2019t have the power to fight back,\u201d Johnson said. \u201cWe will not allow xAI to get away with this.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The NAACP is seeking injunctive relief, civil penalties and fees to cover the cost of litigation.<\/p>\n<p>Methane gas generators keep multiplying<\/p>\n<p class=\"dcr-130mj7b\">xAI first announced the construction of its first Colossus datacenter in Memphis in 2024. Shortly after, methane gas generators started to appear, though the Memphis generators are separate from the Mississippi turbines being challenged in court. By the time Musk said the facility was up and running, 122 days later, there were<a href=\"https:\/\/www.npr.org\/2024\/09\/11\/nx-s1-5088134\/elon-musk-ai-xai-supercomputer-memphis-pollution\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\"> at least 18 generators going<\/a>, per aerial photographs the law center took of the facility. By April this year, that number<a href=\"https:\/\/www.theguardian.com\/technology\/2025\/apr\/24\/elon-musk-xai-memphis\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\"> had nearly doubled<\/a>, photos showed.<\/p>\n<p class=\"dcr-130mj7b\">The rapid growth of xAI in Memphis and Southaven has seen fierce opposition from residents, despite support from Memphis\u2019s mayor, Paul Young, and the chamber of commerce. After xAI was awarded the permit, local environmental groups appealed the decision to the county\u2019s air pollution control board, saying the facility was in an \u201carea that has failed to meet EPA\u2019s air quality standard for ozone for years\u201d. They said the permit ignored the remaining unpermitted generators at the site.<\/p>\n<p class=\"dcr-130mj7b\">Community members, local politicians and environmental non-profits have held protests and public forums to speak out against the pollution they say xAI is generating.<\/p>\n<p class=\"dcr-130mj7b\">\u201cMayor Young and [Shelby county] Mayor Lee Harris need to do their jobs to protect our air and protect our lives,\u201d Justin Pearson, a Tennessee state representative from Memphis, said<a href=\"https:\/\/www.commercialappeal.com\/story\/money\/business\/development\/2025\/04\/25\/elon-musk-xai-in-memphis-gas-turbines-hearings\/83160326007\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\"> during a hearing in late April<\/a>. \u201cWe deserve clean air, and our lungs are not for sale to xAI or Elon Musk.\u201d<\/p>\n<p>Get in touch<\/p>\n<p>Contact us about this story<\/p>\n<p>The best public interest journalism relies on first-hand accounts from people in the know.
