Australia’s richest person, Gina Rinehart, has had a “clear win” in her mammoth legal battle over the ownership of lucrative iron ore mines, according to a prominent Perth resource industry commentator.<\/p>\n

Wednesday’s monumental legal showdown over mining tenements worth billions of dollars in Western Australia’s Pilbara region is the culmination of a complicated legal battle involving Ms Rinehart’s family spanning more than a decade.<\/p>\n

Here’s what you need to know about the Gina Rinehart court ruling<\/a><\/p>\n

Today’s blockbuster court ruling over mining tenements worth billions of dollars in WA’s iron ore rich Pilbara is the culmination of a complicated legal battle spanning more than a decade that has pitted family against family and siblings against each other.<\/p>\n

Justice Jennifer Smith dismissed all claims \u2014 including those of Mrs Rinehart’s children and WA mining pioneer Peter Wright’s descendants \u2014 to an ownership share in the Hope Downs iron ore operation, a joint venture between Mrs Rinehart’s Hancock Prospecting and multinational Rio Tinto.<\/p>\n

However, Ms Rinehart \u2014 whose net worth has been estimated at up to $30 billion in recent years \u2014 may have to pay out hundreds of millions of dollars in royalties.<\/p>\n

It was labelled in court as a “half-win, half-loss” to each of the parties.<\/p>\n

‘Clear win’ for Gina<\/p>\n

But resource industry commentator Tim Treadgold described the ruling as the “big daddy” of legal battles, and as a “clear win” for Hancock Prospecting.<\/p>\n

“The key to all this is ownership of the asset,” Mr Treadgold said.<\/p>\n

“The cash which has flowed in and out over a 20-year period is neither here nor there.<\/p>\n

“I think it’s a quite clear-cut win to Rinehart and Hancock. I would have given it 90 per cent Reinhart, 10 per cent Wright.”<\/p>\n

It was an assertion Hancock Prospecting (HPPL) executive director Jay Newby backed in a statement released minutes after the judgement was published, which stressed the value of ownership.<\/p>\n

Split decision as Gina Rinehart, Wright family both claim legal wins<\/a><\/p>\n

Gina Rinehart is dealt a blow, with a court finding the family of her father’s former business partner has the right to potentially hundreds of millions of dollars in royalties from lucrative Pilbara mining assets.<\/p>\n

Justice Smith found both Ms Rinehart’s Hancock Prospecting and Rio Tinto were jointly liable for the royalties payments on all current and future mines within the Hope Downs complex to Mr Wright’s family company, Wright Prospecting.<\/p>\n

This issue, Mr Newby said, was “far less significant”, estimating historical royalty payments to Wright Prospecting of around $14 million annually.<\/p>\n

Additionally, Justice Smith gave mining and earthmoving company DFD Rhodes, formed by Lang Hancock associate Don Rhodes, the right to 1.25 per cent of royalties on half of the mines.<\/p>\n

Twenty years of missing royalties<\/p>\n

Hancock Prospecting estimates these will equate to $4 million per annum in years gone by.<\/p>\n

But Mr Treadgold believed past royalties that could be paid by Ms Reinhart’s company to Wright Prospecting could total as much as $1 billion.<\/p>\n

“My calculation, the best guess, she would have to pay the Wrights about $US750 million for missing 20 years of royalties,” he said.<\/p>\n

“You can work out the missing royalties by looking at Hope Downs producing 30 million tonnes of iron ore a year, at a price over the 20 years of operation of about $US100 [per tonne].<\/p>\n

“So, it generates about $US3 billion annually, and Rio Tinto pays a royalty on that of 2.5 per cent, if it was all to the Wrights.<\/p>\n

“Rio Tinto owns half of it, so you need to do a lot of halving and adding and taking away, but basically, it’s the $US3 billion in annual revenue, one and a half [per cent] to Reinhart, and the royalty, which is now going to be shared with the Wright family.”<\/p>\n

Wright Prospecting, for its part, welcomed the court’s ruling on royalties.<\/p>\n

“These proceedings were commenced in 2010 and, after many delays, we are pleased to finally receive a result in our favour,” a spokesperson said.<\/p>\n

“The decision is lengthy and complex. We will review it in detail before determining if any further steps need to be taken.”<\/p>\n

‘She can afford it’<\/p>\n

According to Mr Treadgold, the cost of past and future royalty payments would be buffered by other assets in Hancock Prospecting’s portfolio.<\/p>\n

“They can definitely afford it \u2026 it used to be the most important asset, but the biggest asset now is the Roy Hill mine, and there are other assets in the group which are also extremely valuable,” he said.<\/p>\n

“She’s got rare earth assets, she’s got lithium, she has got oil and gas, so she’s got a very, very big business; this is a minor pain.<\/p>\n

“Without exaggerating, it really is petty cash.”\"A<\/p>\n

Another court hearing has been set for next week to determine the payment of legal costs, which were also expected to be large.<\/p>\n

Justice Smith suggested one potential resolution would be for Hancock Prospecting and Wright Prospecting to cancel out each other’s costs.<\/p>\n
