A former Darwin school teacher who struck a female student in the face, causing her to fall against a table and break her teeth, has been sentenced to four years in jail, suspended after three months.<\/p>\n

Darroch Robinson, 56, was earlier this week found guilty in the Northern Territory Supreme Court of unlawfully causing serious harm during the classroom incident in March 2024.<\/p>\n

The court heard Robinson had earlier confiscated the Darwin Middle School student’s phone, before she demanded it back and called him “a dumb c***” or “a stupid c***”.<\/p>\n

During sentencing on Friday, Chief Justice Michael Grant found Robinson had been “subjected to a degree of provocation over a relatively extended period”.<\/p>\n

Robinson’s defence lawyer said he had “made an outstanding contribution to the wider community” before the incident. (ABC News: Roxanne Fitzgerald)<\/p>\n

“That provocation culminated in the frank abuse by the victim \u2026 those circumstances have some mitigating effect,” he said.<\/p>\n

“However, even allowing for all of those contextual considerations, your conduct constituted a gross breach of the trust between student and teacher and the trust which society reposes in teachers.<\/p>\n

“No level of verbal abuse or taunt could justify your conduct on this occasion.”<\/p>\n

Chief Justice Grant said Robinson experienced “a momentary loss of control and lashed out without intending to inflict any significant or long-standing injury on the victim”.<\/p>\n

Despite the lack of intent to cause injury, Chief Justice Grant said the strike had “a quite devastating impact” on the girl, with her two fractured teeth causing ongoing pain and requiring continued intervention from dentists.<\/p>\n

“The jury’s verdict makes it plain that at the very least you saw the possibility of serious harm resulting in the sense that you knew or realised there would be a risk,” he said.<\/p>\n

“You took that risk in circumstances where a reasonable person would not have done so.”<\/p>\n

‘Top level of good character’<\/p>\n

Defence lawyer Peter Maley said Robinson took responsibility after the incident by reporting it the school principal and had offered to plead guilty to a lesser charge.<\/p>\n

Mr Maley argued Robinson should be spared prison time and if he was to be jailed, it should be “short and sharp so that he can return to the community and his family”.<\/p>\n

“You’ve got a man here who has made an outstanding contribution to the wider community, served his country [in the military], retrained as a teacher,” he said.<\/p>\n

“He has outstanding references, I would really put him in the green, top level of good character.”<\/p>\n
