Many were victims of a sophisticated bank impersonation scam, where criminals imitated HSBC bank employees and sent text messages that appeared to come from HSBC.<\/p>\n<p>The bank has consistently denied it did anything wrong, instead often presenting scam victims with the findings of \u201cfraud investigations\u201d that, rather than investigating the crime, <a class=\"inline-link\" href=\"https:\/\/www.theage.com.au\/national\/scammers-stole-almost-50-000-from-katrina-her-bank-offered-her-goodwill-instead-of-getting-it-back-20250826-p5mq0o.html\" rel=\"nofollow noopener\" target=\"_blank\">outlined why the customer was solely to blame for the losses.<\/a><\/p>\n<p>This week, less than two months before the scheduled trial date, HSBC said it would no longer defend the case brought by the Australian Securities and Investments Commission. The 12-day trial planned for mid-June has been cancelled, and replaced by a one-day hearing the same month.<\/p>\n<\/p>\n<p>On Wednesday, the regulator and bank wouldn\u2019t comment on any proposed settlement. However, scam victims and advocates said they hoped the penalty for HSBC would send a clear message to the industry \u201cto lift their game\u201d.<\/p>\n<p>They called for full financial compensation for HSBC scam victims (including those they say were previously pressured into accepting \u201clow-ball\u201d settlements), recompense for the bank\u2019s combative approach with customers, and a significant further penalty.<\/p>\n<p>\u201cIt was quite extraordinarily awful behaviour by HSBC,\u201d said Stephanie Tonkin, chief executive of the Consumer Action Law Centre.<\/p>\n<p>\u201cWe routinely see \u2026 big businesses telling individual scam victims who\u2019ve lost everything that it\u2019s their fault, and that there\u2019s nothing that the business should or could have done.<\/p>\n<p>\u201cWe know from this HSBC case there\u2019s a long list of routine things they could have implemented to protect their customers.\u201d<\/p>\n<p><img decoding=\"async\" alt=\"Stephanie Tonkin, from the Consumer Action Law Centre, has been scathing of HSBC\u2019s handling of scam cases.\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/04\/8ea8bd5902403e94b91037c98008283718215bff.jpeg\"  class=\"sc-d34e428-1 ldCIuB\"\/>Stephanie Tonkin, from the Consumer Action Law Centre, has been scathing of HSBC\u2019s handling of scam cases.Max Mason-Hubers<\/p>\n<p><a class=\"inline-link\" href=\"https:\/\/www.theage.com.au\/national\/not-a-single-care-victims-of-hsbc-fraud-say-bank-could-have-stopped-the-scammers-20240716-p5ju22.html\" rel=\"noopener noreferrer nofollow\" target=\"_blank\">An investigation by this masthead<\/a> into HSBC\u2019s handling of a long-running impersonation scam found that the bank had failed to pick up red flags of fraud, including overseas logins made on accounts mere minutes after the customer had logged in from Melbourne and other Australian cities.<\/p>\n<p>Court documents since filed by ASIC indicate that HSBC knew its customers were being scammed because of the bank\u2019s own security shortcomings.<\/p>\n<p>They show that, in January 2022, a meeting of an HSBC fraud steering committee was told losses from scam cases \u201cwould likely have been avoided with BioCatch\/Threatmetrix implementation for transactional monitoring\u201d.<\/p>\n<p>More than a year after this internal warning, HSBC customer <a class=\"inline-link\" href=\"https:\/\/www.theage.com.au\/national\/scammers-stole-almost-50-000-from-katrina-her-bank-offered-her-goodwill-instead-of-getting-it-back-20250826-p5mq0o.html\" rel=\"nofollow noopener\" target=\"_blank\">Katrina Qian<\/a> lost almost $50,000 to scammers. Qian was still learning how to speak English and was spooked by the scammer who called her pretending to be a government official.<\/p>\n<\/p>\n<p>No alarm bells were raised at the bank when the criminals who targeted her were able to exchange tens of thousands of dollars of Qian\u2019s money into British pounds, and then send that money to an overseas recipient.<\/p>\n<p>Qian is still $37,500 out of pocket.
