Kyle Sandilands and Jackie “O” Henderson are being sued in a counter claim by the media company that broadcast their popular radio show, claiming the breakdown of the hosts’ partnership posed a serious threat to its financial survival.<\/p>\n

ARN Media’s The Kyle and Jackie O Show came to an abrupt end in February, when an on-air dispute led to Henderson refusing to work with her co-host of more than 20 years.<\/p>\n

The premature ending of the show \u2014 whose stars were set to earn a combined $200 million over 10 years \u2014 led to Sandilands and Henderson independently launching Federal Court action against their former employer, ARN Media subsidiary Commonwealth Broadcasting Corporation (CBC).<\/p>\n

CBC has fought back ahead of a hearing on Friday, launching a counter claim against the duo seeking damages for breach of contract, losses in profit and advertising revenue, and legal costs.<\/p>\n

The company’s lawyers claimed the relationship breakdown between the hosts threatened to undermine its profitability, court documents revealed.<\/p>\n

Letter from Henderson’s lawyers significant to case<\/p>\n

A key part of the CBC’s defence is a letter it received from Henderson’s lawyers about a week after the on-air dispute that ultimately led to the hit show’s cancellation.<\/p>\n

It stated the CBC was “well aware” of Sandilands’s bullying, and that a review of its records would provide examples.<\/p>\n

“Our client [Henderson] has other examples and audio (both on air and off air) to support a claim of repeated and constant workplace bullying that she has endured at the hands of Mr Sandilands as well as numerous witnesses to the behaviour within the workplace,” it read.\u00a0<\/p>\n

“The mere fact that this behaviour is frequent and has been continuing for a prolonged period of time also goes to demonstrate that the Group has not taken the required action to act in compliance with its obligations to provide a safe place of work.”<\/p>\n

Henderson’s lawyers said she was left “psychologically unwell” from the “ongoing bullying”, some of which was widely reported by media.<\/p>\n

It reportedly stated she “cannot continue to work with Mr Sandilands”, and “direct contact with Mr Sandilands is now untenable”.<\/p>\n

It also said she would continue to honour her contract as a presenter, but her return would not be possible until “a suitable alternate day part is found”.<\/p>\n

Henderson’s lawyers said involving the state’s workplace regulator would result in a ruling against the CBC.<\/p>\n

“Should a report be made to SafeWork NSW, it is now highly likely that the Group will be found to have breached its duty of care to Ms Henderson by exposing her to Mr Sandilands’ bullying conduct over a prolonged period,” they said.<\/p>\n

Examples of alleged repeated bullying<\/p>\n

In court documents, the CBC’s lawyers said they would argue Sandilands repeatedly denigrated people he worked with on air, from censors to executives, and provided multiple alleged examples dating back to last year.<\/p>\n

One example was from a broadcast dated February 11, 2025.<\/p>\n

“Don’t go bleeping this shit out or you censors will have no job.<\/p>\n

“Let me explain one more time the bosses have no control whatsoever over what we do on this show. Zero. None. Jackie and I \u2026 it starts and ends with what we want to do.<\/p>\n

“I put my BLEEEP fellas and ladies. We’re contracted to do whatever we want to do. And if you don’t like it, too bad. There’s no one sneaking around in the background fixing shit, cos there’s nothing to fix.<\/p>\n

“I don’t give a shit [about shareholders]. I got my money. End of caring.”<\/p>\n

CBC lawyers said Sandilands was told to comply with four ARN safe work and code of conduct policies in December 2025.<\/p>\n

He had rejected allegations by ARN Media his behaviour met the threshold of serious misconduct, claiming he was wrongfully sacked and eager to return to work.<\/p>\n

“Everyone says things from time to time, especially with people that you’re close with and it’s unfortunate it worked out that way,” he said in late March.<\/p>\n

“[Henderson] understands, we’ve had blow ups before. Her on me, me on her. We just get over it usually.<\/p>\n

“I think this has all turned into quite a circus.”<\/p>\n
