{"id":63975,"date":"2025-08-13T02:07:10","date_gmt":"2025-08-13T02:07:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/63975\/"},"modified":"2025-08-13T02:07:10","modified_gmt":"2025-08-13T02:07:10","slug":"new-nauru-deal-another-chapter-of-australias-shameful-history","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/63975\/","title":{"rendered":"New Nauru deal another chapter of Australia&#8217;s shameful history"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Australia\u2019s detention camps in Nauru have been plagued by public scandals, including repeated <a href=\"https:\/\/www.theguardian.com\/australia-news\/2023\/may\/25\/morrison-government-paid-corrupt-businessman-millions-for-offshore-processing-on-nauru\" rel=\"nofollow noopener\" target=\"_blank\">reports of corruption<\/a> and last week\u2019s revelation that multimillion-dollar government security contracts had been awarded to the controversial <a href=\"https:\/\/www.theage.com.au\/national\/leader-of-australian-bikie-gang-strikes-deal-to-provide-security-on-nauru-20250805-p5mkez.html\" rel=\"nofollow noopener\" target=\"_blank\">Safe Hands Group<\/a>.\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">But we have also just quietly marked the latest entry in two interrelated and much longer chapters of Australian history: the first concerning the ongoing <a href=\"https:\/\/www.abc.net.au\/news\/2024-11-12\/high-court-patrols-governments-power-to-punish-after-nzyq-case\/104587642\" rel=\"nofollow noopener\" target=\"_blank\">collective punishment<\/a> of migrants and refugees subject to indefinite immigration detention, and the second being our government\u2019s reliance on neo-colonial relationships in the Pacific to launder domestic political problems.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Last week, the <a href=\"https:\/\/www.abc.net.au\/news\/2025-08-06\/un-urges-australian-government-to-halt-nauru-deportation\/105614816\" rel=\"nofollow noopener\" target=\"_blank\">UN Human Rights Committee made interim orders<\/a> preventing the Australian government from deporting a 65-year-old Iraqi refugee to Nauru to live out the rest of his life on the small island nation.\u00a0\u00a0<\/p>\n<p>\n\t\tRelated Article Block Placeholder<\/p>\n<p>\t\t\tArticle ID: 1172124\n\t<\/p>\n<p>\t\t\t\t\t\t<a href=\"https:\/\/www.crikey.com.au\/2024\/08\/28\/pacific-islands-security-china-climate-change\/\" class=\"\" target=\"_self\" title=\"\" rel=\"nofollow noopener\"><br \/>\n\t\t\t\t<img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"162\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/08\/penny.jpg\" class=\"aspect-video object-cover h-auto w-[141px] md:w-[216px]\" alt=\"Climate action is crucial to Australia\u2019s standing in the Pacific\"  \/>\t\t\t<\/a><\/p>\n<p class=\"wp-block-paragraph\">The man at the centre of the UN complaint, who is represented by the <a href=\"https:\/\/www.hrlc.org.au\/news\/legal-action-launched-for-person-facing-deportation\/\" rel=\"nofollow noopener\" target=\"_blank\">Human Rights Law Centre<\/a>, is one of three selected \u2014 seemingly at random \u2014 by the Albanese government to test its expansive new \u201c<a href=\"https:\/\/www.hrlc.org.au\/explainers\/2024-11-8-deportation-surveillance\/\" rel=\"nofollow noopener\" target=\"_blank\">third-country removal\u201d powers<\/a>. <\/p>\n<p>All three men were released from immigration detention following the <a href=\"https:\/\/www.hrlc.org.au\/explainers\/2023-11-29-explainer-high-court-ruling-in-nzyq\/\" rel=\"nofollow noopener\" target=\"_blank\">High Court\u2019s ruling<\/a> in November 2023 that indefinite detention is unlawful. They were granted Bridging R Visas, subject to conditions that the <a href=\"https:\/\/www.hrlc.org.au\/explainers\/2024-11-6-ybfz-high-court\/\" rel=\"nofollow noopener\" target=\"_blank\">High Court found<\/a> in November last year to be unlawfully punitive \u2014 including a 10pm to 6am curfew condition and the wearing of an ankle bracelet. Their removal to Nauru is the government\u2019s third attempt at subjecting them to lifelong punishment.\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The third-country removal powers were rushed through parliament in the final sitting week of 2024 after the Coalition and media had hounded Labor for months over its handling of immigration detention. The powers allow the Australian government to enter into a paid arrangement with any other country in the world to receive people who Australia wishes to deport, irrespective of the conditions they might face in the other country, or even whether they might be detained there. In effect, these powers extend Australia\u2019s darkly innovative \u201coffshore detention\u201d policies across the globe.\u00a0\u00a0<\/p>\n<p>\tIndependent. Irreverent. Sign up to Crikey\u2019s free newsletters for fearless reporting, sharp analysis, and a touch of chaos                        <\/p>\n<p>By continuing, you agree to our\u00a0<a href=\"https:\/\/www.crikey.com.au\/terms-conditions\/\" target=\"_blank\" rel=\"noopener nofollow\">Terms &amp; Conditions<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.crikey.com.au\/privacy-policy\/\" target=\"_blank\" rel=\"noopener nofollow\">Privacy Policy<\/a>.<\/p>\n<p class=\"wp-block-paragraph\">In September 2024, before the new laws were introduced to parliament, the Albanese government began discussions with the government of Nauru on a <a href=\"https:\/\/www.refugeecouncil.org.au\/refugee-council-alarmed-by-australias-new-deal-to-exile-people-to-nauru\/#:~:text=Under%20its%20latest%20deal%20with,detain%20non%2Dcitizens%20with%20no\" rel=\"nofollow noopener\" target=\"_blank\">30-year deal to receive people from Australia<\/a>. An agreement regarding an <a href=\"https:\/\/theconversation.com\/australia-is-deporting-3-non-citizens-from-the-nzyq-group-to-nauru-what-could-it-do-instead-250053\" rel=\"nofollow noopener\" target=\"_blank\">initial three people<\/a> was formally reached in early 2025. While Australia had requested those people be granted \u201cindefinite stay visas\u201d, Nauru granted them visas valid for 30 years. It is unclear what will happen after that 30-year period.\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Importantly, there is no right of family reunification or <a href=\"https:\/\/www.hrlc.org.au\/explainers\/2024-11-8-deportation-surveillance\/\" rel=\"nofollow noopener\" target=\"_blank\">pathway to citizenship<\/a>. No serious assessment was conducted by the Albanese government of the dangers that refugees might face during their lifetime stay in Nauru, either when making the agreement or applying for their visas.\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The initial agreement, as detailed in a <a href=\"https:\/\/jade.io\/article\/1134883?at.hl=TCXM\" rel=\"nofollow noopener\" target=\"_blank\">recent court judgment<\/a>, includes a list of rights that will purportedly be protected, without any details as to how. Such promises are on par with previous assurances that refugees in detention camps would be treated <a href=\"https:\/\/www.unsw.edu.au\/kaldor-centre\/our-research\/offshore-processing\/bilateral-agreements\" rel=\"nofollow noopener\" target=\"_blank\">in accordance with human rights standards<\/a>, which have been contradicted by 24 years of <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/01\/australia-responsible-arbitrary-detention-asylum-seekers-offshore-facilities\" rel=\"nofollow noopener\" target=\"_blank\">brutal experience<\/a>.\u00a0\u00a0\u00a0<\/p>\n<p>\n\t\tRelated Article Block Placeholder<\/p>\n<p>\t\t\tArticle ID: 1185360\n\t<\/p>\n<p>\t\t\t\t\t\t<a href=\"https:\/\/www.crikey.com.au\/2024\/11\/28\/labor-wants-immigration-detention-phone-ban-opposed-coalition-plan\/\" class=\"\" target=\"_self\" title=\"\" rel=\"nofollow noopener\"><br \/>\n\t\t\t\t<img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"162\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/08\/20240820111928779107-original-2.jpg\" class=\"aspect-video object-cover h-auto w-[141px] md:w-[216px]\" alt=\"Labor voted against the Libs\u2019 immigration detention phone ban twice. Now it\u2019s pitching a very similar proposal\"  \/>\t\t\t<\/a><\/p>\n<p class=\"wp-block-paragraph\">The deal was <a href=\"https:\/\/www.facebook.com\/watch\/?mibextid=WC7FNe&amp;v=484804698020986&amp;rdid=K0WiabjkjTmuNACE\" rel=\"nofollow noopener\" target=\"_blank\">controversial among the Nauruan public<\/a>. But as unpopular as the arrangements may have been, the reality is that Nauru is reliant on the revenue to fund <a href=\"https:\/\/www.sprep.org\/news\/rebuilding-nauru-the-island-nations-ambitious-climate-change-adaptation-plan\" rel=\"nofollow noopener\" target=\"_blank\">urgent climate adaptation measures<\/a> and secure the future of the island.\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Australia has a long colonial entanglement with Nauru, having previously administered the island as a <a href=\"https:\/\/www.austlii.edu.au\/cgi-bin\/viewdoc\/au\/journals\/UTSLRS\/2017\/27.html\" rel=\"nofollow noopener\" target=\"_blank\">protectorate after WWI<\/a> and overseen the strip-mining and near exhaustion of its natural resources. The resulting reliance on Australian aid provided fertile ground for the establishment of offshore detention camps in 2001.\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">Now, as sea levels rise, <a href=\"https:\/\/www.theguardian.com\/world\/2025\/feb\/26\/nauru-climate-citizenship-golden-passport\" rel=\"nofollow noopener\" target=\"_blank\">Nauru looks to a future where 90% of its mostly coastal population<\/a> is relocated to a small area of several kilometres in high-lying regions of the country. Australia, one of the <a href=\"https:\/\/earth.org\/australias-fossil-fuel-exports-ranked-2nd-for-climate-footprint-globally-report-finds\/#:~:text=Without%20fossil%20fuel%20exports%2C%20the,total%20to%2045%20billion%20tonnes.\" rel=\"nofollow noopener\" target=\"_blank\">highest per-capita<\/a> greenhouse gas emitters and fossil fuel exporters in the world, is poised to deepen the social impacts of the climate crisis by expanding its offshore warehousing operations, with equal contempt for the migrants and refugees impacted and the people of the Pacific.\u00a0\u00a0<\/p>\n<p class=\"wp-block-paragraph\">The fight against the new third-country removal powers is about more than just three men. It is about putting a limit on our government\u2019s ability to punish migrants and refugees, and to exploit the people of our neighbouring nations who are faced with climate collapse. While the UN\u2019s intervention might halt these deportations for now, it is up to all of us to collectively determine where we draw that line, and the type of society we are prepared to become.\u00a0<\/p>\n<p>\tShould the government stop making Australia\u2019s refugees other countries\u2019 problem?<\/p>\n<p>We want to hear from you.
