{"id":662720,"date":"2026-05-10T23:23:10","date_gmt":"2026-05-10T23:23:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/662720\/"},"modified":"2026-05-10T23:23:10","modified_gmt":"2026-05-10T23:23:10","slug":"nsw-health-agency-to-pay-50k-in-damages-to-worker-in-disability-discrimination-case","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/662720\/","title":{"rendered":"NSW Health agency to pay $50k in damages to worker in disability discrimination case"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">An admin officer has been awarded more than $50,000 in compensation after a tribunal found a NSW Health agency discriminated against her due to her disability.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Soneva Donald-Stanton has no function in one of her hands and limited mobility in her neck due to a musculoskeletal condition called Klippel Feil syndrome.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She had worked in administration for more than 14 years and said her condition had never interfered with her ability to perform her role.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But Ms Donald-Stanton said she became concerned about the way she was being treated by management several months after she started working at Western Sydney Local Health District&#8217;s (WSLHD) Aboriginal Health Strategy department in December 2021.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Despite not requesting any assistance or modifications, she said she was referred for a workstation assessment and medical check after her manager raised concerns about her physical limitations and questioned her ability to complete office tasks.<\/p>\n<p><img decoding=\"async\" alt=\"Soneva sits on a brightly-coloured chair and holds her knee while posing for a photo.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/05\/fd84a34ab7dd4ee1ab7d63fbf5c9073c.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Ms Donald-Stanton did not request any assistance, but was still referred for a medical check. (ABC News: Michael Donnelly)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Donald-Stanton said the medical assessment was &#8220;very intrusive&#8221;, lasted four hours and left her feeling &#8220;violated&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It included a physical examination, it included me giving a lot of personal health information, it involved a cognitive test which I found extremely insulting,&#8221; she said.<\/p>\n<p>&#8220;It was just an all-round awful experience.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">The practitioner who conducted the assessment found Ms Donald-Stanton could only continue in her role if her workplace could accommodate a number of conditions.<\/p>\n<p class=\"paragraph_paragraph___QITb\">These included modifications to her commute to the office and restrictions on colleagues talking to Ms Donald-Stanton about her disability, conditions which Ms Donald-Stanton was told could not be met.<\/p>\n<p class=\"paragraph_paragraph___QITb\">She was subsequently declared unfit for work and placed on leave.<\/p>\n<p>Apology, compensation ordered<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Donald-Stanton went on to pursue legal action against her employer, with the Civil and Administrative Tribunal in April finding she had been discriminated against.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In a statement to the tribunal, Ms Donald-Stanton&#8217;s manager said she had been &#8220;concerned that there was more [the workplace] could be doing&#8221; to support the admin worker.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The manager said she was worried &#8220;without additional supports [WSLHD] may be exposing [Ms Donald-Stanton] to risks to her health and safety&#8221;.<\/p>\n<p><img decoding=\"async\" alt=\"A female doctor writing in a note pad, with a stethoscope on the table.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/05\/76ad538443771e6f831dc19043add827.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Ms Donald-Stanton says the medical assessment was intrusive. (Unsplash: Frederick Medina)<\/p>\n<p class=\"paragraph_paragraph___QITb\">But the tribunal found her manager failed to identify why she thought Ms Donald-Stanton&#8217;s health and safety was at risk at work.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It was only because [her manager] observed that [Ms Donald-Stanton] had a physical limitation in her hand and in turning her head that she initiated the course of less favourable treatment,&#8221; the tribunal found.<\/p>\n<p>&#8220;[Ms Donald-Stanton&#8217;s] disabilities clearly played a part in [her employer] treating her less favourably than the comparator in being deemed unfit for work and directed to take leave.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">WSLHD was ordered to apologise to Ms Donald-Stanton and provide all managers with disability discrimination training.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The tribunal found Ms Donald-Stanton should receive $55,000 in damages for the &#8220;hurt, humiliation and injury to feelings&#8221; she suffered in the workplace.<\/p>\n<p class=\"paragraph_paragraph___QITb\">A WSLHD spokesperson said the agency was reviewing the tribunal findings.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Western Sydney Local Health District is committed to providing a safe workplace and treating all employees with respect and fairness,&#8221; the spokesperson said in a statement.<\/p>\n<p>&#8216;I wasn&#8217;t weak&#8217;<img decoding=\"async\" alt=\"Soneva has glasses and long brown hair and poses for a photo near a display cabinet.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/05\/88a1e4ac1bb51d30e5f1e34dd4a1c2e5.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Ms Donald-Stanton says the decision is important for the disability community.
