The arguments don\u2019t hold up | Genevieve Smith"},"content":{"rendered":"<p class=\"dcr-130mj7b\">This April, the US Department of Justice joined <a href=\"https:\/\/www.theguardian.com\/technology\/elon-musk\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Elon Musk<\/a>\u2019s xAI <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-intervenes-xai-lawsuit-challenging-colorados-algorithmic-discrimination\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">in<\/a> <a href=\"https:\/\/www.justice.gov\/crt\/media\/1437846\/dl\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">suing<\/a> the state of Colorado to kill its AI anti-discrimination law.<\/p>\n<p class=\"dcr-130mj7b\">When the federal government sides with a billionaire against a state trying to protect its residents from AI discrimination, that\u2019s not only a <a href=\"https:\/\/www.theguardian.com\/us-news\/colorado\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Colorado<\/a> story. That\u2019s everyone\u2019s story.<\/p>\n<p class=\"dcr-130mj7b\">The justice department\u2019s lawsuit is part of a coordinated federal effort to reframe AI consumer protections as ideological overreach. In July 2025, <a href=\"https:\/\/www.theguardian.com\/us-news\/donaldtrump\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump<\/a> signed an executive order on \u201c<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/07\/28\/2025-14217\/preventing-woke-ai-in-the-federal-government\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">preventing woke AI<\/a>\u201d, equating bias mitigation measures to a leftist \u201cwoke\u201d agenda that suppresses free speech and truth. The federal <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2026\/03\/03.20.26-National-Policy-Framework-for-Artificial-Intelligence-Legislative-Recommendations.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">National Policy Framework<\/a> launched in March included a push to pre-empt state laws on AI, with Colorado\u2019s law targeted. The justice department\u2019s intervention in Colorado marks the first time the federal government has sought to intervene in a lawsuit challenging a state AI law.<\/p>\n<p class=\"dcr-130mj7b\">The <a href=\"https:\/\/leg.colorado.gov\/bills\/sb24-205\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">AI bill in reference<\/a>, Senate Bill 205, was about protecting people from discrimination in high-risk AI systems making consequential decisions: who gets hired, who gets housing, who receives healthcare.<\/p>\n<p class=\"dcr-130mj7b\">The original bill required bias audits, impact assessments and disclosure, requirements that drew pushback from the business community. Colorado heard that and responded. Before xAI ever filed its lawsuit, the state <a href=\"https:\/\/governorsoffice.colorado.gov\/governor\/news\/colorado-artificial-intelligence-policy-workgroup-delivers-unanimous-support-revised-policy\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">revised<\/a> those requirements with a reduced transparency framework in mid-March.<\/p>\n<p class=\"dcr-130mj7b\">This kind of bill matters. A <a href=\"https:\/\/www.science.org\/doi\/10.1126\/science.aax2342\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">2019 study<\/a> published in Science found that a widely used healthcare algorithm deployed across US hospitals assigned Black patients half the care of equally sick white patients because it used healthcare costs as a proxy for health needs, embedding existing inequities into clinical decisions. Removing healthcare costs eliminated racial bias in the model and helped hospitals deliver more effective care.<\/p>\n<p class=\"dcr-130mj7b\">But <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cod.253513\/gov.uscourts.cod.253513.1.0.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">xAI argued the Colorado bill<\/a> would force the company to promote the state\u2019s \u201cideological views on various matters, racial justice in particular\u201d, in its Grok chatbot. Brianna Titone, a Colorado state representative and one of the bill\u2019s lead sponsors, disagrees. She <a href=\"https:\/\/coloradosun.com\/2026\/04\/10\/elon-musk-colorado-ai-law-federal-court-lawsuit\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">captured<\/a> the misleading nature of xAI\u2019s lawsuit: \u201cSB 205 is about consequential decisions \u2026 We\u2019re not restricting speech. Our bill does not say that Grok still can\u2019t be a dick.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The justice department, meanwhile, called the bill \u201c<a href=\"https:\/\/www.justice.gov\/crt\/media\/1437846\/dl\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">state-mandated discrimination<\/a>\u201d that \u201cobligates AI developers and deployers to discriminate\u201d, an extraordinary characterization of a law that requires companies to check whether their systems are producing unlawfully discriminatory outcomes and fix them if so.<\/p>\n<p class=\"dcr-130mj7b\">The justice department\u2019s\u2019s argument rested on the false assumption that AI systems use \u201cneutral criteria\u201d. Under this logic, altering models that use neutral criteria messes with their objectivity, constituting discrimination. But as the hospital study shows, criteria that appear neutral can produce worse outcomes for some populations. This trend of poor proxies harming marginalized groups has been shown in various studies, such as for <a href=\"https:\/\/www.scientificamerican.com\/article\/algorithms-designed-to-fight-poverty-can-actually-make-it-worse\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">welfare allocation<\/a> and <a href=\"https:\/\/www.aeaweb.org\/articles?id=10.1257\/pandp.20181018\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">college admissions<\/a>. Bias also enters when models have less training data on some groups, causing worse performance for those populations \u2013 as documented in <a href=\"https:\/\/proceedings.mlr.press\/v81\/buolamwini18a?\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">facial recognition research<\/a> and my own research on <a href=\"https:\/\/aclanthology.org\/2024.emnlp-main.750\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">large language models<\/a>. When companies improved representation in their training data, performance discrepancies nearly disappeared.<\/p>\n<p class=\"dcr-130mj7b\">Then there\u2019s the \u201cwinning the AI race\u201d framing, reflected in the justice department lawsuit. The race technologists talk about and that the US government refers to is the <a href=\"https:\/\/time.com\/7339638\/eric-schmidt-ai\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">pursuit of artificial general intelligence<\/a> and <a href=\"https:\/\/www.youtube.com\/shorts\/0Ii0N1xVcYg\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">beating China<\/a> \u2013 a frontier dominated by a handful of well-capitalized corporate labs. Rules barring AI from discriminating in hiring and healthcare are separate from that race. Conflating the two is misleading.<\/p>\n<p class=\"dcr-130mj7b\">The only mainstream national outlet to cover this story thus far, <a href=\"https:\/\/www.wsj.com\/business\/entrepreneurs-flocked-to-colorado-now-red-tape-is-driving-some-away-b1324242\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">the Wall Street Journal<\/a>, focused on effects the law could have on businesses and \u201ckilling the entrepreneurial spirit\u201d, a sentiment echoed in the justice department lawsuit. That argument doesn\u2019t hold up, either. No companies are cited as leaving Colorado because of this regulation. The state\u2019s governor, Jared Polis, states that \u201cfar more\u201d firms are moving to Colorado than leaving. The one concrete example offered in the Journal: Palantir cited the bill as a possible burden in a Securities and Exchange Commission (SEC) <a href=\"https:\/\/investors.palantir.com\/files\/2025%20FY%20PLTR%2010-K.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">filing<\/a>. But the company <a href=\"https:\/\/www.denver7.com\/news\/local-news\/palantir-colorados-largest-public-company-leaving-for-florida\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">did not say<\/a> this was the reason it left Colorado for Florida. On the opposite end of the spectrum, companies including Microsoft <a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/789019\/000095017024087843\/msft-20240630.htm\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">have flagged bias and discrimination in AI<\/a> as a material risk.<\/p>\n<p class=\"dcr-130mj7b\">Small businesses have legitimate concerns, to which the state responded. Still, using AI to make consequential decisions about who gets hired or receives healthcare is a choice. If a business wants to develop or use AI in hiring or healthcare but doesn\u2019t have the bandwidth to check whether it discriminates, then they don\u2019t have the bandwidth to use it responsibly. It\u2019s worth noting: AI tools that don\u2019t work for everyone deliver worse outcomes, create liability and erode trust. The healthcare algorithm that was fixed didn\u2019t sacrifice efficiency; it got better at its job.<\/p>\n<p class=\"dcr-130mj7b\">But the pressure campaign worked. On 14 May, Polis <a href=\"https:\/\/tsscolorado.com\/polis-immediately-signs-regulatory-review-artificial-intelligence-bills-into-law\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">signed into law<\/a> a new <a href=\"https:\/\/leg.colorado.gov\/bills\/SB26-189\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">bill (SB 189)<\/a>, which repeals and replaces SB 205. Gone are the requirements for companies to proactively assess their high-risk AI systems for bias, conduct annual reviews, report discovered discrimination to the state, and use reasonable care to address known and foreseeable harms. What remains is a requirement for AI developers to share technical documentation (on intended uses, limitations, training data) with deployers but not with the public. Consumers get a notice that AI was involved in a decision and the right to request human review, which most consumers will never know to invoke. It\u2019s better than nothing, but falls short of ensuring meaningful, proactive accountability for high-risk systems.<\/p>\n<p class=\"dcr-130mj7b\">If the justice department can join a billionaire\u2019s lawsuit to kill a state law meant to protect consumers and support transparency in high-risk areas, what does that mean for other states trying to shield residents from AI harms in the absence of federal regulation? The message is clear: don\u2019t try.<\/p>\n<p class=\"dcr-130mj7b\">That\u2019s not pro-America. AI is an incredibly powerful technology, and its potential is greatest when it works for all of us.
