{"id":699304,"date":"2026-05-28T04:39:14","date_gmt":"2026-05-28T04:39:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/699304\/"},"modified":"2026-05-28T04:39:14","modified_gmt":"2026-05-28T04:39:14","slug":"australian-federal-court-orders-changes-to-local-documentary","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/699304\/","title":{"rendered":"Australian Federal Court Orders Changes to Local Documentary"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.judgments.fedcourt.gov.au\/judgments\/Judgments\/fca\/single\/2026\/2026fca0653\" rel=\"nofollow noopener\" target=\"_blank\">Australian Federal Court<\/a> has ordered changes to the credits and promotional materials of the local documentary, <a href=\"https:\/\/www.screenaustralia.gov.au\/screen-guide\/never-get-busted-39571\/\" target=\"_blank\" rel=\"noopener nofollow\">\u201cNever Get Busted!\u201d<\/a>.<\/p>\n<p>In a <a href=\"https:\/\/www.judgments.fedcourt.gov.au\/judgments\/Judgments\/fca\/single\/2026\/2026fca0653\" rel=\"nofollow noopener\" target=\"_blank\">landmark moral rights<\/a> ruling, the court found that filmmaker Stephen McCallum was wrongly denied recognition as the film\u2019s principal director.<\/p>\n<p>In a follow-up judgment, Justice Debra Shariff set out the remedies and injunctions flowing from an earlier liability ruling that found Projector Films Pty Ltd and filmmaker David Ngo breached McCallum\u2019s moral rights under the Copyright Act, as well as contractual obligations and provisions of the Australian Consumer Law.<\/p>\n<p>At the centre of the dispute was a battle over one of the screen industry\u2019s most valuable pieces of creative real estate: the \u201cDirected by\u201d credit.<\/p>\n<p style=\"text-align: center;\">\n<p>McCallum argued he was the documentary\u2019s principal director and should have received the clear attribution \u201cDirected by Stephen McCallum,\u201d but alleged festival materials, IMDb listings and on-screen credits gradually elevated Ngo as the film\u2019s creative lead instead.<\/p>\n<p>The documentary, \u201cNever Get Busted!,\u201d premiered at the Sundance Film Festival and later screened at the Melbourne International Film Festival.<\/p>\n<p>The court ultimately agreed with McCallum\u2019s core argument, finding he was the film\u2019s sole \u201cprincipal director\u201d for the purposes of Australia\u2019s Copyright Act.<\/p>\n<p>Love Film &amp; TV?<\/p>\n<p class=\"observer-desc mb-2\"> Get your daily dose of everything happening in music, film and TV in Australia and abroad.<\/p>\n<p> <img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2025\/08\/spinner.png\" width=\"30\" height=\"30\" alt=\"\"\/><\/p>\n<p>Justice Shariff found Ngo worked on the project as a writer, producer and director, but was not the principal director.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"size-full wp-image-271642\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/05\/MW-280526-15O5.jpg\"   alt=\"Stephen McCallum\" width=\"800\" height=\"433\" aria-describedby=\"caption-attachment-271642\"\/><\/p>\n<p id=\"caption-attachment-271642\" class=\"wp-caption-text\">Stephen McCallum<\/p>\n<p>The court examined a series of public representations surrounding the documentary, including IMDb listings, festival materials and promotional assets.<\/p>\n<p>Among the examples raised in court were changes to the film\u2019s IMDb credits, Sundance descriptions referring to the documentary as Ngo\u2019s \u201cdirectorial debut,\u201d and posters carrying the wording \u201cwritten and directed by David Ngo.\u201d<\/p>\n<p>The judgment found the combined effect of those representations conveyed the misleading impression that Ngo was the documentary\u2019s principal creative force, while McCallum\u2019s role had been diminished.<\/p>\n<p>That distinction mattered.<\/p>\n<p>What\u2019s in a name, you might ask.
