North Carolinians who are suffering from mental illness are sometimes required by judicial officials to undergo treatment at a psychiatric facility \u2014 a process that could become more flexible if lawmakers take up a proposal expected Tuesday.<\/p>\n
State Rep. Tim Reeder \u2014 a Pitt County Republican and physician who has been leading a review of North Carolina\u2019s involuntary commitment laws \u2014 says he plans to amend a bill he filed last month to encourage mental health treatment outside of psychiatric facilities. North Carolina\u2019s psychiatric facilities are often crowded<\/a> and understaffed, prompting hospital employees to report unsafe environments<\/a> to state regulators.\u00a0<\/p>\n Reeder recently signaled his hopes of expanding the use of outpatient commitment services through a House committee focused on involuntary commitments and public safety that he leads. The committee in April called on lawmakers to identify funding to support the expansion of outpatient commitment services.<\/p>\n \u201cThe system as it is currently designed is not set up to do this. We are hoping to update statues and create a more efficient and effective system for this,\u201d Reeder told WRAL Monday.<\/p>\n The committee launched its review of the state\u2019s procedures for treating people with mental illness after the August death of Iryna Zarutska, a 23-year-old Ukrainian who moved to Charlotte in 2022 and was fatally stabbed on a city train.DeCarlos Brown, the man charged in her death, was deemed incapable of proceeding<\/a> following a mental evaluation.<\/p>\n The General Assembly in October approved a judicial reform package titled, \u201cIryna\u2019s Law,\u201d in an attempt to keep more suspects in custody while awaiting trial. Brown had been arrested multiple times prior to Zarutska\u2019s death.\u00a0<\/p>\n However, legislators faced pushback<\/a> for some of the new rules. For instance, hospital representatives took issue with a requirement for certain criminal defendants \u2014 who have undergone an involuntary commitment within three years of their arrest for a violent crime, or who judicial officials believe to be a danger to themselves or others \u2014 to be transported \u201cto a hospital emergency department or other crisis facility\u201d for a psychiatric evaluation.\u00a0<\/p>\n Hospital leaders said they don\u2019t want the suspects evaluated in emergency departments because they could endanger patients and hospital staff. Hospital leaders said the evaluations should be conducted in jails \u2014 a suggestion Reeder said he plans to incorporate<\/a> into his bill.<\/p>\n Law enforcement officials have expressed concerns about proposals to require additional mental evaluations in county jails.
